    They needed to have produced 'continuation' GTO just like so many other manufacturers - maybe they'll miraculously find just in time to file and win another appeal a recent continuation car in the collection of a collector who obviously insisted its existence be kept a secret !

    A few years ago at the most famous restoration carrozzeria in the Modena region I saw, behind a partition, a brand new GTO, 62 style, lacking only paint. I asked what is this and was told non e niente, it's nothing. Hush hush.

    I was trying to remember on which visit I saw that. I only went there a few times. It was not the last two times, 2019, 2017, it was earlier; I think it was on my first visit in 2006. It looked ALL new. If it had been a legit GTO being restored the man would have said so. Instead he said it is nothing....and it was odd that it was the only car behind a partition in a corner of the workshop.

    Wow Ferrari losing the rights on their most iconic car to some kitcar company.. what a debacle.

    European trademark laws are rubbish. If you haven't heard of the story, look up CNN's coverage of the Supreme brand in Europe. An impostor copy cat company registered the trademark and logo in Europe before the main office in the US could do so.. now the 'Real' Supreme is powerless and fake goods are sold out in the open in retail stores all across Europe.

    I would have thought copywriting a shape was impossible unlike a brand name or logo or some other specific tangible thing. Besides there are already thousands of fake GTOs ranging from Datsun 240Z based fakes to remade cars from GTO Engineering and Heitbrink amongst others that only an expert could tell weren't real. Where these do and will differ is they aren't able to be legally branded as Ferrari's. Maybe you could get away with a one off based on a Ferrari chassis but good luck with series production without Ferrari's approval. Anyone else remember the Miami Vice replica Daytonas that were built by McBurnie coachworks which saw legal challenges over their badging?

    Shapes can absolutely be protected. OEM car companies spend millions of dollars developing and creating unique designs. The shapes are patented and protected from infringement by expert legal teams. Chinese companies, toy producers, kit car makers, many others are out to profit from other people's hard work and brand equity. This is exactly about being able to produce that particular shape (in any quantity) "without Ferrari's approval".

    It's a bad decision for Ferrari's rights, but I don't think it hurts the status of the iconic 250 GTO one iota.

    I honestly don't think this will be a problem for Ferrari. Replicas with the Ferrari brand will still be illegal, and with the existing GTO's well accounted for, no one will mistake them for the sea of replicas - many of which are already out there.

    You could tell by the rear hatch and the doors. ,,,,,,
    and didn’t like the removal of the side 1/4 windows.

    I’ve been saying for years that “when” Ferrari finally decides to follow Aston and Jaguar in building their own “continuation” series of models like the GTO, Testa Rossa etc, (should easily be able to sell them for 4 to 5 mil each) not only will it be extremely profitable but would provide the basis for a revived Historic Challenge Series.
