Abusive Contractor!

    About 15mins ago, my nephew got an anonymous phone call. The person on the other line stated that my nephew should cross the street very carefully and that he should look around before he steps out of his house! :mad: Can you believe these f*ckers!!! They have the nerves to threaten the under-dog. I was actually gonna tell my nephew to just leave it be and that I would cover what the contractor left out (monetarily). But now that they're playing the game, I think Ill just invest in a good lawyer (for my nephew) and just sue the hell out of these guys.

    EDIT: An angry fellow called my nephew no more than 3mins (11:08pm) ago claiming that he is the lawyer of the guy who got into an accident with the metal shoring. He told my nephew that the company will sue him for negligence and that my nephew shouldn't leave the country anytime soon cause they have already informed the immigration about the incident. He also stated that the immigration authorities will be "picking him and his mom up" and that they will be deported back to LA by the weekend. My nephew is scared sh*tless cause these guys have his home address. I told him to go to the nearest police station to report the harrasment and that to come and stay with me for the time being. Can you believe this!?! :mad:

    Strange story,

    Seems like a whole lot of trouble for a few days pay. Your legal exposure will far exceed any possible wage recovery.

    Your monetary outlay would probably stretch farther by topping up the tank and purchasing new togs for the nephew to secure his new career.

    Save the expense and aggravation for a good one; like a car accident.

    Contact the provincial labor standards office. This is exactly the type of thing they are supposed to help with.

    Racial slurs, discrimination, verbal abuse, threats and harrasment seems like a "good one" as far as aggravation goes! Its not really about the pay anymore, its far from that already. The 3-4 phone calls last night was really damaging to my nephew and his mom. They're scared sh*tless! Thanks for the best wishes though. ;)

    Thanks DAC! His lawyer is actually in contact with the labor standard people earlier. My nephew's new employer actually is siding with (and extending assistance) to my nephew and his mom. I guess a lot of the credit should be given to the union people also that got him started with his new job. Apparently, my nephew spoke to one of the union reps that he spoke with when he signed up and forwarded the info to some other people and now they're helping out big time! Props to La Farge Canada and The Union 919 out in Surrey!

    I wouldn't take any of these accusations too seriously unless someone threatens physical harm. Why would they suggest that he hang around so that they can sue him yet suggest that authorities have been notified to remove him because he's illegal? That's telling him to run. However, he should call his telephone providers security department and explain any implied threat. They can trace the origin of the call. I'd also record further calls as well.

    Btw true employees are not liable for their actions at work through error or ommission. WorkSafe covers that through a premium on wages paid by the employer. Workers injured on the job are compensated through WorkSafe, not the courts. Period.

    Different story for contractor. Is your nephew an employee or a true contractor/sub? As a sub personal liability depends greatly on how you're structured.

    He was a Sub-Con for the guy, thats why my nephew is so scared right now. Im not quite familiar with the laws here in BC so please enlighten me. Thanks Arium! ;)
