FYI, this is shaping up to be another F-phony. Any time a guy cruises on here and makes exaggerated claims with nothing to back it up, is almost always a phony. Another classic tip off is he insists it's true and at the same time tries to turn it around on the accuser. I've seen it too many times to think anything but.

I can state, definitively, that Ferrari will not be leasing the 430 Scuderia in the same way as they did the F50. What FNA is doing, is requiring their dealers to offer financing through FNA's Financing subsidiary and the really asinine part of this is that they are attempting to secure a a one year lien on the vehicle, even if it is bought for cash. This is their plan, notwithstanding the fact that there cannot be a lien on the asset without a commensurate obligation. Like other FNA tactics in the past to try and control the market it too will backfire. Let the games begin. BTW this new policy applies to all new Ferraris sold through authorized dealer, not just the 430S. Legitimate car financing outfits like Putnam, Premier, Woodside and any bank offering car loans are the ones getting the short end here.
There is a commensurate obligation - the ROFR. I have seen the legal documents from Ferrari, and their legal thinking is the following: you get the car and as consideration you give them $MSRP + the ROFR. The lien, supposedly, is then in place to secure the ROFR, which is part of the consideration for the car. You are right, this applies to the 599 GTB too.
I agree. You, me, Ferrari or anyone can assert a lien against property but the question is whether it can be perfected. Would a court allow Ferrari to make a claim like a creditor? I doubt it. A ROFR is exactly that, a right, not a financial obligation in the generally accepted defintion. If one were to push the issue I agree with Alex that the courts would summarily dismiss such a claim as frivoluous. The reality is that many will simply take it; like Kevin Bacon in Animal House: "Thank you sir, may I have another..."
In 100% agreement. My dealer told me the absolute same thing about what they are trying to do for all new Ferrari's. I pointed out if they no longer have financial interest I thought it would be illegal?? Just another genius plan ready to backfire on Ferrari. Maybe in Europe butr not in the States. RTGT told me that they want first right of refusal, Ferarri will place a lein on the vehicle for 1 year and you pay over MSRP. I know fricking CRAZY. The funny thing is people will do it! NOT ME Mike
