There are always 2 sides to every story and this was my response.......This person is a nightmare to deal with...... You sent me something that was not even in your photo add. Plus it was missing tools, and the case poorly repaired full of mould and complete rubbish.I then tried to resolve this with you amicably. My emails were not responded to due to your extremely poor communication skills. I then sent you a formal email through PayPal to resolve this amicably and then had to wait a week to go through their long winded process. Still no reply so I filed a dispute with PayPal and had to send them photos, the add photos and all correspondence. I then had to wait 3 weeks for them to contact you and go through the same process. They ruled in my favour and it was only then I heard from you sending me threats via email. I don't respond to threats so as I have said to you in the past contact PayPal. I am not going to respond to any of your threatening or extortion emails. By the way I have bought many items off Fchat members, the most recent a set of fabspeed headers. All my dealings have been wonderful. I won't be responding to anymore of your slander or threats. I will say it again. Contact PayPal as they made the decision. You can't do a charge back on PayPal. You have to follow a lengthy process which was done. That's what you get for ripping people off........Nothing more to say.
I buy and sell all the time using Paypal. As of date I have never lost any money with Paypal. You can request that they send the buyer a shipping label(with tracking), which he or she has to use and take to their local shipper. Package must have been received at their local shipper. Once you received the item, video tape the closed package and video tape the opening of the package (just in case it's just a bunch of rocks). That's not to say I haven't had my verbal disputes with Paypal but in my cases perseverance paid off. Good luck to the OP. I hope you get your items back. p.s. always take photos and videos of an item (or items) you sell. It will serve as proof of the condition and the contents you have sold...especially if it is of a certain value
It always amazes me the amount of people who always allow a good story to get in the way of the truth........
Well, I have bought and sold a few items over F-chat and always try to check whom I'm dealing with. Not any guarantee by any standards, but it provides a sense of security. Best way I have learned is to check seller references if possible. PP charges (or should I say rob), a lot. So much in fact that it's sometimes not worth following through with the deal. And I for sure wonder what their warranties are worth when **** hits the fan..? I much prefer bank transfer but have learned that over seas (i.e. NA), sellers don't like charing the info...
I was ripped of by him (refarri calls himself Mike Paggett) as well. This was after I did a number of deals. And sometimes I received items which were slightly different that as they were offered. And I always paid with bank transfer. Prices were fair, so I was't complaining too much. Till one day the paid items never showed up. You can guess the rest. No reactions by email. Till I saw him offering the items on this forum. So I put a member warning out with all the evidence I had. And now I saw his member warning. Unbelievable! Good for you that you did it by Paypal and got your money back. So he now know how it feels. Was it a lot of money? I surely hope so!
Even one of our moderators was quick to jump onto the bandwagon of a one sided post and thread full of lies........Very sad indeed........ Even one of our moderators was quick to jump onto the bandwagon of a one sided post and thread full of lies........Very sad indeed........
Buyer requested that the kit be sent to a hotel in New York where he was staying and would collect it.. I didn't know he lived in Sydney until after ?
A one sided post ? Thread full of lies ? I gave an accurate account of the fact that the member has the item and the money ! The moderators suggested that I put the thread on the forum in order to resolve this.! I haven't lied at all. The buyer admits that he has the money and the item..how is that right ?
Where is the slander ? Where are the threats ? How have I ripped you off ? You have the money and the item ! That's technically fraud isn't it ? PayPal have suggested that either I try to get the item back from you, at your expense they say..or report the situation to the online fraud organisation..their idea not mine ! You have the email I forwarded from them ! Bear in mind that from my point of view I sent the item that I advertised (no pic in the ad) as requested to New York it was sent back to me and I resent a second time it at my expense , to Sydney. If your not happy with it , and I offered to resolve things, ok you got your money back. But I don't have the money or the item ! So surely it's me that's been ripped off isn't it ?
No, what he admitted was that you did not send the item as advertised nor did you send it after he complained to you. He complained to PayPal and they ruled in his favor. It would not be very difficult for him to screenshot the PayPal correspondence and post it here for all to see. I think that would settle the matter once and for all.
I sent the item as advertised, the ad is shown below the one in the photo posted on this forum,. I sent the item straight away he didn't have to complain that I didn't send it ? Yes PayPal gave him a refund because I didn't realise there was a case opened and didn't respond in time as I was away and hadn't had a message from the buyer that a case was open. The only issue I have is that the buyer has the item and the money and refused to return the item or to correspond until now , and I've had to go on the forum with this to get a response at all. I'd be happy to post emails sent to him giving him every opportunity to avoid theses posts..!
The ad did not have a photo in it, your ad said to PM and you would send a photo. If PayPal ruled in Gary's favor, it is simple to conclude that what you sent did not match what you promised. Why don't you post your correspondence with Gary and PayPal?
Gary never asked for a picture ! PayPal ruled in his favour as I didn't know a case was opened and therefore didn't respond in time ! I sent what was advertised ! Happy to post correspondence if it will help my cause though what I don't want to do is to make matters worse ! ,
Here is the original ad: http://www.ferrarichat.com/forum/threads/355-toolkit.550351/ Mike, please tell us why a buyer shouldn't believe that the toolkit in the photo is the one you were ultimatley selling to Gary? Because the #2 post (photo) was posted in 2016? Rubbish. A buyer has no way of knowing that the #3 toolkit-for-sale post, just below, is not referring to the same toolkit. For all a buyer knows, you had 1 toolkit, and were bumping the advert a year later. Maybe that's why Gary didn't ask for a photo... Perhaps in the future you should make one advert per item, and clearly show that unique item with a photo. A buyer shouldn't see a photo, and then have to wonder if that's actually then item they're buying.
Initially our English Friend sold it to me, but it never arrived.... So when he advertised that on the forum I made it very clear this guy is fraud, with all the proof of my buying this. So this guy 'refarri' is the only guilty one.... He should not be allowed to be able to make any future adverts. Whatever he does, just don't buy anything from him and the ripping off will stop! I think there are enough red flags by now.
Done and dusted, I'm afraid. I can't see any reason why Gary is at fault or why he should pay to return the item. The advertisement is misleading, although I'm not suggesting it was intentional, it was certainly careless.
If the correspondence is in your favor, why wouldn't you post it? You're dangerously close to permanently ruining your Ferrarichat reputation. You should be doing whatever you can to save it. Between Gary's reply to your thread and VetroresinaNL's tale you're also on thin ice. We permaban scammers.
Wow this is a whole lot of drama. It's simple to resolve. The seller pays shipping for the return item if the buyer initially paid for shipping to his address. If the seller refuses to pay for shipping back to him..then he forfeits his item. Now if shipping was included in the sale then the buyer should cover shipping back to the seller (only fair and right).
IMO really straight-up sellers (and buyers) would immediately resolve an issue b/c they are uncomfortable with even the appearance of impropriety.
Ughhh...the woman watches her every day. She is ridiculously inconsistent when it comes to car stuff.
