Hi, my name is Allan and I would like to welcome you to the flame thread. Before Maranelloman and Art ever owned a pathetic Ferrari I was kicking a$$ and taking names in my NOS powered Diablo. I was the original FChat flame warrior and knew how to keep a fight on track. LAMBORGHINI vs. FERRARI is where it's at, none of this ***** bullschit threatening to sue or report to the IRS. Unfortunately I got banned for my trouble but I leave to all of you this thead which will be the home for all the flaming and personal attacks.

Don't hold your breath on this one, if it's like any of the other numerous times he's been asked to respond to his posting crap. Reason? He doesn't have to because he's exempt from answering by reason of being an attorney and taking the fifth.

Sorry Sunny, but I'm going to have to defend Art on this one. It sounds like what he did was legal. I know of many people who do the same thing.

Do you know anyone that will pay a tax when he knows of a legal way to get around it? I sure as hell wouldn't. I don't think that it matters which side of the political fence you lean on. We all want to pay the minimum in taxes that we can. That's why people spend buco bucks on accountants each year.

So, it's really none of your business.

Dom, all you need to do is call your DMV and ask if you can't understand the written laws.

Point was, Art was soo sure he was correct. My point is, no, he's not.

You make it everyone's business when you proclaim it in a chat room, "I got around my taxes because of x,y,z."

You and I don't do these things, most of the membership here doesn't. Art did. I'll call this a momentary lapse of judgement on your part (thats a joke)! ;)

Hey, I'm not flaming!!! I am proud to consider Sunny in my circle of Fchat friends.

I posted based on what I have inferred from reading the various posts about art. From the linked post, I don't see any info that Art is incorrect. Furthermore, I infer the following:

    1) Art, like everyone of us, would like to avoid paying taxes
    2) Art is a lawyer, and thus knows the law better than the average joe
    3) Art also should understand the consequences of breaking the law

I would guess from the above that what Art is trying to do is legal. You could argue the ethics and what not based on his liberal leanings (but why bother, we all want to pay less taxes), but I don't know that you can argue the legality without more details.

I hope that clarifies things a little.

So, did Allan really write that, or was it somebody impersonating Allan? It seems to me that he could post phantom responses on his site, which could then be imported here by others, but i didn't suggest that....

Secondly, sorry it took so long between posts, but, you know how it is when you're inspired by your antique burlwood top desk, as you sit in an oh-so comfortable antique rocking chair and play Jet Airliner on your Resonator Guitar. What, you don't have one? Pity, really. Everyone should.

Did I mention I have a guitar? Or my desk? Or my chair?

Oh, I see, I have, ever so noncholantly, every so often.

Did I mention this is a single-cone Resonator guitar? Tri-cones, if you haven't heard, aren't as loud.

By the way, it has a rosewood neck.

I use heavy strings, as it really brings out the tone. Girlie-men shouldn't use heavy strings.

I play fingerstyle. Ten fingers a-wailin'. Picks are for mere mortals.

That's bull ****! Did you learn the guitar on heavy strings? I mean everyone has to start somewhere and build up. Jimi, Eric, and SRV used picks. What, you are better than them!?! You are such a pompous ass. I saw you already got banned at AucosticGuitar-Talk.com! I do love the picture of your guitar though. VERY nice! I would like to put my hands all over it.

Keep the cdar out of state, register it in Oregon, use it in Oregon, after 120 days, bring it into California, and tell them that you originally intended to use the car in Oregon, but the useage failed, and you should not owe any use taxes. Check to competent tax counsel in Calfornia and you'll find I'm correct.

    "Robert:

I would register the car in Oregon where there is no sales tax. I would also rent a cottage by the water, and keep the car there. That provides you with a reason for registration of the vehicle in Oregon (a valid one) and I'd use the cottage. That way you had a REAL reason for the out of California registration, and if California were to attempt to collect the tax, calling the out of State registration an attempt to evade California Tax, you have a valid reason for what you did. While the statute says 90 days, I would keep the car out a little longer than required.

    Robert:

contrary to what some say, I was NOT advocating tax fraud. HOWEVER, if you do have a place in Oregon, and plan to use it in Oregon, and THEN change your mind, and the vehicle is kept out of California for at least 90 days, there is really nothing DMV can do to collect the taxes. If you use this for a PLOY then expect to get caught, but if you have the place in Oregon, go up to use the car while it is there, and then bring the F355 back to California, there should be no tax. IMHO

You can't just keep the car out of state. You must have an intent to use it out of State before you can escape the California Sales tax. The penalties are too great to try this without getting it right and complying with the law.

I hope for your sake that no one from DMV monitors this site. The penalities for attempting to commit fraud to avoid the use tax are stupendous (sometimes equaling the purchase price of the vehicle).

That same Tyco CEO also sold his 456 to a friend of mine at a very good price, maybe related to the art work, or being caught for same.
