    Yeah, I know. I bought a new Ferrari and got a ticket. I'm sure this has happened to many folks in here. The officer claims I was doing 113 in a 60. I had some cars riding my rear so I did speed up to get into the right lane in order to let them pass me and they sped on. Perhaps the radar hit them and not me. I don't feel I was going over 100. Maybe 85 or 90 but certainly not 113. Do I hire a traffic attorney? The officer said the ticket will be around $1100. If I'm indeed guilty of this, I'll gladly pay the money. The points on my license is what's gonna kill me. Any advice is appreciated.

    My attorney just sent me conclusion & fine to pay from my last ticket, no where near the speed overage you have. Yes you need an attorney, my 2 cents

    Best to find an criminal/traffic attorney who is former LE in your jurisdiction. They don't need to worry as much about the technicalities of the law because they know the players and can call in favors where others cannot.

    The whole traffic "court" idea is nothing but a gigantic, billions-grabbing scheme. Attorneys are, by the way, complicit in it as they could very well try every case in a real court (judicial hearing, and not administrative) and have it discharged instantly.

    This is a bad ticket, and you should hire the right guy. The way you find the right guy is to find an ex DA or similar, who knows the game, is always in court rather than a desk jockey and can get it dismissed before the judge hears it. It has nothing to do with your speed, the cop, or the other cars.

    Or pay off the cops brother so he won’t show up in court.

    Not that I’ve ever done that, but it is a strategy.

    Absent that, go spend a day or two in court and see which attorneys do best, then hire them.

    Wow Florida is lenient if you just get a ticket. I guess that figures since they don't even have vehicle inspection. If you were clocked 50+ mph over the limit in some states you would be arrested and the car impounded.

    Always wondered why cars and drivers don't receive their own speed ratings.

    A 17 year old in a VW Bug might get rated for 55mph on the highway.

    A 25+ year old housewife in a minivan can safely travel 80.

    A 30+ yr old in a standard BMW or Mercedes = safe to 100mph.

    The Porsche is safe to 120mph, unless the retired dentist is too old, then maybe max him out at 90mph.

    I've told this story before. I just bought and F430 spider out of LA and then moved to Vegas. So I took it to the Nevada DMV to get registered. I turned in my plate and got a temp tag that you stick to the windshield. At that time they mailed you your plate which took a week or 2.

    I'm leaving the Hard Rock about 1 AM on a warm Friday night. I don't drink and I'm taking my time driving south on Paradise going down to Tropicana because I didn't want to make a U turn. I'm just cruising with the top down on a nice evening going with the traffic. Cabs are flying past me going to the airport. Next thing I see flashing red lights behind me. Cycle cop.

    So he walks over all tough like and looks at me. "Been drinking?" "Nope. I don't drink". Clearly he could see I was not impaired. "Let me see you license". I pull out my Nevada drivers license. I can see right away he's disappointed thinking no plate was a California driver (damn-- he's a local!). So next he asks for my registration. I pull out the paper that shows I paid just yesterday (damn -- he's paid up!). So he goes back to the cycle and talk to someone on the radio for a while. I've got no warrants or tickets. (Damn!).

    So he comes back to me and says "You were speeding. I'm giving you a ticket for 5 MPH over the speed limit". I'm like -- WTF? But I don't argue.

    I gave the ticket to a lawyer friend of mine and he got it reduced to a $200 parking ticket, which I paid.

    So the answer is -- yes -- fight it. Sometimes cops just want to make a bust.

    In CA you would be in jail if over 100+

    I lived in Ft Lauderdale for a year. There are two types of drivers on I-95. Those that drive 90 mph and those that drive 9mph. :)

    Sometimes cops just want to make a bust of a Ferrari. Over the past 10 years or so, I have been pulled over three times for five over. The most absurd was on I-10 in West Texas at ~2:00AM, pouring rain and small town cop pulls me over for 5 over!!

    Go set your car up with front and rear radar detection as well as laser jamming counter measures , get familiar with what K, Ka, band your HIghway patrol uses or whomever as well as who is using lasar. The laser jamming will give u enough time to hit the brakes , K Ka, whether or not its instant on are easy pickens for good radar detection devices. Of course , you should do your high MPH antics in areas where you have enough room to breath. Out here in So Ca, we have an infinite about of roads for high speed 2 and 4 wheel machines. M V1 will pick up CHP at least 2 miles depending on the road, they use Ka, same as LA County Sherrif. In the city its useless. Most of the time the CHPs pace you, so a good eye for the rear view during the day helps.CHP on the 15 going to Vegas or the 40 to Laughlin, you can do 150 no problem with good radar, CHP are going both north and south, and east and west, or sitting in their cars. The V1 is so good,it picked up a CHPs radar gun in the on position idling in its holster, at least 1 mile before , when I pulled up to him, I asked him , he said he left it on and had not picked it up for the last several minutes. I will have to say, once in a while out in the desert they have aircraft checking for speed.

    the conspiracy theories about lawyers gets so old.

    nobody calls in a favor for a traffic client. If I've known and socialized with the judge for twenty years, I'm not asking for anything for some brand new client off the street.

    State attorneys doing traffic aren't old experienced guys. They're newbies. And they aren't good at their jobs.

    An experienced attorney does a discovery later, sees what evidence the state has, and advises accordingly. Cases go away when you point out to the prosecution all the problems. But nobody on the state side doing jailable traffic is some old buddy with whom we go drink. Now, knowing who a supervisor is in the state's attorneys office so you can jump heads... that happens. We have the number because we're friends, but it's not a favor he's doing me... it's a favor I'm doing him so his newbie attorney in his office doesn't look bad and make his office look bad.

    It comes across as easy because it is when you know the statutes and caselaw and have a reputation of that. The other players know you don't call BS when it's not.

    Backroom glasses of scotch just don't happen for traffic cases.

    What Statler said. I got a ticket (not in one of the Ferraris) on Interstate 85 in a rural NC county. Found a local lawyer in the Mayberry-like town. He and the traffic court guy were childhood friends. $ 550 and no points (86mph recorded in a 70 zone).

    Get it lowered to a speed that allows you to take an online driver safety course. Keep your nose clean for 2 years and no points. Still pay "court cost".

    OK, I'm a criminal defense lawyer AND I got a 116 mph ticket in my own right last year. Take my spin on the problem for whatever it's worth...

    1. The chances of getting that ticket pled down to a manageable speed that'll get you a traffic safety course option are slim to none. A three digit violation is a different order of magnitude and judges and prosecutors get really unsympathetic. I understand that 120 in an Fcar is nothing but they're not gonna see it that way.

    2. Best bet initially is to be super polite to the cop...be respectful, don't BS him, and don't play him for a fool. Maybe, just maybe, you'll catch a break. But don't admit to the speed either...mainly let him do the talking.

    3. Can you afford to go to trial and lose? At hyper speeds most jurisdictions will have a stinger of some kind built into the statutes. Your car can be impounded, your license can be suspended, you can even go to jail in some instances. Best to do your research first so you understand your exposure. And don't assume the playing field is level.

    4. That said, most courts will have some kind of delayed or deferred sentence option...you might not be able to reach it pro se but that's where a lawyer comes in. Basically, you plead guilty or no contest but you aren't sentenced immediately...instead the case is kept open, what we refer to as "deferred", for a period of time equivalent to probation - could be 6 months or a year. You'll get a substantial fine (usually disguised as some kind of administrative fee) and might even have to go to traffic school too but if you complete the term successfully the charges are dropped and the case history is expunged meaning, in effect, that it disappears from public view. The process that gives you a toxic history is when a judge finds you guilty - with a successfully completed deferred sentence that never happens. And BTW - I had a colleague friend negotiate mine for me...plays better that way. Trust me.

    jurisdictions vary greatly. I went to law school in Florida but I've been practicing in Maryland for over 20 years. completely different laws and process. And our neighbors in Virginia? another world when it comes to traffic. We also have some federal roads nearby.

    Even counties within a state may be different for the process. Some here it works to force the officer to show, but in others here the officer is allowed to be on call, and if you make him appear the trial goes forward as settlement has failed. So people without lawyers who think the officer wasn't there and make a fuss end up getting screwed because they didn't know the process.

    call someone in the county where you got tagged and ignore everyone else. (including me as I don't practice there).
