    Some interesting bank balances included in a recent article on a judge freezing the accounts of Scott Tucker and his wife Kim and stipulating that they have an allowance of $150,000 to get them through 2 months. Oh the humanity! lol

    Before people defend or call for his hanging, or complain the banks are no better, or complain the Feds shouldn't be port of this. I don’t’ believe he was not arrested for the pay day loans per se. The charges are based on illegally incorporating on tribal land while really running his business elsewhere to evade rules etc. also I’ve heard of charges based on illegal debt collecting. No matter what your views on pay day loans they aren’t illegal and he’s not being prosecuted for them.

    They ARE illegal. That's the point. Native american tribes have tribal sovereignty so many US laws do not apply to them (like gambling, usury etc laws), but that doesn't mean it's legal, it's not. It's illegal usury that Tucker was trying to get around by saying they were Native American businesses and subject to tribal sovereignty. He's a scum bag predator.

    I do think the noose tightens ever so slowly (as the saying goes, the wheels of justice turn slowly, but grind finely). A part of me feels for the guy. His world is collapsing (well, it's already pretty much totally collapsed).

    Then, I remember his victims. Mostly nobodies. Who paid for this guy's private jet, race cars and extravagant lifestyle. I witnessed how over-the-top it was at the track, and I can only imagine the excesses off of it.

    He built a business based on usury, though. So, I guess he reaps what he sows. Innocent until proven guilty, of course, but the guy's painted into a corner at this point.

    He's probably not destitute despite the freezing of assets. His new company received a lot of funding a while back.

    As far as feeling for the guy - I've met him, spoken one-on-one, etc and he seems like a nice guy and had a rep for treating his team well. Having said that you could tell all the way back in Ferrari Challenge days that things didn't add up and as you said CW you can't overlook how he made his money.

    Absolutely true. And, if you're a crew guy, unless you were with a factory werks team, you wanted to be at Level5. Seemingly unlimited budget. Awesome equipment. Nothing was lacking.

    Our crew guys remind us that our trailer's old enough to buy a drink, now. So, I guess we're slumming it.

    I was impressed that when he pulled the plug he paid everyone through the rest of the contract - at least that's what I heard.

    I gotta tell ya, facing the full machinery of the feds is scary stuff. They have unlimited resources and time. They can grind and grind and grind. One act of wire fraud is 20 years. Plus, there is no good time in the fed system, all you get is one month per year. And forget about Club Fed. Not saying I feel sorry for the guy, just saying getting caught in the cross hairs is scary.

    Well, that's really the crux and heart of the case, isn't it? Always has been.

    So, this is, essentially, a motion for summary judgment by the defendant(s). Now, that's only my comparison (using civil legal terminology). But, I would say that MSJs are VERY hard to win. They are usually denied (always when there is a material question of fact), so I wouldn't expect these charges to be dismissed. The question then becomes whether this is an issue of fact or an interpretation of law. The latter being appropriately resolved by the judge. I think this is going to trial and all counts will be for the jury to consider, though.

    Unfortunately, ST's "lavish"-spending (jet, Aspen home, etc.) and racing "celebrity" lifestyle (in particular Level5 excesses like the DSR story) will be exhibit number one. If he earned the money legally, he should be able to spend it however he chooses, BUT the government will march a parade of spending excesses in front of the jury (assuming this won't be a bench trial), and that will NOT be in his favor.

    I know I mentioned it before, but I was always staggered by the unlimited budget gear you mention. That trailer really fits the bill.
