We would like to publicly announce that myricambi run by Denis Leborgne and Katty Craan is not a authorized Capristo Exhaust dealer .

Denis Leborgne is no longer employed by Capristo USA and has no authority to sell or distribute any Capristo products through his newly formed company

All information and pricing from Myricambi.com are a fraud.

Glad it was clarified that this is different than Daniel at Ricambi, as I have bought from him and have always been pleased.

Somewhat surprised at the name simmilarities, because I only knew of one Ricambi before this post.

Just needed to advise all customers wanting our Capristo products to purchase only from an authorized Capristo Brand dealers.

We have made legal attempts for Myricambi.com run by Denis Leborgne and wife Katty Craan to remove all Capristo products and Information from there newly formed company/website as they are violating all copy write and trademark laws.

"Ricambi" is Italian for "spare parts"

 

They deceive the public into thinking that they have and sell our brand .They do not have any of our products nor can they get hold of them .


Denis Leborgne and wife Katty Craan were working for Capristo USA until such time that they were let go .

After an in depth back ground check we were not surprised to find the exact identity of the two .

Just needed to inform customers and our dealers that Myricambi.com are misrepresenting our Capristo brand with information and pricing .
For the life of me i cannot understand why they would be doing it .

 

Money.

So are they selling counterfeits? Made in China maybe?

 

Perhaps one of us should attempt a "fake" transaction from their site. Curious to see what their response would be when asked for an ETA of the product since they cannot get it to begin with.

 

I would be very careful with accusations of character being thrown around here, if they are not authorized to sell your products I would leave it at that.

 

He can throw around what he wants if he has proof.

 

You can say whatever you want about whoever you want, just make sure you have a s--t load of cash because right or wrong it will cost you plenty to retain council and defend yourself.

 

In my state you can have them pay your fees if you win. Assuming they sued you.

 

What stops them or anyone from making a purchase from an authorized dealer and marking up the price to the next person too lazy find a less expensive purchase opportunity. Isn't this economics / opportunity 101. Ferrari does this all the time. Take MAF sensors for example, from Ferrari they costs hundreds of dollars, order the same Bosch part number from Honda or Ranger Rover and the cost is less than 200.00

I would think Daniel would be more upset that their URL address is similar to his.

My first thought was that they have deliberately chosen that name in the hope that if people search for Ricambi, their name will pop up and unsuspecting customers will not realise that it's not the same company.

This could be quite damaging to Ricambi's reputation as not every Ferrari owner is as clued up on these things as some on here, and if the service/parts they receive are sub-standard, then it could result in false complaints against Daniels company.

If I were running Ricambi then I'd definitely be having My legal team look into this!

Thank you. We actually started that process back in March when their domain first started popping up. The advice we have gotten -- from some quite capable legal folks in this field -- is that we'd make the lawyers some money by chasing that company, but not likely achieve any lasting satisfaction.

At the end of the day, I believe the market will speak louder than a lawyer on issues like their attempts to confuse/obfuscate our brand.

 

I did suspect that that could be the result of the issue (and in reality it's completely wrong! it's so obvious why they've selected this name that even Stevie Wonder in a dark room with a blindfold on and a bag over his head could see it!).

You and your team have worked hard to get your good reputation and I'd hate to see it get tarnished in any way by an unreliable tin-pot operation selling shonky goods!

Whilst the vast majority of Ferrari owners will know exactly which company is which, and which is to be trusted, the minority who get it wrong could do some damage by (innocently) spreading the wrong information if they have problems with the other company.

I sincerely hope that My doom and gloom scenario does not come to fruition and that this other company does not cause you any grief, but I can't help suspecting that somewhere down the road we'll be hearing more about this!

 

If you are in SC, then the American Rule (each party to a lawsuit pays their own fees) is still the law, as it is in I believe all states. See Blumberg v. Nealco 427 S.E. 2nd 659

The English Rule (loser pays) was never adopted in the US. There are some exceptions (like contracts where both parties agree to them) but that is not the case for torts like slander and libel.

We at Capristo simply felt the need to speak up to protect ourselves, our dealers, and our customers from any false advertising and/or counterfeit merchandise. Please do your own research and make your own conclusion.

Capristo Exhaust has a great reputation as does Ricambi.
