Clarification, from the discussion in April 2019, on indicating ownership when posting pictures The board rule is clear. By posting with no comment, you automatically grant further free use of the image. If you do not have the right to grant (bold text below) that free use, you should say so in the post. https://www.ferrarichat.com/forum/help/terms You agree not to do any of the following while using the FerrariChat.com Bulletin Board: 6. upload or transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party. It wouldn`t be, if you would take of all the images were copyrights have been broken. So what are the consequences for the users which don`t follow the rules? Kind regards Manfred
So do I understand correctly that even by just copying and pasting an image or content from the web or its social media platforms without acknowledging its ownership and/or verifying its previously granted free usage can potentially be a copyright infringement ? Or if someone posts their own original content, image or photo without specifically expressing or requesting their copyrights to be observed, they’re essentially granting its free & open future use ?
I would say YES and YES. Terms and conditions and American law are a wonderful thing. Especially when people post first than think
Thank you for clarifying. I’ve always suspected or thought this was the case and have tried my best to observe it. OTOH, I think you're giving too much credit for “people” in general, especially on web forums. Just like in real life, many don’t seem think much, if at all, before of after posting or expressing themselves. More often than not, they just seem to react without it (= thinking).
Almost all the pix I have posted are my own, and if not I have mentioned the owner's name. You are free to use my pix, but it would be nice if you mentioned my name.
Ed, I adored this little mini-string! P.S. I've practiced law in New York for over 60 years, was adjunct Professor at N.Y.U. Law School for almost 30; Manfred's answers to TTR's questions on U.S. copyright law are correct.
