My First ticket...silver lining

    I think you meant fight the ticket and you will almost certainly win.

    Burden of proof is on the officer. His device for providing proof of the infraction malfunctioned.

    I have fought two tickets similar to this one I was completely innocent. Not speeding the cop just had a hair up his ass and made **** up. So I asked to see the gun and he couldn't show me the gun. So when I went to court I told the judge exactly how it went down and the judge stopped me midway and said... is this true to the cop. Cop said yes. Judge said so you couldn't prove that he was speeding. He said visual speed estimation.. she said... so we only have an estimation... no facts. Dismissed.

    Then had it another time where i was going ten over. Similar situation. Same result.

    The big thing is at least is that in arizona we have reasonable and prudent laws. Reasonable and prudent on a bright sunny day with no traffic in a 40mph zone means technically you can go 50 55 and still have it be reasonable and prudent and you can fight it and prove that it was a reasonable and prudent speed for the conditions.

    Don't give in. Don't admit blatantly admit. If you are in the right that is. Obviously if you are going 110 in a school zone or going 80mph and zipping in and out of traffic endangering other motorists... you should go to jail. end of story. Being stupid is just that... stupid.


    I do see you also got in infraction for an unsafe lane change...

    The unsafe lane change was a warning and not an infraction. I may do traffic school or I may pay $500 for a traffic attorney. Not sure which path I will take but will update once I know.

    If you hire the attorney and win, the result will be the same as taking the school -- no points. But if you lose then its automatic points, no school option. So if you can take the school, I'd do it. Takes just an hour or so on the computer and you're done. You wont be able to take school again for (18?) months, so thats the only downside, but you could fight it the second time if need be.

    Some one talked about the third option. I in NJ used the third option few times, i.e. head up early and talk to the prosecutor for plea bargain. Usually they bring it down, else if you mention that you would not like points, they raise the $ fine but no points, which will work out better in the long run on the record for 3 years the Ins record keep it.

    In my experience, always plead "not guilty". In once case, it was dismissed via mail and I didn't even have to go to court. No idea why, but apparently in CT it happens quite a bit. In another case, when I lived in NY, the officer didn't show up and the ticket was dismissed. In the third case, I met with the DA and plead down to a lesser infraction ("failure to obey a traffic control device") which meant no points. It's not the money, it's the points, as they never truly go away and you'll be paying through the nose for insurance. All in all, in 25 years of driving, I've gotten 5 speeding tickets, plead "not guilty" to all of them, and in only one case I was unable to "get out of it" or get it reduced. Definitely worth the time.

    If you live in California and use a Mr Ticket type attorney the new method is if the officer shows up.The attorney can request the citation be dropped to a with the officers approval(non moving violation) or a (Parking Ticket)the fine is usually the same but no points or traffic school.Its without a doubt better to always plead not guilty to a moving violation at least for myself I have 5 cars on my personal insurance policy any ticket affects all 5 cars

    So they say 50 mph was the guesstimate, but driver implies he was going even faster... in a 35 mph zone.

    I lost one of my best friends years ago because a driver was doing 55-57 mph in a 35 mph (two-lane highway) zone and didn't have reaction time to his error in judgment. My friend was a world-class cyclist following all rules of the road, when the driver came upon him too fast and ran over him, killing him.

    I enjoy the speed and thrill of driving my F-car.
    But I would never exceed the speed limit by 1 mph in 'lower posted zones' such as 15, 20, 25, 30, 35.

    There's a reason for it and a lot of it has to do with stopping/braking distance and/or pedestrian/residential areas.

    Not good.

    Well said, and a good reminder to all of us, regardless of what kind of car we drive, to always be safety conscious and cognizant of where we are driving. Be safe.

    Will be interesting to see how long before someone gets busted from the data stored in the 458's computer memory. It's right there in the intro section section of the owners manual -- the data is collected and can/will be shared with law enforcement and other interested parties (eg, your insurance company). I wonder if there is any gps data stored in there.

    Wish I had judges like you have. In WA. state, or at least my area, the officer does not even have to show up. I have also tried long ago, when I got my last ticket, to get the officer to show me the speed on his radar gone, he said he had already cleared it. Best thing here is if you want to speed, go somewhere far out of town.
