    Once you accept and cash the insurance company's check (which the car owner did), lawsuit options are severely curtailed. Cashing the check is de facto acceptance of the full payment of the claim.

    Its true. In a select few cases I have instructed my customer service to not apologize and give nothing because we wanted to get rid of the customer permanently.

    Maybe this price gouging game by the dealer should be looked into by the Attorney General. It's a price fixing game where you are paying more for a used car in order to buy a new car. The Dealer was not willing to part with one dime out of their pocket. It is not a great deal to get a new car for $80,000 - $100,000 more after you are a victim of a crime. It's not a game. This is a joke. You trust a dealer to take care of your car while it's in service. Due to the service center not taking the time to keep the keys locked up, or even keep track of your car, you lose your car, it gets trashed, and then you are suppose to be thrilled you are now eligible to buy a new car at full price, and only spend $80,000 - $100,000 more. Awesome ! Ridiculous Business Practice !

    Your Ridiculous ! No one is rallying the Ferrari community to bing down a small business for personal gain. We are warning you about what happened to us could happen to you, so be careful dealing with them, if you take your car in for service. If you can read. We don't expect anything from this dealer now. The dealer already showed us their crappy customer service after we gave them a month to help us. If it happened to you we would see how dispicable you would be.

    I would call it supply and demand, free market, capitalism ...

    What is going to be investigated? They are selling cars at MSRP, they are selling used cars at market value ( what a buyer is willing to pay )

    Just because you are not willing to understand that they were willing to take substantial loss to offer you a new car at MSRP does not mean that they did not offer you something that has value to many many others in the Ferrari Community .

    And we are still only hearing your 2nd hand opinion of what happened and how the actual owner of the Ferrari in question has been treated.

    In the end, there is another Lamborghini on the road with a satisfied owner... and there is an 458 that needs alot of attention to be made right again.

    I really do empathize with the situation...

    No one would have know anything about this incident as the Victim of this Crime gave the dealer a month to rectify the situation and help her. She was told after her car was stolen that they would make it better for her than when she first purchased her car. Then she was told what a great deal she got for the Insurance money, and that if she sold it to them, they would not have paid her as much.

    She waited for a phone call that never came from the owner to apologize, and she was very kind, and nice in dealing with them. Too nice, they took advantage of her. Yeah ! Her big Italian family is pissed off about the way she was treated that's why the press was notified, and this chat was started.

    The Ferrari dealer is not a "small business". It's a "multi-million" dollar business as I stated on my comment.
    "Be careful who you give your keys to because you may never see your car again," - These are your words and you're not attempting to shut the business down? Surely you jest! You have an axe to grind. Drive your Lambo more and move on!

    After 24 pages you still haven't made an argument that makes sense. I feel bad that your girlfriend's car was stolen but most of that empathy has been washed away by the written nonsense that the two year old car was "special" and somehow became a family "heirloom" because she had a relative that made something of himself.

    As you have discovered, both arguments fall on deaf ears with the insurance company, the car dealership and likely with any court in the US. Why? Because what you are trying to get is MORE MONEY. You can paint it with telling us all about the bad customer service and poor business practices but all that would have gone away if they gave you MORE MONEY.

    By your own words you indicate that posting on Fchat is only happening because they didn't give you MORE MONEY. It is a disingenuous argument (bordering on libel and extortion) to make. Fortunately most US courts see through this type of nonsense. As others have pointed out.....if it was totaled in an accident....would you be making the same nonsensical arguments?

    Scratch that ......of course you would. Why? Because you would want MORE MONEY.

    You are either absolutely clueless or you work for the dealer. Do you have a vested interest in their business? In business they are considered a very small business. The dealers net worth is not worth arguing about, so how about you get a life and move on. I am over the absolute stupidity of these chats.

    When I hear this story I feel for your girl friend(?) but 2 things. We have heard from you, not the actual "victim". So we don't even have her side of the story (after 10 pages I read here and how many on the other thread?) We don't have the dealerships side of the story either. It's a bad situation but hard to pass judgment. I can't take your side or the dealerships side at this point. One thing I have learned is there are 3 sides to every story, yours, theirs and the truth.

    This thread has gone the way of several in the past. I think one major thing to consider is the main motivation of OP, which seems obvious when one notices his join date was 12/22/17 the same date as his first post. This thread is just a method to “get even” with F of Newport Beach and bash the Ferrari brand, not so much to inform the general Ferrari public.

    So with that in mind and not hearing from the actual injured party or the dealership I would think most Fchatters would be inclined to withhold judgement relative to how the dealer responded to the bad situation they were responsible for creating by not having better control over their customers vehicles.

    When someone works very hard for their money to buy a very expensive exotic car, and wants to pass it down to another family member, it becomes an heirloom. The same as a $50 watch, or a piece of art. Why is that a joke? You must be jaded to think a 2015 Ferrari 458 Spider is a worthless car, not worth keeping, and how jaded to think that after you are a victim of a crime due to trusting a service center to keep track of your car that you would not want every dime it's worth. Your argument is a disingenuous argument. You non-chantly throw around words like Libel and Extortion, which you obviously are just spouting off nonsence, and don't even understand the meaning when everything said has been very well documented, and the truth.

    So how much did you get from the insurance? How much of a discount did you want on a 488? As for the dealership leaving the keys in the car, did they leave to keys overnight or was just in the day time so they can move cars around? Does the Lamborghini dealership you bought your car from have security in the service area? I am asking because looking at all your posts, the dealership in my opinion did everything the could to accommodate you. As for security, I have never really seen security guards at high end dealership's, I could be wrong. I am sorry of what happened to your car, a really crappy situation.

    Your girlfriend buys you a Ferrari and you call it at "heirloom"???? That is infamously ridiculous when you demand the Dealer should pay you the original sale price of the car. Your girlfriend at least had the sense to cash the insurance check. Also..... you really need to work on your sentence construction and spelling.

    BTW what happened to your promise of "being done" with Fchat?

He sounds a lot like the dude from Beverley Hills (curb stoning & not his car ads) previously going off on rants about almost anything.Now he just wants to argue with anyone who does not agree with his position.     It is amazing to me how many people do not know the difference between "your" and "you're". I don't know if it is laziness or general stupidity but I keep seeing this pop up more and more.
