    I recently read this thread start to finish, and I commend you for not rolling over, as most would have by now, Dr. Brian Ross has clearly underestimated you. I mentioned your case to my local dealer in Australia and, incredibly, they are well aware of it also which, to me, justifies your investment on behalf of us all. Thank you and I, along with just about all owners worldwide, stand by you.

    I'm impressed that you took the time to read the whole thread, and thank you very much for your support! It's great to know my story has made its way around the world to Australia. It shows the power of FerrariChat to unite the worldwide Ferrari community, and hold Ferrari dealerships to account for their wrongful behaviors toward loyal customers. I imagine that FMoV and Brian Ross are getting just a little worried about how long it will be before Ferrari S.p.A. in Italy decides to take disciplinary action against them. With the support of people like yourself and others in the worldwide Ferrari community, it is my honor to continue the good fight for all of us!

    On April 6, 2017, I attended part of the court appeal (before having to return to work) regarding the dollar amount of loss of use of my Ferrari for the approximately 9 months it was maliciously withheld by FMoV in 2013. I noticed Mark Edmonds, Manager of FMoV, was also present in the courtroom audience, but whether through indifference or embarrassment kept his head down looking at his smartphone most of the time. The Appeal Court will likely issue their decision in 2 to 3 months.

    Sadly, this sort of behaviour is not uncommon amongst the Ferrari dealer community. Having witnessed similar unethical behaviour over the years with my own local dealer, I will never deal with them again. I purchase pre owned, and have an independent dealer do the service. Have been a lot happier since 'divorcing' my local dealer and certain staff members. As a previous contributor to this thread mentioned, there is far more competition in the market, and McLaren and others are establishing a growing foothold. In particular, they are focusing on unimpeachable customer service (the Scottsdale McLaren dealer is particularly commendable on this). Ferrari needs to be ruthless in insisting on ethical treatment by their dealers. They seem to have forgotten the early 90's, where the F dealers couldn't give away their cars.....

    Very true. A dealer does not have to bend over backwards for a customer however a customer has a right to honest, ethical treatment.

    Likewise. I have every confidence that Mr. Ross will ultimately come to regret the way he handled your problem. If word has spread through the dealer network to Australia, who knows where else it has gone? Next time I call in to my local Ferrari agent, I'll see if they have heard of it. Good luck! :)

    Mr Miller,

    I have not worked more than 5 years in the dealership world. And I can say if any damage is done by any of our employees, we roll the red carpet out. The last thing you need is bad PR. I have put people in brand new cars for a couple of weeks due to some horrible judgments in our shop.
    Sad to hear they wouldn't own it up front and do the right thing.
    If you ever need to get rid of that eye sore of a 430, I have great spot for it :)

    You make excellent points! Your situation illustrates how an unethical dealer can turn customers off and negatively affect the brand, and I commend you for not putting up with it and taking your business elsewhere. I completely agree that Ferrari should be ruthless in insisting on ethical treatment by their dealers. I hope that my case serves as a stark example to Ferrari dealers everywhere about the potential negative repercussions of egregiously mistreating even one loyal Ferrari customer. In my view, FMoV, Brian Ross, FNA, and Ferrari S.p.A. all made the same mistake of underestimating the power of social media to publicize their wrongful actions (and inactions) in my case to the worldwide Ferrari community. And as you say, there is far more competition in the market, and McLaren and others are establishing a growing foothold. I believe that those dealers who focus on unimpeachable customer service will continue to grow in market share - and rightly so. In contrast, those dealers who value money over integrity will eventually find themselves with neither.

    I agree completely. All I ever wanted was honest ethical treatment from FMoV and Brian Ross, but their actions continue to demonstrate the exact opposite. In my view, they have made two obvious errors: Failing to recognize the indefensible nature of their position, and failing to take any steps to change their position. As the saying goes, "Life is a good teacher provided one pays attention to the lessons".

    Agreed. One reason why my local Ferrari agent, Carrs in Exeter, despite being located right in the bottom left hand corner of the UK, have customers who send their Ferraris there for servicing from all over the country, and buy new cars through them in preference to dealers more local to where they live. I count myself very lucky to have them on my doorstep.

    That's excellent! It's so important to have a dealer you can count on in your area. Sadly, FMoV is the only official Ferrari dealership in British Columbia (for now), and their lackluster approach to customer satisfaction (at least in my case) reflects that reality. However, hubris may be their downfall. There are now several other companies in the Metro Vancouver area that service Ferraris and other exotic cars who are gaining more market share.

    As promised, I am posting the link to the Court of Appeal's April 27, 2017 decision regarding the $15k award as compensation for the 9-month deprivation of my Ferrari, resulting from FMoV's negligence.

    2017 BCCA 166 Miller v. Brian Ross Motorsports Corp.

    The appeal was denied. The $15k award stands unchanged.

    Because the appeal was denied, I believe that I will have to pay at least some of Brian Ross' appeal court costs - likely several thousand dollars.

    The saga does not end there because Brian Ross still owes me court costs from the initial trial which was estimated at about $25,000. In order to circumvent further costly litigation, Brian Ross' lawyer and my lawyer agreed to reduce the estimated amount owed to $22,500. However, when Brian Ross' lawyer sent the agreement to my lawyer, it surreptitiously included a non-disclosure clause saying I could not discuss the amount received! At no point prior to or since did we discuss or agree to any non-disclosure clause. In my view, this was their attempt to hide the legal cost of their negligence from the worldwide Ferrari community. That's not going to happen - the worldwide Ferrari community has a right to know how Ferrari Maserati of Vancouver (FMoV) and Brian Ross do business. In particular, they engage in wrongful behaviors and then try to cover it up - at least in my case, and there's nothing to prevent them from doing the exact same thing to anyone else who does business with them.

    Yes - I still have my beautiful F430 and definitely enjoy riding it! Psychologically speaking, I have personally largely moved on from focusing on my own situation, and have become more focused on promulgating my negative experiences with FMoV and Brian Ross in order to help prevent anyone else from being victimized by their business practices.

    Thankfully, my negative experiences with FMoV and Brian Ross have been more than offset by the continuing support shown by the worldwide Ferrari community! It reaffirms my belief that there are more good than bad people in the world. I'm happy to be part of such a great group of people!

    Dr Miller, you could get dozens of content farms to put your side of the story out, include details of Brian Ross's behaviour, and SEO the hell out of each one. Facts only, but your facts. You could optimise for a search of the man's name and his dealership. You could get them translated into Chinese and get some content on Weibo - lots of Chinese speakers in Vancouver. It would be a near permanent slur on his reputation, and while it won't stop him from buying classic Ferrraris, or get your money back, it would probably annoy him a lot, for ever. If you get enough content up there, it will cost him a lot to counteract it.

    This entire thread is just such a shame things happen and life is short.
    I had a Ferrari that I had to have some relatively minor work done on it took a few months to get it done..... they broke the windshield doing it and then the windshield had a terrible wind leak when I got it back .. The shop was 200 miles away I Called the owner he said he would fix it but in the end of the it was 8 months ... so they fixed it and all is good. This is one of the best most well known and respected shops on the east coast... I had to pay for the new Ferrari windshield .. which was unrelated to the work being done.. and took a while to get
    end result I was never concerned and am very happy with the shop that did the work .....
    with Ferraris sometimes S**T happens...,.....and they made it right....
    satisfied customer....
