Uh - that's assault with a deadly weapon (see "OJ Simpson") - not speeding. Edit - oops "murder"

And the speed limit thing - went into effect well before any oil crisis, maybe not on the freeways, but definitely elsewhere.

This sign was has one purpose - to raise revenues

That's what speed limits are for... To raise money for the state... So you can catch me being defiant, flying down the interstate, top down, putting everything in front of me, behind me... :)

Almost had me for a second. I like that you have used your interpretations of my musings to turn them into my own words. No, I didn't say (or even imply) it was fair. No, I don't believe in any "safe speed". No, I am not cheering the system, just living with it and dealing with it. My point is - there are rules, play by them. If you don't like them - effect a change - don't just sit around and complain about them.

You make several good points - yes, the VAST majority of speeding is harmless (for that matter, so is drunk driving), but if you get caught, or you crash or kill someone, then accept the responsibility. Yes, car enthusiasts are far more safe than the average minivan mom or doddling old guy. And yes, focusing on speed limits to create safer roads is indeed a farce, but it is a small start - your suggestions for creating safer roads (40,000+ a year die in the USA alone) is....??

Unfortunately, your good points are lost on me when it comes to sophomoric name calling. I am not a glassy-eyed stooge and I am awake. I'm just not mad at the rest of the world anymore and don't need to blame others for my problems. Feel free to look into that concept.

Fighting a ticket according to legal procedure and exercising the rights given to you by society *is* playing by the rules. It's just not rolling over and crying "uncle", as you seem to be advising people to do.

You're right. Maybe I'm just feeling a little melancholy over my friend's "accident" (a quaint phrase, isn't it?). I'll wait and see how the other driver pleads.

Nothing quaint about it. If it wasn't intentional, it was accidental. Disagree?

You should not allow your grief to cloud your judgement, or surrender your rights without question, especially when it may simply be a case of people abusing authority to take advantage of you.

Sorry to hear about your friend.

It may be a law to not speed, but so what? I'm not 100% sure if my dad was speeding or not, I just think that it's not that big of a deal to be going 10 over in a fairly clear area. Tesseract- Are you insinuating that I leave the country because I don't agree with this ticket? It's not that big of a deal, but if he can fight it, and has a good chance of getting it dropped, why not? A law is a law, but that doesn't mean it's always in order. Excuse me if I sound naive; I'm very faimiliar with this area, and that's probably what's ticking me off the most.

If this was in the city on a one way, I don't think speeding should be tolerated whatsoever. There are no buildings/pedestrians/hazards around this area. I'm trying to look at it from a common-sense angle. If this isn't really endangering anyone, is it that big of a deal? My point-of-view might have something to do with the fact that I see people go 70+ on this road everytime I go on it.

It also could have something to do with the fact that when I was in highschool, I saw 5+ crimes commited everyday. From substance abuse, to traffic violations. I never saw a cop near my high school. This cop just happens to be sitting a couple miles from it. Maybe I'm being hypocritical, oh well. Thank you, everyone.

EDIT- I'm not trying to complain about the law, but I strongly believe those laws were *supposedly* placed there to protect people. If he wasn't putting anyone at risk, including himself, I don't think that it's something that should be prosecuted. I know I'm going to get bashed for this. ;)

No, I find your views entirely reasonable.

Being singled out for a law that may or may not make sense, and whose application in a certain situation does not make sense at all...well, that just sucks.

Talk to the prosecuting attorney. They will take his record and age into consideration. Since he isn't a kid that they feel needs to be taught not to speed they should be willing to drop it to something smaller. In my area they will drop them to a charge for no seatbelt. I have known people to have the DA's office throw them out if they were not too high over the limit.

You could also talk to the judge if the ADA doesn't want to help but if he wants to sentence a small fine you will have to pay court costs. You have to decide if that is worth it.

The prosecuting attorney would not reduce my ticket for 17 over. Since he would not agree to a lesser charge we talked to the judge who gave me a $50 fine and agreed to deep-six the ticket with nothing on my record or being given to the insurance company. While after all fees I ended up with a total price just under the ticket price I didn't have to worry about my driving record. In Louisiana you can use article 894 to keep it off of your record but if you get a ticket soon after then they both go on your record.

we need a spell check on here. LOL

Right on... America thinks America needs America to hold America's hand and watch it and guide it and slap this big-ass diaper on society and put up rubber walls all around us so we don't kill ourselves... America has figured out a way to severely slow down Darwinism and that's NOT good...

As for being in high school, exposed to some of the lower points of life while Mr. Protect & Serve sits a few blocks away, hanging out his window, waiting for easy money to pass - well, that's just a bad-taste result of America letting America do everything for it...

Lastly, i don't think you need a lawyer; only time i ever had an attorney when i did something wrong was when... well... nevermind about that. :)
Have your dad plead not guilty and go to the hearing... If the cop shows up, then you need to fight; if he doesn't, they'll reschedule a hearing... If he shows and you need to fight, you need to know some stuff... How did you gauge your father's supposed speed...? Radar...? Request to see documentation that the officer in question is radar certified; it's my understanding that they need to take refresher courses every two years... Ask to see documentation on the last time Mr. Jack's money- i mean Radar gun was calibrated... They need to be calibrated every so often... If it was a different means with which Mr. Uphold The Law gauged your father's speed - such as a visual 'point A to point B' assessment, then find out when the last time was he took a refresher course on that...

Oh, and as an after thought, find out exactly how far back there was a speed limit sign before the point where The Man got your dad... Is the sign clearly visible...? If The Guy With The Gun radared your pops, what was in the immediate area...? Were there other moving cars around...? In front of, behind or side by side with your dad...? Cars going in the other direction...? Is your dad's car shiny...? Are there other shiny things in the area, like a big, glass building...? If radared, was there anything blocking The Pig's line of vision/radar...? Keep us posted...

OK, well, to answer a few of your questions, I think the speed limit sign was pretty far back. I have to go down that road today and I'll take a look.

I will ask my dad if there were any moving cars around.

His car is fairly shiny. He put the company logo and everything like that all over the car. It's all vinyl. Then he has a bug deflector which is pretty shiny, as well.

MY dad told me the cop said he had him on the radar. I've been trying to find the law, for Colorado, that talks about radar use and training.

The pig's line of vision was, actually, pretty good. I'm making a 5 year old's picture in paint, and I'll upload it once I find out where the other cars were.

    Thanks :)
