430 Had an accident. Advice needed.

    Long story short. Was on the HWY, a bike fell off someones truck. Everyone slammed on their brakes. I couldn't stop fast enough and went under someones SUV at about 40 mph. I was able to drive it home, but it was pulling to the right and it has a slight lean now. Hood, Fender, Bumper, Headlight and Mirror are obviously trashed and tweaked. I'm taking it to the Bodyshop tomorrow per my insurance. I know things can add up quick, so I'm just curious what you guys think?

    Oh, also someone swiped my mirror.

    I'd be worried about diminished value, but it may be unavoidable if there's already an accident report. If there's no record of the accident and you don't have to replace many parts I'd consider paying out of pocket. I've been shopping 458 replacements for my 430 and every time I see a great deal it's a Ferrari that has an accident report on Carfax.

    That is at least $40k. Does the guy whose bike fell off have insurance? If it is the other guy's insurance, then you can claim diminished value and entitled to a rental car of equivalence

    I think this will cost over 20k. Wonder If they will total it?

    Value if you sell later will take a 10% or more hit.

    If there was a police report and they grabbed your VIN (which they almost always do), then there is a hit on Carfax entered.

    I've had a couple non-police involved accidents/issues from massive hail damage to being rear ended, to a hit and run... none of them showed up on Carfax.

    The police were never called. My insurance already spoke to the girl that I hit and she's not filing a claim with my insurance. Her dad was able to pop her bumper back out.

    I'm not sure. He was long gone. Same with the person who swiped my mirror. It all happened so quick. She tried stopping on the HWY, but I got out and told her to get off the HWY. We exchanged insurance and went our seperate ways. She thought she was at fault and didn't want a ticket, so the police weren't called.

    Yes, I'm worried about diminished value. Paying out of pocket isn't an option. I'd rather just let it go to the insurance company. Who knows though. I'm not sure how this all works.

    That sucks. Totally random. At least the structure of the car held up.

    I've had several close calls and small incidents with things flying out of trucks: a microwave bounced and hit my bumper, an entire wood armoire/bookshelf (that miraculously smashed totally flat after rolling out of the pickup truck directly in front of me, enough for me to drive over at 65mph without damage to mom's Caddy), my first A8 got its aluminum hood smashed by a gigantic piece of ice that came off of an 18-wheeler, etc. I watched a truck in front of me on the I-10 in LA with a giant roll of paper that was unspooling light other vehicles on fire. I've dodged mattresses, watched a Lazy Boy tumble out, and more...

    If the damage is more then 60% of the value of the vehicle, the insurance company may total it.
    The sum of the parts is far greater than the value of the car

    Technically, the OP is at fault for the damage to his F430. The bicycle owner has nothing to do with his claim...only if someone hit the bicycle. He rear ended the SUV, in that case, he could be cited for "following too close" if he reported to the police.

    Agreed, easily over $20k...headlight, bumper shock, mirror, and paint the entire front. Will know more once the bumper comes off for inspection, and put it on a frame bench.

    The same here in Florida--80%. I really empathize with you sir. I've had two cars totaled by careless drivers. REALLY sucks. Especially when you put your hard work into one to make it everything you want your car to be. You may be better off just cashing out. But I know that can be a tough decision. The diminished value will be a factor though then there's that to consider.

    Pour a glass of scotch and kick back tonight. Maybe two...

    Is a diminished value claim taken into consideration when a insurance makes a decision into totaling a car?

    ouch, so very sorry to see. I would never consider paying out of pocket, that expense is too great. It's in a condition that could very well be totalled. To get it done right by a ferrari specialist would be 30k easy (perfect color match and orange peel, cant tell if the panels were repainted etc), and at the end of the day you run the risk of diminished value if it shows up on carfax. The soft market for 430s certainly dont help....>< time to move on, and i am glad u are ok

    Responsible accidents are accidents that you are responsible for, so the perspective on whether an insurance company should pay for the diminished value is different than when the accident is not your fault. You may have a harder time trying to collect anything from your insurance company if the claim is considered due to a responsible accident. If you have legal counsel, then you could consult your lawyer to find out what the likelihood of getting paid would be based on your state laws.
    It doesn't hurt to find out what your insurance company is willing to do for you specifically, but, in general, this situation is less likely to pay for diminished value.

    Diminished value is not taken into consideration if it is your insurance company. Usually there is a clause that does not allow for diminished value in your policy. You can get it from someone else's policy if they damaged you
