A friend of mine got cought doing about 20 over the posted limit and does not want the ticket on his record. Anybody have any luck with an attorney who successfully got them out of a ticket?

If it's in Tarrant County try James Mallory in Fort
Worth or Jim Lawler(-sp) in Arlington. I've taken many to both of them.

It's very easy to get deferred adjudication these days, often times it's an option right on the back of the ticket. Either use a traffic attorney or contact the court clerk for details..

Mallory is OK, doesn't really defend a ticket but does all the defered adjudication paperwork for about $50 or so. Communication with the firm bites through, you got to stay on them.

I've used Mallory many a times in the past 10 years. He has always come through for my wife and I. This is one of his specialties and his paperwork is very clear and specific. It will take some months to get the final, but hey that's the court system, not Mallory. His office is spartan, and needs updating, but hell - if you want the nice office - go to upscale Dallas and pay for it.

I...um.....know someone...yeah....that's it...that got a ticket in Mesquite a few weeks ago. Deferred Adjudication was an option on the back of the ticket. Please no contest, pay the fine, don't get another ticket in that city for 90 days. You're done.

Don - Your friend needs to post further details. Relaying speeding issues is difficult unless he wants to get a lawyer or just wants the court to win.

Deferred adjudication is ok, and will prevent the ticket from going on your record, but in the end, the court wins. The ticket is X amount of dollars and the deferred adjudication is X+another sum of dollars, which usually equates to about 200 or so. Traffic court is NOT the law. Traffic court is a business, and anytime you cough up a dollar, you lose. Reduced fines, you still lose. But if your buddy is worried about points and insurance increases, he might not be worried about the court costs. I just have a problem with coughing up a dollar in traffic courts.

your buddy can always take an on-line defensive driving course. Costs $25, and a bit of time. Lowers your fine, and keeps the ticket off your record. Only doesn't work if you've already done one in the past 12 months.
    Potentially lowers your insurance too

I have yet to see one for $25. The online classes are usually $40. This also doesn't include the court costs, and DD fee, which varies per county/court and the $10 for your certified driving record.

In my case(s), the tickets are usually justified. At one point in 2002 (before I had the car!) I was on DA in 6 cities at one. Just a string of bad luck :D As long as I can keep them off the official record, I don't mind the DA costs.

I've done that too. Not six, but four counties. When it came to the fifth ticket in a different county, which was actually 3 tickets in a particular stop... well, I was caught after the judge did more research into it. That's when I did DD Level II, which was offered 3-4x's a year for 12-15 people and was a 2 day 12 hour class, plus the 100 hours of community service, and mo dollars.

    Tillman,

Yea that's my opinion too, I don't mind a few DA's, if it doesn't go on your record. You have me beat on the number at the same time, man I thought 3 was enough at the same time.

Shatten, I knew that recently they started checking in other cities and counties, when I had my 3, I had them in Fort Worth, Arlington and Dallas. They never said a thing, just took it to the Lawyer and DA is what I got.

Defensive driving can only be done once a year, so save that for state troopers.

Insurance companies are wising up to people who are taking defensive driving in order to get off the hook for a citation, and then turning a copy of the "completion certificate" into their insurance to get a discount.

Be prepared, in a couple years, all the insurance companies will require that you take thier own course if you want a "defensive driving course" discount. Some already do this. It won't do you any good with the courts, because it's a shorter class, and doesn't meet the state's requirements to get you off of a ticket.
