I live in Miami and own a 458. Never got pulled over unless I was speeding. Drink and drive is a no no to me I'm sure you were so happy about enjoying your new ride that forgot a blinker or something of that nature. Be glad they let you go and enjoy your car. Be more careful next time. When cops need to reach their quota of tickets they have no tolerance.

Keep in mind, you don't need to be .08 to get hauled in. "Driving While Impaired" can be one beer. If I have had even one beer, I stay out of Laguna Beach and certain parts of Newport on weekends.

I'm with the group that says the 6 lane move is what brought you to the attention of the officer. Laguna, Newport and South OC in general is infested with Ferrari and Lambo drivers. Not a big deal to PD.

That's a fact. In my youth, I was arrested, charged with DUI and thrown in the drunk tank at .06. The DA declined to file a case but it definitely opened my eyes to my own stupidity.

I agree Tom. I have a female friend that got nailed by Laguna PD after one glass of wine. She was driving a little too fast down PCH, got pulled over in Laguna.....done...."Driving While Impaired".

Not sure where you thought I was being wish-washy...I don't drink !!! For some reason, I do drink a single Corona on Cinqo de Mayo but it has been years since I finished one full beer on that day. My wife now gets me the Coronita's (small bottle) and I can finish that one. I will not drink wine/beer/alcohol outside of my home where I might drive in the same day, but at home I don't drink either. I do have a bottle of Kaluha at home, bought it when my daughter was born 24 years ago...its about 3/4's full and no longer tastes good but I keep it around more for the memory of that day then to drink. I was not being wishy-washy as far as I can tell...but ok, sorry i was. Back to the original subject and I will keep quiet.

More info on this please? I always thought 0.08 is the threshold?

I make it a point never to argue with anyone carrying a gun.
    ;)
As I understand it roadside stops are among the most dangerous parts of a cop's job. If they're prone to preemptively establish authority it doesn't bother me.
Being polite doesn't mean surrendering your rights. I once had a Mass State Trooper take back a rather large ticket he'd already written. I doubt that would have happened had I been an A hole.

There's driving with a prohibited alcohol content (0.08 BAC) and driving while impaired or intoxicated. Impaired can be from any amount of alcohol (or drug) as long as the officer can prove your driving was impaired.

Think about it this way, cross to 0.08 threshold and you're going to jail no matter how impaired you really are or aren't. Under that threshold, the prosecutor has to show to a jury that while you were under the limit, you still were too impaired to drive.

I agree, that is why i was and always am very polite. Now polite and consenting to tests with no real cause are two different things. I'd politely refuse

Learn something new everyday. I don't drive with alcohol in me but still wanted to know how it works.

    Absolutely.
It's also important to know your rights so you can (politely) excerise them.

interesting comments on refusal to submit to a sobriety test. my old traffic lawyer used to give out business cards to clients and on the back was the exact verbiage one should recite when pulled over and asked to perform a sobriety test (or any search for that matter). I don't have it in front of me but the gist of it was that you wanted your attorney present before any test or investigation was conducted. you were technically not refusing - you just wanted legal counsel present before submitting to the test or investigation.

I suppose in theory your lawyer would then take his sweet time getting to the scene but I always wondered if this would actually work or if it was still applicable, for that matter. I'd be willing to bet some of our Houston friends carry this same lawyer's business card as he is probably the most prolific traffic attorney in town.

regardless, I don't plan on ever testing it out...

It's not you, I do clearly remember the dealer that I picked up a F12 for a customer for didn't want it registered in California and mentioning CHP and all LEO agency's are looking for any Ferrari that isn't registered in California. So......... yeah ! that loop hole in Montana is getting seriously abused lately.

I've driven some highly-visible, loud Ferraris in Northern California for years now. Never been pulled over in a Ferrari. The handful of times I've been pulled over in other cars, all but one of the officers have been polite.

General $.02: like everyone else, LEOs vary -- and circumstances vary, and how you interact with the LEO has an impact. Being polite with them not only costs me nothing, it statistically saves both time and money :)

Some cops are total *******s while others can be very nice. Their only human after all.
I'll say that the 1 cop I met that was a ******* left me with a question in my head about all other cops, luckily that was about 12 years ago and most interactions since then have been fine, except for the bs ~$96 window tint ticket(I was 1% too dark) I did stop by my township police dept to inquire about it after getting the ticket from a state cop. They commented that my car looked great with the tint and that it was "illegal" they even got the rule book out and show me where it was too dark. We talked for a little bit longer then they went back inside to their office.
My hate for the cop that was a ******* to me still continues. If he died today, great. He put me thru every field test he could do and kept insisting I was drunk. His eye test proved to him 100% I was drunk, guaranteed. Lucky for me I had a natural twitch in my eyes. He had me standing outside for over 30 minutes when the temp was in the teens. I had jeans, t-shirt and a light jacket on. When your freezing your ass off and teeth are chattering and he's telling you this isn't nothing compared to the harsh weather he dealt with over in Germany and he's wearing proper weather clothes. *******. The best part of the whole ordeal was when I blew a .00 and he refused to believe it. He reset it to a more sensitive setting. I blew a .002. He insisted his device was broken so be used his buddy's unit. Another .00. With that he had nothing on me be could ticket me for. The whole time I was polite and asked several times if I could sit in my warm car and he kept being a ******* to me.

Cops in OC seem to be getting more aggressive. Many people that I have spoken to are sick of it. They funneled me into a DUI checkpoint on PCH in Dana Point last week at 6:00pm. Mandatory breathalyzer for all stopped but I was let go without having to blow. Driving the 308 GT4.

I don't think the Ferrari was the reason, but the OC cops are not winning any public support these days and it is bad PR in my eyes.

The mandatory blood draw works a little differently, they have a Judge on the field team and technically he is authorizing a search warrant to draw your blood as evidence.

It's a little past the Field Sobriety tests.....

Zero tolerance has become just that, in Austin and in Houston on lot of special enforcement weekends. They are spending Federal money to cover the overtime of the officers

    Nice apology Gregg.

Your initial reply was understandable, however, it was also a bit over the top.

It take a good man to issue a public apology.

    I'm with you, MR2!

OP, if you didn't get a ticket, just consider yourself lucky. I've had cops scream in my face. I've had one who insisted he smelled alcohol when I had not been drinking at all - and he submitted me to all sorts of ridiculous verbal and physical gymnastics to prove I wasn't impaired. The only thing he didn't do was a breathalyzer, which I would gladly have agreed to do to prove that I was completely sober.

Please note that none of this happened in my Ferrari. The one time I was pulled over for speeding in my F-Car, the cop said, "Hell, if I had this car, I'd probably go a little too fast myself."

Count yourself lucky, do the lane changes gradually, and forget about any conspiracy theories regarding targeting Ferrari drivers. Yeah, I've met a lot of cops who were *******s, but not all of them are. And simply reminding you to drive safely without even ticketing you does not constitute anything close to "harassment."

Scary, Greggs comments remind me of the Abner Louima case in New York. I've always wondered about the mind set of people who even say stuff like that, even if it's in jest/anger.

    Makes me very nervous......
