Kevin Hart, passengers in car crash prep for lawsuit over vintage ride

The comedian is taking heat from those who were injured in the Sept. 1 crash, including the driver and a second passenger, who say Hart showed negligence for not having critical safety features installed like airbags and safety harnesses, according to a report from TMZ.

They are expecting someone to retrofit an old car with airbags? That's a ridiculous argument. I don't see this holding up.

I think Kevin needs to get some new gear-head buddies who won't sue.

Silly. I wonder if the lawyers talked them into this nonsensical action?

    Ya THINK?
The potential repercussions could be 'problematic' for the industry...at the very least, any custom/restoration shop is now working on liability releases w their attys...

Let's look at it this way- none of the plaintiffs are dead, only injured. Thus, the 1970s safety technology did its job and worked in preventing their death.

My understanding is that the resto-modding removed the rear seat. Seatbelts prob helped front seat passengers, but there was no secure seating for the 3rd passenger in the rear...

I'll go out on a limb & assume there was no one holding a gun to anybody's head to get in the car & go for a drive.

I think driver owes Hart a new car! How can driver have right to sue? Old days owner would beat the cr@p out of driver for excessive lack of talent wrecking owner's car.

I don't see this going anywhere nationally but I can totally see California seeing this as a moneygrab. Make everybody retrofit airbags into the vintage cars or pay steep fines! LOL

Agree! Car crash tests, air bags, rollovers, bumpers, etc. are mandated by Federal law to receive NHTSA (or equivalent) approval before being legal for the road. As a practical matter, to retrofit such devices, it would require building 2 vehicles. One to crash and destroy in the NHTSA test and the second to enjoy on the street if the first vehicle "passes" the test.

An old car like Kevin Hart’s was never engineered for airbags and wouldn’t be realistic to re-engineer it so it could. Way way too many variables! Airbags can kill you! Modern car structures are designed for airbags using crush zones and sensors. OEMs Test every size, shape and weight of a human to ensure them being as safe as possible. When Porsche added airbags to the 911, they re-engineered the complete structure with the 964 and subjected it to unheard of hours of testing. There are older vehicles that have integrated airbags into them such as the Mercedes G-Wagon. To do this, it requires safety crash experts, re-engineering and lots of testing. In most states, a car must only comply with the model year. As an example, a car that wasn’t equipped with seatbelts such as cars from the 50’s (up to 1968?), don’t require them. What do you do if it’s an original Model T? A ‘32 Hot Rod? As an enthusiast, it’s just common sense to reinforce the body structure and add street legal harnesses if you add this kind of performance. You can’t make your friends wear them though! I won’t drive anyone that doesn’t put on their seatbelts. That’s just me though. Kevin Hart could use an industry expert witness. It’ll be interesting to see where this goes. Should be about common sense and what is realistic.

I thought the thread was mostly about negligence for not having critical safety features installed like airbags and safety harnesses.

It will have zero impact on those who keep their cars stock/original.
