    I know this isn't really Ferrari specific but, my son got a ticket here in central California today. He was driving his BMW and got cited for doing 113. He doesn't have any tickets on his record and is a very solid 30 year old guy. The question is, what is he looking at? I've done well over 100, hundreds of times in my exotics but haven't been caught. He was and now we lean upon the expertise of this forum since I know many here have had this problem before.

    Excessive Speed and Designated Lane Use

    22348. (a) Notwithstanding subdivision (b) of Section 22351, a person shall not drive a vehicle upon a highway with a speed limit established pursuant to Section 22349 or 22356 at a speed greater than that speed limit.

    (b) A person who drives a vehicle upon a highway at a speed greater than 100 miles per hour is guilty of an infraction punishable, as follows:

    (1) Upon a first conviction of a violation of this subdivision, by a fine of not to exceed five hundred dollars ($500). The court may also suspend the privilege of the person to operate a motor vehicle for a period not to exceed 30 days pursuant to Section 13200.5.

    (2) Upon a conviction under this subdivision of an offense that occurred within three years of a prior offense resulting in a conviction of an offense under this subdivision, by a fine of not to exceed seven hundred fifty dollars ($750). The person’s privilege to operate a motor vehicle shall be suspended by the Department of Motor Vehicles pursuant to subdivision (a) of Section 13355.

    (3) Upon a conviction under this subdivision of an offense that occurred within five years of two or more prior offenses resulting in convictions of offenses under this subdivision, by a fine of not to exceed one thousand dollars ($1,000). The person’s privilege to operate a motor vehicle shall be suspended by the Department of Motor Vehicles pursuant to subdivision (b) of Section 13355.

    I don't know how many "points" this is but it's not just like a regular ticket. It could really impact insurance.

    I agree with William. His record is good in the past so I'd work with an attorney to work with a judge to reduce it. If he had a history of this, I think he'd be SOL.

    Thanks guys, my buddy, the former county sheriff, told me that he was lucky the CHP didn't impound his car. Probably because my son is a really good guy and very respectful he didn't get the car hauled away. I agree, he needs to get representation to plea it down if possible. One thing I know for sure, he won't do it again!

    Based on what Dave posted, for a first time offense...looks like he's ok...

    Not much worse than the 82 in a 55 i got in VA the other month...go figure

    Sounds like he'll get slapped with the $500 and the judge will say he's lucky he's not losing his driving privilege etc.(due to no priors) Insurance will take a hit. Probably will be a lesson well learned.

    I can answer this question from experience.

    I live in CA and was ticketed once for doing "111+" (the police car topped out at 111 mph, but I was still pulling away). The fine was $365 - not bad imo. Unfortunately, it placed two points on my record that stayed with me for five years (as opposed to the usual one point for three years).

    Who cares if he has to pay the fine or if his car could have gotten impounded,
    what's important is that he didn't get hurt nor hurt anyone else and didn't get
    into an accident.

    In PA he'd get a reckless driving, a 31+ over the limit, and anything else they could find from a bad taillight to not shaving closely enough that morning.

    The speeding alone would be several hundred dollars, plus 60 day suspension, plus 6 points, plus plus plus. 6 points in PA earns you a trip to driving school.

    Looks like CA is the place to speed, I guess he was lucky not to get hammered for unsafe lane changes, reckless, etc.

    First and most important

    1st Plead Not Guilty!

    2nd find a lawyer that knows the cops and judges in the area that the ticket was issued.

    3rd postpone,postpone postpone....

    4th be patient it takes time but you whittle it down to a much lower offense.

    5th go to any police fund raiser where the area is and make friends.



    FYI I GOT A TICKET FOR UNAUTHORIZED SPEED CONTEST IN EXCESS OF 90 MPH AND IT WAS DISMISSED AFTER 3 YEARS OF FIGHTING IT.

    Ps... I was not guilty....

    I hope in this instance the judge goes lightly on him and most importantly , he learns a lesson and doesnt go 113 ever again.

    I was pulled over in my Viper around 140 once. I had a perfectly clean record. Cop let me off with nothing...no ticket at all. Told me if he ever caught me doing that again it was straight to jail.

    I dont look a gift horse in the mouth so since then, around 6 years ago, I have not exceeded the speed limit by more than ~15 miles per hour.

    Perhaps the copper thought Jerry was a women with his wavy locks. He pulled Jerry over to get a closer look and just had to let him go after he saw it was a man. :D

    I'll let you know what happens. My son is a worship pastor, of all things. He also works as a development guy for a large ministry. So, he is really humiliated. It is a lesson. I know several judges. I may give one of my friends on the bench a call for counsel. Don't want to put them in an awkward place though.

    I know people in ministry who did significant time in prison for drugs, assault, murder, etc.

    I wouldn't sweat a speeding ticket, even a big one.

    Oh please. Where did you get the lift kit to turn your Ferrari into a high horse?

    There is nothing magical or inherently dangerous about 100 mph. I and millions of other people drive faster than that on public highways on a regular basis, with the blessing of the law and a lower accident rate than US freeways. The only reason 113 is stupid in your little world is because it's expensive when you get caught, not because it is automatically dangerous.

    Sound like you are more concern about the fine that needs to be paid than safety which in my book is WRONG! WRONG! WRONG, it's not so much of the speed of 113mph but the consequence.
