Warranty or no warranty, faults like that are indefensible if they refused to pay and you took them to court. My wife would tear them to pieces. Actually, I just checked with her and she quoted me some gobbledegook from Australian Consumer Law, but you can go the dealer, and if it's a private sale, you can even go the manufacturer.
