I'm finally getting my F430 !!!

    The second letter in MSRP is important. The dealer is (normally) an independent entity which is not obligated to charge MSRP. He can charge any price he wants.

    That said, I think Ferrari frowns on dealers charging over MSRP for a wait listed brand new car. They encourage dealers to comply by using a very powerful incentive -- allocation.

    Although you may be told you need to buy from "your" dealer, you are under no obligation to. If you contact another dealer and insist on purchasing through them, they cannot legally prevent that. At least that's what a (non-Ferrari) dealer told me.

    I called a number of dealers when I started shopping last fall for a 360, and every dealer I talked to out of my area said they weren't interested in my business. I don't know how to get around that on a car with a waiting list.

    Yea, there not supposed to sell to someone who is from out of their area and serviced geographically by another dealer.

    Wow, I'm in the wrong business! Let me get this straight. They are selling $200K+ vehicles, there are not enough made to satisfy the demand, they turn people away and you have to get on a waiting list to buy one? DAMN.

    Did you have to buy used to get your TDF 360? (Absolutely BEAUTIFUL car, by the way -- seriously. It is a work of art that happens to be a great performing car, and yours is my favorite color combo)

    This F1 vs stick debate is getting old. It should be combined with the other two longstanding unresolvable F issues -- Tubi vs Capristo and red/tan vs all others. Maybe even add the stripe, no stripe CS issue (realizing that someone will say "you can't get a CS stick".

    I'll go. stick/Tubi/Grigio Titanio/no stripe

    The combinations should keep us fighting for days. This is like arguing over which woman is more beautiful.

    Here's my theory: Whatever car you currently own and the tranny it has is the one you prefer b/c it is the car that has given you the most joy and you have become attached to it. I was an old school, die-hard, manual stick kinda guy yet now I have an F1 and guess what...I am having a ball with it too!

    People crack me up...if you got unbelievable deal on a car that you think has the tranny you don't prefer, I would guarantee after driving it you would prefer this car now.

    Trust me, whatever tranny you get it will bring you a boat load of fun.

    So, what warren is saying is that the dealership has the right to force him to sell it back to him? Jeez... that's steep.

    I think it's more of a "gentlemen's agreement". I doubt that it would be enforceable by law (but I'm not a lawyer...). In any case, you probably wouldn't be able to order another Ferrari from that dealer for a good long time if you violated the agreement and he found out about it!

    HERE IS THE AGREEMENT THEY WANT ME TO SIGN TO ORDER A F430. THEY SAID THEY WOULD LOCK IN THE PRICE OF $15,000 OVER MSRP. BUT, PLEASE LOOK OVER ALL THESE OTHER CONDITIONS AND LET ME KNOW YOUR THOUGHT? THIS IS ABSOLUTLEY RIDICULOUS FOR ME AS A BUSINESSMAN THAT CAN AFFORD TO BUY ANY CAR INCLUDING AN ENZO TO GET LOCKED INTO THIS TYPE OF A CONTRACT.

    COMMENTS?

    WHAT ONE MUST GO THROUGH TO GET ON THE "F430 BUYING LIST"
    This order reservation and deposit agreement made on July 23, 2004 between X Corporation, hereinafter referred to as “Dealer” and, an individual, hereinafter referred to as
    “Customer", sometimes collectively referred to as the "Parties".
    WHEREAS, customer is desirous of placing a special order for a Ferrari 430 Coupe, hereinafter referred to as
    “Vehicle” and;
    WHEREAS, as the factory authorized dealer for Ferrari in the State OX x is willing to
    engage in the process of ordering, acquiring, and retailing the Vehicle;
    NOW, THEREFORE, in consideration of the terms and conditions hereinafter set forth, both the Dealer and the
    Customer, hereby agree to the following:
    1. Order Process. Dealer will accept and place a special order for the Vehicle with Ferrari as per the
    specifications set forth by the Customer. The initial specifications for the Vehicle are attached to this
    agreement. Within thirty (30) days prior to the Vehicle going into production at the Ferrari factory, the Dealer
    shall contact the customer and schedule a final review meeting to review and finalize the specifications for the
    Vehicle. At this time the parties shall further define the terms and conditions of this transaction by executing an
    addendum to this agreement.
    2. Deposit. At the time this agreement is executed the Customer shall place an initial deposit of
    $5,000.00 with the Dealer. Should the Customer decide to cancel this order after the execution of this
    agreement, but before the Vehicle goes into production at the Ferrari factory, 30% of the initial deposit shall be
    non-refundable. Upon the execution of the addendum to this agreement at the final review meeting an
    additional deposit of shall be due. The initial deposit and the additional deposit will be 100% non-refundable
    upon execution of the addendum to this agreement and/or once the vehicle goes into production. All interest on
    deposits shall be retained by the Dealer.
    3. Vehicle Pricing. The price of the Vehicle shall be negotiated and finalized at the final review
    meeting, and shall be established by the Dealer according to the fair market value of the Vehicle at that time,
    but in any event, not less than the Manufacturers Suggested Retail Price. All applicable taxes and fees,
    including, but not limited to gross excise tax, import use tax, license and registration fees, document and
    handling fees, as well as dealer installed options shall be at the expense of the Customer.
    4. Transfer Restriction. This agreement is non-transferable. The Vehicle must be registered in the
    State of X to the Customer and cannot be transferred or assigned in any way whatsoever.

    My deposit was with FoW and it is FULLY refundable and i had to sign no such "contract" full of restrictions.

    This sounds outrageous. Who is the dealer?

    I AGREE. My deposit is a downpayment towards the MSRP and there are no restrictions on selling or time periods or where I keep my car.

    my dads on the list at FoBH, does anyone know of any restrictions they have? If my dad went through with it, it would be his first Ferrari purchase EVER, so I doubt that makes him much more then a speck on the list, but we'll see.

    my guess is no. all of these supposed stories about dealers' imposition of limitations sound really fishy, and it's very telling that the names of the dealers hasn't been revealed. If I'm wrong, I'll give a humble bow. If it is true, then the name of the dealer should be revealed and FNA notified.

    A deposit is and should be refundable if you want out. Moreover, dealers cannot sell new cars above MSRP. Period. If you order the car directly (i.e. aren't buying someone else's new car), then you will pay MSRP.

    YES, THIS IS AN AUTHORIZED FERRARI DEALER and NOT a BROKER/DEALER. As suggested buy a Ferrari Chat member, I contacted FNA today and I am optimistic they will be able to help me finally buy a Ferrari.
    THERE IS NO WAY AS A SUCCESSFUL BUSINESSMAN I WOULD NEVER EXECUTE ON A CONTRACT LIKE THIS. When I saw this is was amazed that an authorized DEALER could do something like this.

    I'd rather not mention the dealer name now since I am in discussions with FNA. Thanks again, I will let all know my outcome.

    I am glad you are not going to sign that shady contract. I figured that someone who had the means to get an F430 would know that the contract the dealer was offering was not right. Good luck and definitely keep us updated.

    James at FoBH said that as of now, anyone on the waiting list will pay MSRP when their day arrives, but he doesn't have a whole lot of information right now on the car, it's just a list at this point, they aren't even taking deposits.

    I just met James today at FoBH and he couldn't have been a nicer guy. This would be my first Ferrari also so I went in there thinking I would be lucky if my name ever comes up. Well, he said I WILL get a car but he couldn't tell me when. I thought I would be lucky if my name comes up in 2-3 years and he said I may be pleasantly surprised! He also said they will give their old customers priority first while also allocating some cars for their new customers too. I really appreciated him treating me like as if I have been doing business with him for years. So I really felt good and hopeful after leaving the dealership. James also said that the F430 will have chains instead of timing belts so that should make the F430 cheaper to maintain hopefully. Along with about 100 more horsepower, the F430 should be a great first Ferrari! I can't wait for my name to be called.
