Speeding ticket by "speedometer calculation"

    Great advice Art, thanks.

    The thing that keeps getting me, is he said "I've been trying to catch you since town [ABC]". Well if that's the case then I must have done something wrong back in town ABC, right? Because he wrote me for 70 in a 55, but back in town ABC the speed limit is 25, and there is no way you could speed through that town. Perhaps he meant city limits, I dunno. He didn't have his lights on while he was chasing me for 12 miles, so why was he chasing me again? Weird

    I am not trying to defend the cop by any means... From the OPs original post I got the impression he was more than likely speeding and probably a good margin over... I agree with your simplified scenario however if the cop only had to do say 10-15 over and he caught him in a mile than you are right, what if the cop had to do 40-50 over and it took him 10 miles to catch up, we can both agree the op was going well over the limit...
    I don't know, non of us by 180+mph high performance cars and take them on winding roads and do 25. I for one go by Sammy Hagars mantra, I can't drive, 55........
    Hopefully he gets out of it and this method of identifying speeders doesnt catch on...
    Again, just my opinion of the situation.......

    I think he did a VASCAR. Simple time and distance calculation. He could use the trip computer in his car. You were here at this place and time, then you were there at this place and time.

    No matter what you do in court, win, lose, represent yourself or havea lawyer, the cop will have an argument:

    You lose, he'll make you lose again.
    You win, he'll make you lose in the near future.
    You defend yourself, he'll see it as a blatant challenge.
    You use a lawyer, you're the rich guy that needs a lesson or 2 more.

    Grandpa was right.

    It shows bias, and as we learned in evidence class long ago, bias is always relevant.

    You betcha. Ticket lawyers are the best few hundred bucks you'll ever spend. Also as Art says, get the judge off the case if it's the same one as before.

    That said, we do not have the officer's side of things. Those who are confident of this officer's getting fired, paying damages, and ending up at Walmart have never worked a civil rights case. And careful of what you wish for about hidden cameras and mikes. Court files are full of "police brutality!" cases that ended right after the judge saw the video that the citizen didn't know had been made.

    You should ask the judge what the purpose is of this question, or how is this relevant to anything? Does that mean that because your car is expensive that you can simply pay any fine, whether legitimate or illegitimate, and not break a sweat? The fact that he said this should have the judge up in arms, and a good cause or reason for dismissing your case. I would have lost it if I was in your position.

    Pay the ticket and move on. As upsetting as this is you certainly must have better things to do in your life than spend hours and dollars pursuing what is likely going to be a losing effort. Find another fun road out of this guy's jurisdiction.

    Hidden cam is really the only way to go but may be in violation of your state's law. The only recourse against these thugs is public humiliation by getting their corruption exposed on sites like YouTube.

    Just drive deliberatly below the limit by 10mph when you're at that stretch of road. I got busted with 40 in a 30mph zone. This road is about 1/2 mile of city road with a tunnel and no interesections. Now, I just sit at 20-25mph in the 30mph zone without regards to how many cars are behind me because I know there is always a chance a cop is sitting and waiting just for me. Normal traffic is 40mph through this straight stretch, but thanks to the police, I just obstruct traffic at my "legal 20mph".

    Cops can also stop you for driving too slow and impeding traffic.

    My dad got a ticket for driving too slowly when he was a teen in Cleveland, OH. He was, big surprise, doing a bit of girl watching at the time. The ticket was probably worth it.

    Your profile shows 3 nice ferraris and a... cough... p-bug. I'd drive each car on that road and see if I get a ticket from the same guy in each car just for giggles! If the motive is jealously that will really make him cry and the 300 bucks a ticket will be worth it because the poor sucker keeping score will never have what you got and you both will know it. He wins when he thinks a $300 ticket pisses you off. Just think of it like a tax. You don't like taxes but you pay them because in the end you know the more you pay in taxes means the more you got. If this really is an abuse of power deal I feel very sorry for the guy beating his chest in the only way he can. I'd just move on and go make a million dollars that's the best revenge. To get a few hundred dollar lawyer and win your case will be an empty victory and waste of your time and talent.

    Not necessarily. I've had a judge tell an officer to his face in open court "Officer, frankly I don't believe you." What a relief for my brother and I who were riding our motorcycles were not culpable of speed contest because we were riding together and had a reasonable story(and some actual facts ), remember judges see the same cops all the time and not all of them are forth right in their testimony, most judges aren't stupid and don't like their intelligence brought into question either.

    I have fought most of my tickets and won all the ones I fought just by showing up and having a good attitude and some reasonable facts.The cops have a great advantage though PACING: "I followed you for more than the required 1/4 or 1/2 mile and I clocked you at" reality translation:you were pulling away while I was doing the speed limit". Assigns a speed and bingo no defense, short of the new computers as was mentioned earlier....I like that one gotta think fast on your feet when your're enraged or bewildered, wtf did he come from?

    Win some, lose some, it's about the revenue anyway, not fairness or safety, and you were lucky all the times before and will be again in the future also, just the cost of doing business.

    Read all the trick books about getting out of tickets etc, My favorite was about overpaying a couple of bucks forcing them to refund money and not cashing it to keep the docket open so it doesnt show up on a reciprocity report ...BS ...They(Miss.) thanked me for the overpayment without acknowledgeing it, kept the money and reported me anyway.
    You'd have to get real lucky since our CHP aren't stupid, have their equipment checked regularly and have seen guys like you, him and me regularly. Most are pretty darn good at being on top of their game.

    I always wondered if this was a myth. I found it hard to believe that it would be that simple to get out of the ticket being reported on your record. If it was true, it would be a cheap way to get out of it, and I'm sure they would catch on after they see several people "overpaying" and not "cashing the refund'
