I'm happy to accept what you say though the only bit of speculation in my post is whether or not they have utilised the 780 pages.

As far as the FAI goes it is of little interest to me. I am happy for the Championships to be decided on track.

I am also happy for Ferrari to sue Mclaren and its' functionaries in whatever jurisdiction they can and to seek any other remedies that are applicable.

 

I think this is a good thing. If Mclaren are found innocent, then I'll forget about this and at least stop feeling like Ferrari didn't get a fair shot at the championships. But if they are found guilty, that pretty much guarantees another championship for Scuderia Ferrari, so I'll be very damn happy about that. Although on the first trial I thought that Mclaren should have been fined for not bringing this spy thing to the attention of the FIA.

I would like to point out is that Mcl didn't need to make carbon copies of Ferrari parts to be considered taking advantage of the data. Knowing Ferrari strategies can definitely help you plan your own. Knowing what areas the F2007 is weak and strong in is beyond helpful, you would be a fool not to prioritize the developments on your car based on that data. Obviously most parts on the F2007 will not work on the Mclaren, but having the technical data can certainly inspire you to create your own versions that will work on your car, or at least speed up development of your car. If Mclaren are found guilty of any of these then they should be excluded from both championships, for 2007 and 2008.

 

I can see my efforts at treating you with respect were wasted.

 

I will dig it up for you, there is a lengthy article in Autosport about a week ago on this point, as well as the entire situation up to that point. They also mentioned that McLaren had an independat law firm take depositions from each member of the technical staff as well.

 

that's a bit harsh luis, some here need to see it on YouTube before they'll believe McL have done anything wrong

I have been waiting for this issue to go away so we can get back to racing. I have heard all I want to hear from some quarters around here.

 

While I agree with you that settling the Championships on the track is the best answer, I'm troubled by something I haven't seen addressed anywhere on FCHAT or any where else for that matter.

That concern is how McClaren handled the situation before it came to light. All the reports I've seen have said that McClaren told Coughlin to destroy the documents. That smacks of a cover up strategy rather than a proactive strategy. It would seem to me that the proactive approach (aka ethical approach) would have been for them to take the documents from Coughlin and turn them over to the FIA and to take appropriate and decisive action with Coughlin's employment.

While that would be the ethical way to handle the situation, it would assume they had nothing to hide. By taking the approach they did, they opened themselves up to the suspicion that they do have something to hide. Whether they do or do not have anything to hide is pure speculation at this time, but when it comes to Intellectual Property not following the ethical path and trying to cover it up is seldom a good approach.

The open question is what would have happened had the Print Shop Owner not reported Coughlin's wife's activities? McClaren's Chief Designer would have the information from the 780 pages available to him and he would be continuing to to function in his job and use the data as he wanted. I doubt if he (or they) would use it in their design but what about in their race strategy. Knowing your opponents weaknesses is sometimes as valuable as knowing his strengths.

Clearly Mercedes McClaren failed the ethics test, the question is why?

The hearing was simply Mclaren proving their case to the FIA, with Ferrari only there as bystanders unable to state their case. Anything but a fair hearing.

Yes, but the FIA did state that they would be addressing the flexible floor issue during the hearing. Nevertheless Ferrari will get the opportunity to present their case in the appeal. Hopefully more light is shed during those hearings.

Or at least the threat of a prolonged messy lawsuit has got Moseley and the boys seeing the hole in their donut. Ferrari is hitting FIA in the place where they are most vulnerable: the potential of losing billions in the wallet as a result of bad PR. Couldn't happen to a nicer bunch of guys.

all i can say is thank god. it's unreal that mclaren was not penalized for breaching the sporting code.
