Rear ended on December 31st...

    2019 was a rough year and it seems as fate would have it at around 5 PM on Dec 31 I was out for my last ride in decent weather in Atlanta. Stopped at a light a guys plows into the back of me. He went to jail (expired license AND he had also been in another wreck earlier in the month and unscrewed the tag from that wrecked car and stuck it on the car he was driving). Off in handcuffs he went and his car was impounded. The car he hit me in had State Farm and I have State Farm.

    A couple of questions:

    1) Does anyone know any good appraisers in Atlanta area that can help me? I’m concerned about the diminished value equation and getting my ducks in a row with that.

    2) Does the appraiser normally do the appraisal before or after the repairs are done?

    One of the reasons I don't care to drive in Atlanta, even though I have to for my job sometimes. Lots of lowlife trash like this guy. Surprised he actually carried insurance. Hopefully he's off the road for a long time, luck doesn't get much worse that rear ending a Ferrari in a $500 hooptie. Hopefully you can rake his insurance over the coals.

    Thanks Red. I was shocked there was insurance on the car too. The issue was, the car wasn’t in his name. His wife showed up and said they just bought the car. It was an old Nissan maxima. The officer said the car was definitely insured.

    The actual body damage doesn't look bad. The concern I would have is the transmission. It has a crush box on the back to provide some protection. If it was me this would not be going to a standard body shop, even a very good one. I'd want it to go to a Ferrari dealer with an authorized body repair shop. Those are not terribly common but obviously check with Ferrari Atlanta.

    Good luck with the process.


    This could take some time. Get loss of use reimbursement too. Its not only fair, it inspires them to get it done and not just talk about it.

    I am not a lawyer or an insurance man but i'd bring it up right away. Expect them to down play or low ball you but the daily value of a Ferrari is quite high.

    You are paying a lot every single day and you don't get to use it. They *****...tell them to rent you one. That will help make their mind right.

    This just came up on my fchat Facebook feed.
    Sorry to hear this and I had this happen to me with my Lamborghini Diablo VT Roadster. Both of us also carried state Farm and even though he had high coverages, it wasn't Lamborghini coverage lol
    Your insurance is going to pay out here. The most important thing you need is a damage evaluation specialist.

    Reach out to "chairman" on fchat. He did the one for my Lamborghini. Lamborghini Miami was all set to "repair" the car with the insurance's blessing. It was only after the specialist went through the car and frame work, was it shown to be a write off. Insurance companies want to sweep it under the rug as fast as possible....stand your ground.

    Oh, and take as many pictures as possible from all angles.

    Three claims --- (1) damage, (2) diminished value, (3) loss of use.

    Sports Car Market had a great article on loss of use claims in April 2019 by a contribution editor, a lawyer, John Draneas - often times it's the largest part of the three clams.

    Awful end to what sounds like a pretty testing year for you. Hopefully, it gives 2020 the opportunity to run sky high for you buddy. Good luck with the insurers, unfortunately I’m in the wrong country to be able to add any help for you, but the guys seem to have you well covered. Main thing is (and I personally hate it when it’s said, and I’m looking at a damaged Ferrari) you are okay, could’ve been worse! (BTW, I’d hire a 488 pista and break his insurers just for the fun of it!, which in the UK is legal and possible)

    Thanks for this info. Very helpful. The damage evaluation, does chairman do that in person or via photos? I’m in Atlanta so wondering has that is worked out if he is somewhere else. (Do I fly him to Atlanta to do it is my question)

    Make sure that you get your ducks lined up before repairs begin. I have State Farm and they were fair in a recent accident. However, years ago my wife was involved in an accident where State Farm was our insurance company as well as that of the other driver. We got screwed because they then tried to “split the baby” and find some fault on the wife’s part (which there wasn’t). They ultimately said it was 50/50 because they couldn’t “favor” one insured over the other. We would have had to go to court to fight it. So beware when State Farm is on both sides of the fence. There wont be diminished value coverage or high rental cost on your side of the insurance equation and that is where they will try to play.

    He can do it by photos. In my case, he researched the impact by pulling up factory diagrams of the frame work and where the main structural strength was and if it was compromised.

    Btw, his real name is Robbie Desantis...and does this for a living.

    Dcraig - I'm over in the Windermere area. The accident happened at the corner of Buford Hwy NE and Hwy 20. I was stopped at a light that had just turned red at the intersection and he just kept on going. Funny thing is he knocked me into the middle of the hwy and I was able to pull into the next parking lot, but he waited at the red light. So, at least, once he was force to stop at the light by my car, he complied with the law and stayed at the light. Once I pulled in to the parking lot, a part of me was concerned that he was just going to keep going so I pretty much ran out to the road and stood there. I was so upset I was willing to jump in front of his car to get him to stop...I'm kidding of course, but that's how upset I was. Luckily he pulled in...and subsequently got arrested.

    Thanks for that article. That's some excellent and thought provoking information right there. I do have one question...Do our cars really take 150-180 days to repair??? I'm going to miss spring driving season with the top down if that's the case!

    Paul - feeling “average”. It’s funny how adrenaline masks pain for the first 24 hours. I remember it being a big impact but I can honestly say getting hit at a dead stop by a car going 45 mph ain’t no joke. The force literally popped my A/C vents out of the dashboard.

    :( I'm very sorry to hear this. That impact is no joke to do that in the front vent.

    I would make sure you take all possible examinations to make sure your are okay. As you know, many injuries do manifest sometime after the impact. I wish the best, and I hope you get back on the road soon. Be well friend.
