Teddy, this quote is absolutely correct. Much worse could have happened. I found out recently that a student who graduated a year before me at my high school was waiting at a light one night going back to college after playing the piano at a concert. Some f$cking drunk idiot rearended him at 60+. Luckily he survived, but he is currently re-learning how to walk (that is the innocent kid of course).

Don't go too overboard. You don't want this crazy drunk kid coming by your house to mess with you. Try to keep it business and not personal. I know it's difficult, but who knows how wacky this kid really is?

I'll bet the little prick drives himself to his first court appearance - you may want to pay attention to that. Be nice if your observation gets him locked up. You'd be surprised how many dumbasses drive themselves to court while they have suspended licenses.

I'd also suggest starting a written diary relating to the case, including your contact and info on the Defendant, and especially your day to day pain and other issues. Talk to rich friends. They often have good business lawyers that can refer you to good insurance or PI lawyers, if you haven't found one yet.

By the way, did he submit to a blood alcohol test? If so, what'd he get? You mention a 6 mo. suspension - that's what you get in Illinois if you refuse to take the test. Is that what happened with him?

Another possible pocket or two - he got drunk somewhere. If he was at a bar, you may have what's known as a dramshop claim against the bar for overserving him, or maybe he was at someone's house where the parents were allowing underage drinking....

I am a recent addition to the community of F-chatters, and am also very sorry to learn of your story.

My 2 cents worth of input....you may wish to stop posting on the boards about this for a while. We're all anxious to hear the good results, but a poster on another board I frequent had some of the contents of his posts held against him by the other side in a very messy divorce (and the posts were about cars, not his wife or his marriage). Would hate to see the same thing happen to you.

If you are like the rest of us when it comes to your car, then you have pictures & mechanical reports galore. It may be helpful when making your damage claim for the vehicle to have a portfolio of pictures, mechanic's condition reports, dealer condition reports, etc. when it comes time to make your claim.

A couple of years ago right after I finished resoring my Vette a kid ran me off the road. It made my claim A LOT easier when I was able to plop down a portfolio showing the car in its pre-accident state along with an extensive mechanical report from my (very reputable) mechanic...Just a thought. Claim EVERYTHING that is currently wrong with the car if it was not that way the instant before it was hit.

Also, hold off on posting anything that could not have been learned in the newspapers here. As someone else mentioned, you DO NOT want to compromise your case. (Which by the way I do not think that you have done so far) - Based on what you have told us of the Defendant, he would sell his own mother up the river to save his arse....

Maybe this will cheer you up...since you and I are in the same town, after you get over the initial shock of this thing, I will take you out for a beer....
