    Hey, I just wanted to inform you about a weird thing happened to a guy lives near me. Last year he bought a Ferrari. The day after he bought it he parked it in front of a market to buy some things. After he left the car and entered the market, the car started to go down by itself. He ran after it but could not catch. He sued Ferrari and he had been waiting for a year. Yesterday I learned from a friend who knows the guy that he is still waiting for a reply from the court and Ferrari. Poor guy is waiting for his Ferrari for a year. That incident made me question my trust to Ferrari. They are not backing up their cars. What are your thoughts? And I am not sure if this is the right place in forum for this topic.

    Maybe he should have run faster?

    Why is he suing and for what? I don't quite understand.

    My dad once left his Corvette in neutral and forgot to pull the e-brake. It rolled down the street and ended up on a neighbors lawn. Perhaps we should have sued Chevy?

    He parked on a hill & didn't set the parking brake?

    Or? Did the "system" fail - A lot are electronic these days....

    I'm guessing you mean he parked it on a hill with hot brakes and when the brakes cooled down the car rolled away down the hill? If that's the case, I really doubt a lawsuit is going to be successful - it sounds like something he should claim on his insurance as at "at fault" incident.

    I wondered what on earth he meant by going down, was it an inflatable Ferrari? Haha. Should've left it in gear, and if on a hill, parked with the wheels set to pull to the kerb for extra security

    This CAN happen with a 458. In fact it happened to me but I caught it. You can put the car in car wash mode and it will free wheel.

    I'm not sure that makes it Ferrari's problem though. If you don't put the parking brake on in a normal car and it rolls down is it the manufacturer's fault or the driver's fault? The parking brake in a 458 is a manual lever you pull. Its not "automatic".

    I say driver's fault. If I were Ferrari I'd say talk to your insurance company because the car worked as it was engineered to.

    Sounds like somebody is suing Ferrari for a mistake they themselves made.

    I got one in San Diego once. Wasn't even a steep incline like some in SF. :(

    Why is he sueing Ferrari? Just put in an insurance claim under collision, pay the deductible and collect a check, "stupidity" is not excluded under any insurance policy that I am aware. Much less hassle and outcome is predictable.

    Had he parked with the front wheels turned towards the curb, the car would have rolled forward then stopped against the curb.

    But, as noted, if it's not steep (SF style) it shouldn't be a big deal. I got a ticket for not doing it in San Diego years back though......

    Shame we haven't heard back from the OP. Looks like he logged in earlier, but no posts. :(
