You have a legitimate complaint. But posting private correspondence to the public on a forum is not appropriate. Neither is posting someone's telephone number. I hope you get your money though.

My opinion means nothing, but I feel after this long of time and numerous blown off emails, posting this information is justified. I'm sure Jason did not want to resort to this and tried to get his money privately in every way he could think of. All I hope now is that this guy gets a bad enough rep and enough emails from people that he mans up and pays Jason what is rightfully his. I still can't believe there are shady characters such as Andrew Duncan doing business in our society.

    Fellas,

    No posting personal information.

Especially in a flame thread, it's just not kosher.

    Ok, back to business here.

Sorry to hear about the money issue , but you should explain a little more why the rally it self is a train wreck and why it would have been a nightmare ?

    Hey Guys -

Andy contacted me this morning and is aware of this thread and asked me to post his response:

    ----------------------------------------------------------------------------------------------

Thank you, we’re not members of Ferrari Chat but here is our response for anyone who wants to hear it.

    Jason,

I’m sorry but the reason you have not been paid is because you’re claiming payment for work you haven’t actually done. As you are aware you were asked by our mutual friend, who is a Bullrun enthusiast, to assist him with the Bullrun MySpace page. He has managed and monitored all the work you have done so when your invoice came through it was passed on to him to comment as no one else within Bullrun can verify it. If you would like to speak to him directly he will discuss this personally with you and explain why it is incorrect but we have to go by what he tells us is correct.

We have spoken to him this morning and he confirmed he had not actually looked at any of the invoices you sent until this morning but stands by the fact he believes we do not owe you the amount you are claiming. I believe every invoice due to you to this point has been paid.

As for the rest of your post, I’m not sure what to say or how to respond since it doesn’t really say anything except be a non-specific all out attack on myself and the rally which obviously you are entitled to think and express. I think most people who know me and our organization, including members of Ferrari Chat we know, would disagree with you.

However, no one at Bullrun has taken advantage of you because of your age – the opposite is actually true.

Our mutual friend asked if you could come on the rally this year for free with him and in return you would take photographs Bullrun could use. It seemed like a good idea at the time as you seemed like a great guy, there was no questioning your photographic talent / ability and you came across with a maturity level way beyond your 17 years.

Normally (with a handful of exceptions) we do not take minors under 21 onto the event but we made special arrangements for you and cleared your access into every Bullrun party over the 8 days so you could enjoy the event and obviously take great photos at the same time.

If you did not have a great time because of the work you had to do on the event to take pictures then you share the same problem all of us have who are involved in the running of the event. However, a ton of the photos you have sent me have you actually in them and to be honest you seem to be having a pretty damn good time…we could post them too but that’s not our style.

This brings us to your points on professionalism. You failed to mention to the community in your post what happened after the rally finished in May.

When we asked you to send the photographs through as per our arrangement you refused to do so claiming ‘we didn’t have a contract in place’ and they were your photos. It was only after a number of weeks of our mutual friend getting involved and us telling you we would have no choice but to legally obtain the photos from you as we had commitments from magazines to deliver them that you finally relented and sent us the photographs.

In addition to this we recall you asked Bullrun if we would give you free sponsor space on all the cars in the rally for a photography sponsor and in return you (not Bullrun) would receive $10,000 worth of free photography equipment to help push your career on and we absolutely agreed to do this for you.

I’m not sure this sounds at all like Bullrun taking advantage of a 17 year old but we wish you luck in your future endeavours.

    Andy Duncan

Under the Statue of Frauds a written contract for goods or services exceeding $500 is required to be enforceable in a court of law. Since you did have some sort of verbal agreement, you can only legally leverage $500 out of him.

Ok, both parties have weighed in on the subject, all the "facts" have been presented, and it appears that the guys have worked this thing out.

I'm gonna close this thread, and kill the other two that are similar before it turns into something ugly-er.

    Dave M,
