April 22 (Bloomberg) -- The owners of a Long Island, New York, exotic car dealership that sells Bentleys and Aston Martins were charged with corporate espionage against a rival that sells Ferraris and Maseratis.

Giacomo Ciaccia and Leka Vuksanaj, owners of Universal Autosports LLC in Glen Cove, were arrested along with Creative Director Michael Lussos at their homes today, according to a statement by Acting U.S. Attorney Lev Dassin in Manhattan. They are accused of illegally tapping into the e-mails of Ferrari Maserati of Fort Lauderdale-Long Island in Plainview, New York.

The defendants accessed Ferrari Maserati’s e-mail server about 2,500 times between February and September last year from their homes or Universal Autosports, according to the criminal complaint dated April 16 and unsealed today.

“In one instance a dealer associated with Universal Autosports e-mailed a customer who had been negotiating with Ferrari Maserati to buy a rare Ferrari Enzo worth more than $1.3 million,” according to the statement.

“Is there any way I can help or get in the middle,” the dealer wrote, according to the complaint. “Have they found you a car yet?”

Lawyers for Vuksanaj and Lussos couldn’t be immediately reached. The three defendants are scheduled to appear in court today.

“The complaint is just allegations about using the computer,” Ciaccia’s lawyer, Ronald Fischetti of Manhattan, said in a phone interview. “Of the substance, I have no idea yet. I’m sure he’ll be released on bail.”

    ‘Exotic Automobiles’

Universal Autosports “deals in rare and expensive exotic automobiles” and opened in February 2008 in the space formerly held by Ferrari Maserati, according to the complaint. Ciaccia was Ferrari Maserati’s general manager and Lussos its webmaster until they were terminated in March 2007 after new management took over, according to the complaint. Lussos set up Ferrari Maserati’s e-mail accounts, according to the complaint.

Beginning in September, Ferrari Maserati learned that employees’ e-mails were being forwarded to an unauthorized e- mail address on its server. The e-mails contained information about its customers, inventory and employee compensation, according to the complaint signed by Federal Bureau of Investigation Special Agent John Leo Jr.

Ciaccia, 43, of the Bronx, New York; Vuksanaj, 42, of Mahopac, New York; and Lussos, 40, of Coram, New York, are each charged with one count of “conspiracy to access a computer without authorization and obtain information for commercial gain and to further an intended fraud,” according to the statement.

The maximum penalty if they’re found guilty is five years in prison and a $250,000 fine.

The case is U.S. v. Ciaccia, 09-mag-963, U.S. District Court, Southern District of New York (Manhattan).

Yes and let's assume the FBI investigated this for months, didn't find evidence of the email traffic, but had nothing better to do yesterday morning than to round up three fine upstanding citizens...

You mean like what happened with the Duke Lacrosse Players? Senator Stevens? Like the many on Death row who were proven by DNA testing to be totally innocent?

You think this disclaimer by the FBI is a joke?

"The charges and allegations contained in the Complaint are merely accusations, and the defendants are presumed innocent unless and until proven guilty."

There's a reason why people like you wouldn't be, nor should be allowed on this jury should this come to that.

All people accused and charged are innocent until proven guilty I hope that is not news to anyone. However, in the court of public opinion things are and have always been different. Why do newspapers, magazines, broadcast and cable TV stations discuss cases and give opinions for days, months, years before a verdict is given. They get attorneys and former judges to give opinions. It's part of the American culture. I'm sure all of us have formed an opinion on a case we have read or heard about and can still probably sit on a jury hearing a case with similar circumstances.

Juries are picked by both prosecutors and defense, correct?, so in the courtroom there is always an attorney who wants a guilty plea and an attorney who wants a innocent plea. These people pick juries and many people have served saying things which we all do not all agree with but freedom of speech is fundamental in this country. So you can say that this person should not serve on a jury and he can say I think they are guilty.

There are also people proven innocent who are really guilty. It's part of what makes out justice system the way it is and one I don't want to change. Does anyone really want to muzzle the voice of public opinion.

Where did I say I want to muzzle the voice of public opinion? It is fact that everyone is legally innocent until proven guilty and and anyone who is unable to understand that or has a predisposition towards believing someone guilty is excluded by law from serving on a jury.

I feel bad for these folks. I can just imagine being arrested at home, with your wife and kids around. Now, if they did dirty stuff, well yeah, they should pay. But let's all remember that we do not have all the facts. And yes, often people charged are guilty, but by NO means all the time. Lastly, the crime alleged is not one concerning public safety, child porn, violence, etc. They likely will never see a prison cell. So, what I am saying is, stay tuned and don't jump to conclusions.

Jim, I don't recall connecting this situation to the Duke Lacrosse Players, Senator Stevens, or the "many on death row". However, the "DNA" if you will, seems to have been collected by the Cyber Squad of the FBI and as I said, they seemed to have thought it was important enough to take three citizens into custody. Are these guys all innocent of the charges until proven guilty? Of course they are - legally. And so is Bernie Madoff.

    That is correct.

The idea that because someone has been arrested by the FBI it means that they are guilty is laughable.

These are very serious charges and the proper place to determine whether or not they are warranted is in a court of law.

Why are you so outraged at this?

Oh and as for Ted Stevens: http://www.nytimes.com/2009/04/12/us/politics/12stevens.html

I wouldn't say he is innocent, rather, the prosecutors knowingly withheld information that could have helped his defense.

And Jim, getting charged by the FBI is no small thing. Knowing what I know, I tend to think things must have been a lot worst then what is being reported.
