Hoping for feedback from anyone with a similar experience. I’m moving back to Bay Area (Danville) May 1st. My lease started April 15th, and we will move in May 10th.

I purchased my F430 in August of 2018, so if I bring the car with me now I’ll have to pay use tax of $3400 to Ca on top of the $1600 reg fees.

I could wait for 3 months and ship it out after I’ve had her for 12 months and avoid the use tax. I’m not one to poke at karma or shed any responsibility, financial or otherwise, but $3600 for 3 months is making me consider alternatives. I’m ok with exploring this as long as I don’t bring my car into Ca before it’s 12 month birthday. This justifies it to me, as I won’t be ‘using’ it in Ca therefore I don’t owe Ca ‘use tax’.

If I did wait, since my Ca documents will establish residency in April/May, will it work saying I just brought the car into the state after 12 months in August ?

Or will the DMV use residency of april/May anyway which means I will owe the tax AND not have my car for 3 months?

    What would you do?

    Thank you in advance.

Using this website calculator, it appears you are correct. CA even charges for a used car if its less than a year from purchase.

    https://www.dmv.ca.gov/FeeCalculatorWeb/newResidentForm.do

You can put the numbers in for the date of purchase and see clearly with less than one year it has it the fee and and more than one year does not have it.

My suggestion is if the car has a valid registration, just drive it a few more months. Then take it to the DMV with more than one year after the purchase. As silly as this sounds it could save you a lot of money. Or stop driving it in CA and then take it to smog / etc after one year of the purchase dated.

As long as you weren't ticketed there is no way the DMV can know when the car arrived in the state. For all they know you kept it in the old state and drove across state lines yesterday. If the date you show up at the DMV is more than one year from the date of purchase there is nothing they can do about it.

    And welcome to TaxAfornia!

Welcome. Yes living one of the best climates in the world, among the most highly educated and diverse populations, in the center of the technological universe, and the 5th largest economy in the world does have some costs. Judging by the number of people still moving here they think it's worth it.

The mayor got it right, a lot of folks take advantage of their out of state registration for a little, ahem, longer than normal. How is the DMV ever going to know? Just don't get stopped.

I hardly think that law abiding people wanting you to obey the law too is `snitching'. If you're trying to cheat the system (however flawed it may be), expect to pay the penalty when caught. Plain and simple.

Northern CA sucks I had to move back there to have family support for my twins and I can’t wait to move back to Florida. No clue what the fuss is about: it’s expensive and there is next to nothing to do. Rant over;)

I hear ur point- but to me it’s snitching. What good is it going to bring them to do that?
I moved to Ca then Florida then now back for a few years to CA and it makes no sense to me to pay all those taxes here: we have some beautiful backroads right, but so many of our main roads are crap, cities with homeless problem like crazy... why give the state more money? They clearly don’t deserve it. Don’t get me wrong- I have my registration up to date and so forth and I regularly see people at cars and croissant with Montana licenses or even nyc but that would even cross my mind to go report people... if what they are doing is truly that evil...karma will get them or in this case the chp.;)

Nothing to do in northern Ca? Seriously? Try living in the Midwest, I grew up in Michigan/Ohio/Indiana. Talk about ZERO to do.

I’m an avid snowboarder and aside from Utah, Tahoe is pretty great for the weekend snow warrior. I mountain bike - hard to beat Santa Cruz mountains or north star in the summer, Sonoma is a great track, as is Mazda raceway, wakeboarding on the delta, cross country running up Mt Diablo, surfing the hook in Santa Cruz, I could go on all day on what I’m looking forward to do again. Expensive, yes, as are many of the best things in life.

Guess it’s a matter of perspective.

I work in Delaware and live on the water in Maryland, my income tax will actually be lower in Ca.

Buying and selling homes and making a few bucks or breaking even (short term) is way easier in California than anywhere else I’ve lived (I’ve had 14 homes in 7 states in the last 22 years).

Texas is on my mind, enjoyed Austin a few times now. Need to bring the wife, but I’m sure she’ll love it too. But we both HATE bugs and humidity. One of the best things about NorCal for us, no bugs and cool days/nights (relative).

Correction if u don’t like hiking or surfing and like hot weather and the beach as well as lots of nice restaurants with a view then there is nothing to do. I just moved back from south Florida and that’s my opinion. I love the hills, the backroad here and the ease to make money but long term; I like Southern California better and Florida better. I love humidity, but have to agree on bugs although it’s only a few months a year.Just my little opinion.

For sure NorCal won’t be our last destination, and we absolutely agree on Southern Ca, it’s hard to beat.

One successful IPO down, one to go and I think we’ll hang it up and move somewhere more peaceful, no winters, few bugs, car friendly, and a much, much slower pace. Just not sure where yet. I’m following another thread on the topic for ideas.

We will be very close to where you were, walking distance to downtown Danville as we try the East Bay. Work and friends are all on the peninsula so not sure how well I’ll like it so far away (measured by travel time, not distance).

Again like u said - living in the bay is not Detroit and we are all I think fortunate to have good situations...but I think overall it’s very expensive for what it is and Southern California has more that I like for slightly less price. My wife likes Orange County but personally we are more Florida people; something about year round summer minus a couple days that is pretty neat.
I wish the bay, for all of its riches, had more when it comes to entertainment but, at least to our likings it’s lacking. We have 2 small kids so for now it’s okay but in the future definitely going back to Florida.
Danville is very nice! I used to work around there; the country club is nice; I believe u will love it around there.

CA only collects the difference between their sales (use) tax rate and the actual tax paid if you bring a car in within one year of purchase.

QQ: I presume the $3400 reflects the credit you should have gotten for paying sales taxes in MD?

I'd wait the 3 months just on principle but then you miss the summer "driving season"...but then again, the driving season in CA is nearly all year long.

I lived in the East Bay (Walnut Creek, Orinda, Lafayette) most of my life...damn fine roads out there (although I presume they are infested with cyclists on the weekends like everywhere else in CA).

Its a shame that enough people tried to evade taxes by "buying" the car in another state with lower sales tax and then bring it over to CA (where they lived and wanted the car) that the state had to make the blanket rule of "pay our tax if brought here in the first 12 months". Its BS for people like you that had no intention of evading any taxes and truly bought and used the car where you lived and are now moving to CA.

When taxes have a degree of fairness the vast majority comply willingly. It is only when everyone knows they are being bent over do the average people look for another way. That in a nutshell is California.

For my small business in California I had 8 licenses. Every level of government had their hand out. Each with regulations, inspections and fees. Some were actually apologetic about the process. Not only that, in California it is easier and cheaper to get a divorce that to get rid of an employee.

In Texas I have one license, a resale license. This state operates quite well on that one no fee license and we have a part time legislature that meets every other year for 140 days. Then they go home to their real jobs. Seems to work here.

We aren't in P&R, and believe me I'm not defending CA. I left several years ago and haven't looked back for many reasons, the size and cost of government being a primary one.

I'm simply saying - wrt the thread topic - that I'd bet the 12-month sales/use tax look back rule was put in place to deter/catch fraudsters. Just like CA LE troll for OOS plates for folks that live in and own cars in CA and are evading sales and license plate taxes

I used the out of state plate 'snitch' line when I was still in CA for a couple who rented a house across the street from mine. They didn't have out of state plates, but rather paper dealer plates going on over a year. The way I saw it, the more people evading registration, the more my registration rates were going to increase year over year.

In my case, absolutely nothing happened after multiple reports and the deadbeats continued driving on their paper dealer plates for another year until they were evicted for not paying rent as well. It took several months for the landlord to actually get them out of the house, of course, while they continued to live there for free. Which is more CA nonsense.

I understand CA has now moved away from paper plates, at least.

I know, right. Tahoe has no world-class skiing/snowboarding in the winter, or beautiful hiking and camping the rest of the year. There are no beaches, or surf, Can't drive Hwy1, or to Yosemite, or the Wine Country, or Monterey, or go white water river rafting, visit Casinos, Carmel, Lakes, Santa Cruz, Sail, find amazing roads, amazing vistas. Can't eat at any of the finest restaurants in the world, can't visit one of the finest cities in the world or the most popular landmark in the US. Can't play golf on world class golf courses, or visit world class museums. Can't watch any championship Basketball, Baseball, or Football teams. Can't visit Blackhawk Car Museum. Can't find ANY music or comedy or plays or classical music. Can't take in World class race tracks at Laguna Seca and Sonoma. Can't explore missions settled in the 1700s, can't walk across the Golden Gate Bridge, can't take your kids to where gold was discovered, or hike through the tallest trees in the world.

Totally hear ya, no entertainment at all.

Come to Miami -I lived in both places but the bay is all work, expensive, real estate, homeless issue, lots of driving. How long does it take u to commute if u have to? How far Is Tahoe? Yosemite ? In LA or Miami u can live pretty much on the beach.
Beaches ? Please it’s too cold to go in the water.
Yes great scenic roads and totally crazy prices.

    To me I go 1-fl 2-socal 3-northbay

Again I live in the bay; it’s ok, not Detroit but the quality of life ? Not that great and I live in an amazing country club with golf course etc. How much does a nice house cost u? School ? It’s just outrageous.

It’s all personal tastes ; my thing is quality of life, sun, low stress, variety of restaurant and a bit of flashyness...Living in FL offers to me more entertainment and less stress... that’s just me though. I respect ur decision ;) tu are définitly right on our nice landscapes and roads in NorCal , they are great and supercars make no senses in fl but I will take the tax cut anyways ;)

Yeah thanks, appreciate the invite. Done that, not my thing. The downside I see to to southern FL are bugs and the fact it won't be there in a few decades. That said, I see the appeal, it's a fantastic place to visit, like Brasil.

My first house in San Jose cost $254K, but that was a couple of decades ago. See that's one beauty of Bay Area real estate, you get in, and you're in. That same investment has been parlayed over the years into homes worth 16X that initial investment with a little good timing. Yes there are easier places to live, no argument there. I get it's expensive, it's not for everyone. Like you say it's all personal taste. Totally in your camp there. cheers

So today I did pretty much everything to get my Alfa 4c new CA plates from Nevada.

They give you a form to fill out at the DMV. It asks all kinds of questions including if you bought new or used, when you bought it, what date you brought it in the state, when you moved to the state, etc.

My car had been in CA for about 3 months. The registration ran out a few weeks ago in Nevada but I was too busy to get it smogged etc, which I did today.

I told them the car came in on 6-1-19. They said nothing. Because it was expired by only a few weeks there was no penalty.

So my suggestion is don't drive the car or if you do, don't get stopped. Then just tell them you came in a day or so earlier and you can avoid the idiotic tax. Mine was 4 years old and over 10K miles so it was exempt anyway. And, I paid the sales taxes in Nevada on the car. But the process it the same if you want to save some money.

To me, this is a tax on a tax. You paid sales tax in one state and then CA makes you pay it again. Getting around that is not cheating. It's only fair. And in fact you could leave the car out of state with friends or family and drive it into CA the day before and it would follow their own rules exactly. No biggie.

One suggestion is do the appointment and avoid the long lines. You need your smog cert and have the DMV look over your VIN and Mileage before you go inside to get your plates and tags.

And they don't take CC's. You pay by check.
