You already made it personal against another user by choosing to post a pic entitled "Eat ****" with an "i" in place of the "!" The measurement of the pic is 364 x 269 pixels, and coincidentally enough, has the same measurements and title as the second result on Google Images, if one were to type in the word "Eat s-h-i-t" and hit the Search Button. That is mens rea - posting it is actus rea. mens rea is a criminal law concept which focuses on the mental state of the accused and requires proof of a positive state of mind such as intent, recklessness, or willful blindness. Criminal or not, the proof is in the "pudding." actus non facit reum nisi mens sit rea roughly translates to "an act does not make someone a criminal unless (their) mind is guilty."
