Yea, maybe--Can't imagine Ferrari would sue him over someone that small, but Ebay will pull his listing for trademark violations---That I know for a fact...

What is the difference between him selling the wall sculpture and people selling other things on Ebay Ferrari related? How would it be a violation? I would think it would be the same thing.

I asked the guy why he is selling the car and giving away the sculpture--His reply

    Dear XXXX285,

    Hi

Thanks for your question. Hotwheels are "MORE POPULAR" than display signs. More people "search" for hotwheels than signs/banners, therefore it was a marketing decision to list the hotwheel and give away the sign. But your idea is good too, but what incentive is it to receive a hotwheel as a free gift??

Thats not true. Have you seen all the stickers and patches for sale? How about Ferrari crew shirts for $19.99? They are all made in China (crap), and they are for sale everyday on Ebay.

I check Ebay daily, and have always seen fake products, they never get taken down from listing.

Right. So I guess that means my iPod (also made in China and works flawlessly) must be crap too.

I meant that the counterfeit Ferrari shirts are all made in China, and they are CRAP! The detail, material and graphics are all poor, thats why you pay $19.99 for the shirt.

The original post was about the legality of selling fake Ferrari products, and I haven't seen any actions taken by Ebay to stop the sale of them.

Heck, half of the products on Ebay are counterfeit/fake. Versace dress shirts...Armani jackets..... 2 for $199 ? Shipping from Hong Kong...they are as real as the tooth fairy.

Ebay doesn't really care. Ferrari has someone assigned to watch stuff like Ebay for counterfiet items-that person contacts Ebay as a rep for Ferrari and asks them to pull the auction----Ebay complies and pulls the listing-At any given time there are roughly 6,000 items related to Ferrari on Ebay---That person can not catch everything. But I know for a fact someone does watch as best they can. I have personally had listing pulled because the item was not an Official Ferrari item..The email I got from Ebay said if I had any questions to contact Ferrari, S.p.A. and listed there NA address for Ferrari

I wonder if the sign is stolen from a shop and he doesn't want to draw attention to the fact that he's selling it on ebay. If you're looking for your stolen sculpture, you wouldn't think to look for a hot wheels car auction... maybe I'm just cynical this morning.

I've seen guys locally selling Ferrari jackets and shirts (fake !) out of the back of their vans.

Early last year I remeber seeing one guy parked at the gas station, selling leather jackets along with other crap. Its not stolen, its just crap and he's trying to sell it off as something that its not.

    Buyer beware!

what I find funny is how the seller seems to think that his particular Hot Wheels car is the second one produced of a run of only 36 when in actuality the design is #2 of 36 designs. Therefore its not as rare as he either thinks it is or is trying to sell it as...

Ok, so I'm a sucker. I bought this (yes, the $190 hot wheels car...... AND the sculpture).

The sculpture is not bad actually. I can't figure out how to mount it to the wall, you must have to make your own mounting device..... like drill a hole in the back of it or something. I'm thinking I'd like to mount it raised like that one picture, and put neon/led's under it. Would look great in a garage, but I live in a condo so I'm going to put it on one of my walls somewhere (and I'm single, so I can do odd things like that).

It appears to be a plaster mold of some sort, painted black (seems like some type of enamel paint, not bad actually).

Yeah, I took a chance, would have sucked to lose $200 bucks, but I got the hotwheels AND the sculpture, anyone want a $200 hotwheels car now? All I wanted was the free gift :) .

The only small negative point I would make is that the seller wrapped it in plastic wrap for safe transportation, but the plastic is the clingy type of stuff, and some of the enamel paint came of, just on the ears/hair though, and it was an easy touchup, but I'd recommend the seller wrap it in styrofoam stuff before putting the plastic clingy stuff on it.
