    2003 R6, pristine condition, 6200 miles, never been dropped, ($1500 mods).

    I got my tires (Pilot Powers) mounted today ($146 rape, but I wanted to ride...), so I come back 2 hours after I drop off the bike, touch the car door handle ready to walk into the store, and my cell phone rings.


    "Hey Jason, It's Doug.... You should probably come to the shop now. We mounted the tires, and did the inspection, but theres a problem......."

    "Yeah? Well What's wrong?"

    "...... Well the mechanic took the bike for a test drive and went down... "

    "Is he alright? I hope he's not injured.... Is the bike messed up?"

    "Well we'll have all the repairs done by next week. I'll expediate it trust me. I'm really sorr-"

    "-I'm coming up. I'm in the parking lot."


    I show up, and find my bike in the repair lot. Every fairing, the gas tank, exhaust, stator cover, left mirror, windscreen, front brake assembly, right clipon, and frame were messed up. The bike was totalled. I get my digital camera and take pictures of everything just in case.

    Apparently the mechanic, "Don"-20, decided to take it out on what I later found out to be very twisty roads. He took it for a joyride on GREASY new tires, and touched down in the grass around a corner.

    Don is in the hospital for a shattered Pelvis, after hitting my gas tank with such force as to cave it in.

    So I speak with Sharon and Doug, the operators of Cycle City, and talk about how this will be resolved. We agree that we will discuss this further on Monday-Tuesday after the bike is completely inspected, but Doug and I both know that the bike will be totalled because of a scratched frame.

    There was an 05' R6 Raven sitting behind my wrecked bike in the crate that I had my eye on. We'll see how this turns out. Opinions?


    I decided that on Monday I'll be giving him a call and setting up a meeting with Doug and Sharon. Everyone's being polite so far, and at the time they were pretty embarrassed about what happened as they should be. I'll give them a chance to see what they can offer me in terms of $ or bike, but personally I do NOT want to spend the time and energy in finding another used bike! That's a major cost of my time, an interruption in my riding season, and stress I don't need to deal with.

    If they decide to go cheap, then I'll be forced to consult an attorney. To my knowledge there was no police report filed at the scene of the accident, as well as no insurance claim filed by the dealership. They're dealing with enough in terms of their employee in the hospital, so I think this option will be avoided by them at all costs.

    I don't believe they will fix the bike, as the frame is damaged. I don't believe they will decide to pay cash, as a bike is a much more liquid asset at the dealership. I do believe that they recieve new bikes for a great deal under what they sell them for ($8300 2005 R6), and that this cost would probably be LESS than the costs associated with a cash settlement.

    The tone of todays conversation with them was almost "Well what do you want?", but that sounded almost too good to be true. We'll see what happens next. I'll keep ya updated.

    In any case, I've really been nervous today about what'll happen, and I feel cheated as a customer. This will either end how I'd like it to, or how I'd like it to.

    PS- I can't imagine the rider ever even suggesting to sue me over the accident, because he *inspected* it before the ride. If there was anything mechanically wrong he would and should not have ridden the bike, especially without my express permission.

    ouch....:( i have had a few bike..... really sorry to read about this. seems by the tone of your post that the shop owners will do whats needed to make you happy. how was that tech able to get on your bike and not know new tires must be bedded in? he must have been "a new guy" . shame that he had to get hurt to learn such a lesson. he made a mistake, i hope he heals fast.

    Im thinking a new 2005 R6 would be a fair re-payment. Remember to ask for more than what you can expect to receive..............you can always go down but never back up.

    It would probably make sense to get a local lawyer involved now, rather than later:
    was a police report filed? Any accident involving an injury would probably necessitate one. What does it say about cause?
    You should notify your insurance company. They will want to investigate sooner than later. Also find out, or have your lawyer find out, who is insuring the mechanic/store.
    Ultimately, apart from being made whole on the loss of your bike, I think you want the comfort of knowing that you will have no liability for the guy's injuries. This is where your lawyer comes in. Not to raise issues, but it's conceivable that as the owner of the vehicle, you may have potential liability although you are not at all at fault. I would think this would be something that the respective insurance companies sort out, but if the mechanic is greedy or has injuries of a serious nature that may require years of rehabilitation, he may want to score- and chances are, his insurance company may want to tax your insurance company for some of the claim.
    Thus, the lawyer part is a good idea early on.
    You may also have a claim, both against the shop and against the mechanic, including negligence to offset any claim the latter may make (see above) re: his injuries.
    I wouldn't sign any form of release as part of a make good on your bike, because it may preclude you from asserting such claims (even as counterclaims) should the need arise. Ideally, you get releases from the shop and mechanic running in your favor, you release your direct claims against them- but reserve the right to an indemnity or other claim over, should any assertion be made against you (including but their insurance company, the mechanic, etc.) that would justify your putting it right back on their plate for coverage. And, to sort out the bike damage/replacement issue, give some thought to an independent examination if the shop tries to claim that it's fixable.

    Even if it's fixable, the parts and labor would be much more expensive than a new bike. Not to mention theres great depreciation in crashed bikes, so I'd expect compensation.

    I have never had a bike that needed to be test driven for "new shoes" thats nuts...You should get a better reason why "Don" took your bike for a spin.

    All I could think seeing that gas tank was "joyride"? That f*cker ain't getting much joy in a while. I sure hope he already had kids if he wanted some! lmao.

    I'd ask for an equivalent bike (NOT a new one) with a one year total warranty or something.

    I'd spring for the brand-new R6 if I were you, to replace the cost of the bike plus the fact that you got robbed by a mechanic of theirs.

    Sorry to hear about your bike, mate... hope you can find a new one soon for more seat time... :)

    Sorry to hear about the "incident". I think you're right to keep everything "polite" for now. If they consent to giving you what you want, good for you; you may ba able to come out with a new bike. If I were you, I'd consider retrieving my mods asap, as they do have a way of disappearing when not in your possession, and the future ownership of the bike in question. You can put them, (if they are undamaged), on your new R6.
    Glad to hear the guy who dropped it is going to recover, we all make mistakes. Hopefully, the dealer will step up to the plate for you. My guess is they are consulting their attourney right now, you may want to do the same, so you don't get blind-sided.
    I'd not accept the return of a sportbike that the frame had been scratch, NO MATTER HOW STRAIGHT THEY SAY IT IS. You'll never be able to sell it- I wouldn't buy it......................

    Just got back from Cycle City.

    I had a meeting with Sharon and have to say that they handled this with class. After a polite discussion we came to the agreement that I will be recieving an 05' Raven out of the crate, with a new Micron high mount, my ohlins steering damper, and LED integrator. I will be recieving a 1 year warranty as well as the first two oil changes free. The tires that I previously purchased (undamaged) will be pulled from the crashed bike, and the mounting fee will be eliminated. At the end, considering taxes and other fees associated with the cost of the transaction, I will be paying $390. This agreement was reached after I proposed my solution to this problem.

    Dominic the mechanic was at work today, although visibly in discomfort. He was extremely apologetic and seemed genuinely concerned about the accident. He was knowledgeable about the greasy tires, and explained the test-drive honestly: He took the bike on the same path that he took every bike on, but was coming into a corner a little too hot. Between the greasy tires and the unusual amount of grit on the road, it was impossible to regain control. The bike was dumped in the grass, and as soon as someone stopped for him he turned off the bike, locked the steering wheel, and stood it up for the dealership to retrieve.

    I'll post up pictures of my new bike when I can pick it up from the shop, which will most likely be in the next couple days. Galfer stainless steel brake lines were purchased before the accident, so I hope the 03' lines are compatible with the 05' bike.

    Cycle City really proved their worth to me today, and I look forward to continuing business with them in the future.

    Sounds like a good company that you should continue to do business with.


    As for doing a test ride after mounting the tires, as a current shop owner and in the past being a shop forman at a dealership I insist on doing a test drive of every vehicle worked on in the shop. I have turned work away when the owner has not wanted test drives done. For one thing can you imagine what a lawyer would do to me on the stand if I said I just bolted a set of wheels on a vehicle and did not drive it after? I don't care what happened or who's fault it was I would get crucified for doing that. I am sorry I will not open myself up to that kind of liability.

    This is a dealer you should continue to do business with! They handles this with class, for sure! This is how business should be done, IMO. Glad to hear the mechanic is all right, hope he heals up fine! It's great that this was done without getting lawyers involved. Have fun on the new bike and post pics when you can.

    I wish this dealership was in my area - I'd be honored to be a customer there.

    Here's hoping the guy heals up completely - from what you've said, it sounds to me like it was a bit of bad judgement in an otherwise good employee, rather than an abuse or a joyride.

    Got a call back today and I'll be taking delivery on Friday (hopefully).

    It would have been later due to them waiting on the exhaust to get shipped, because they wanted to pull the stock 05' exhaust in an effort to recoup some money. I mentioned that I still possess the stock 03' exhaust and would use that until the Micron arrived, but they said that it still won't be ready until Friday.

    Hopefully I can enjoy this weekend with a bike. What do you all think?

    Sharon's been veyr helpful in this matter so far giving me updates at home.
