Debt question

If a guys marries a woman with bad credit, does that make the husband responsible for the debts his wife had before they married?

For example, say a guy meets a very attractive woman. They hit it off and date for a year. Guy proposes to the woman, and she accepts. Later, the guy finds out his fiance is in debt to the tune of $100,000+. She defaulted her student loans, she never paid off her credit cards, she is loaded in debt. The guy is successful and owns multiple properties. If the guy marries the woman, can the credit card companies and the student loans go after the mans property to pay off his wife's debt? Does it matter that she was in debt before they married? Or does marrige join the debts to both people?

What about property they own in common after marrige? Is that fair game? For example, if they buy a house they live in together.

Joint property or property uou acquire after marriage is fair game.

You should have a pre-nup that covers this.

Marriage is a very serious contractual arrangement.

As a banker/lender i would file judgment against any joint property.

The judgement would cover any property she attains thru divorce, legal separation or death.


each state is different. If you are in a state like Calif. I hear it can get gruesome, but I have no first hand knowledge.

My cousin in California had the IRS pay her a visit right after (days) she married a guy with alot of debt to them which she had no idea about. He was out of there that day and she terminated the marriage.

If your bride did not divulge this before marriage, I would have areal problem. If you can't totally trust someone, there is no basis for marriage IMO.

Which state? You probably need a lawyer to get the right advice.

Aside from keeping the property separate, you've got at least two other problems: 1) even if they can't get to your property, they can make life miserable for her and that could affect the relationship (the amount of handholding and support she needs), and 2) if she was that bad with her separate finances, you'll have to keep an eye on her spending after getting married and that could also affect the relationship.

 

Hate to tell you this pal but your marriage is already on pretty shaky ground if she lied to you about owing 100K+ in debt before you married her - mine only lied about not being able to have children (smile).

It doesn't matter what state - you're on the hook.

You need to decide whether you love her and eat the debt- or file for an anullment if it's still recent.

This is the kind of stuff that will fester and it doesn't turn out well...

 

As soon as you commingle accounts and property then her bad credit/debt will affect the guy's good credit. If I were the guy I would tell her that we'll marry(or live together) as soon as you get your credit cleared up. She will either turn it around on him and make it likes it's his problem or she'll be gone in no time. Not unless you're looking to drag yourself down this in a no win.

Did you own the property before you married her and is her name on the deeds? If you bought the property before you where married, then it is yours and she cant take it. Everything you bought after the marriage is fair game. If you marry someone with bad credit, your credit will defiantly be effected after your marriage
