    ^With God's grace we both are absolutely fine', the Lambo driver told the Indian media. He is the billionaire owner of the Oberoi hotel group.

    Under investigation for liability by the Italian police, but it's not clear if he's still there or if he took the first Gulfstream out of Sardinia.

    Retired Italian couple were in the motor home that was hit.

    My analysis.
    Based on California Law

    Chronological Order
    Lambo making an illegal pass (Fault count = L:1, F:0)
    Lambo did not pass when safe, crowded out a bike (L:2, F:0)
    Lambo did not signal back to lane (L:3, F:0)
    Ferrari speeding (L3: F:1)
    Ferrari making an illegal pass (L3:F:2)
    Ferrari illegally staying in the wrong lane (L3: F:3)

    So far, there have been no accidents, but drivers have made many mistakes.

    Now, to determine the cause of the accident. (reset fault counter)

    Lambo making another illegal pass (since past the center median) (L1: F0)
    Lambo did not signal (L2: F0)
    Lambo did not check the blind spot (did not pass when safe) (L3: F0)
    Ferrari did not yield to the passing car in front of them (did not pass when safe) (L3: F1)

    I assign more blame to the Lambo, but both are in the wrong.

    Lambo's Lawyer will argue that the Lambo was already in the act of passing again (albeit illegally), and if the Lambo was passing FIRST, it's incumbent on the Ferrari to yield to a car passing ahead.

    The problem was the Lambo was indecisive riding the median, the lack of signaling further made it ambiguous.

    Wondering what the Ferrari's prosecution will say, given they hit the Lambo for illegally being in the wrong place too.

    To give perspective, assume this is a Freeway. I ALWAYS yield to the much faster traffic to the left of me, aka the "fast lane", and would never try to merge until absolutely clear.

    Lambo owners is a billionaire, so you'll be sure the estate of the Swiss family will get something.

    i think your assessment is sound.
    and given that he is a billionaire, not only will the deceased estate go after him, so will every other person affected in this accident.
    he is in a world of hurt.
    as was said, he is likely gone already from sardinia, since if he is not then he is in jail or soon will be - italian law on these things is draconian

    I just returned from Italy last week. While driving with my friend who lives there, I commented on the driving habit of passing on solid white lines. I asked if was legal or just not enforced, because everyone seemed to be doing it. Three wide at some point! He said completely illegal, if you are caught instant license removal, no questions asked. Car towed. Yet it was constant. Strange way to live............... or die as the case maybe.

    If I understand the event correctly...this is one of those "experience drives"...like not their cars? If so I can't help but question the logic of handing the keys for very powerful sport cars to overly excited tourists who have likely never driven one and will want to "see what it can do".

    Truth be told I think even if you buy a new 296GTB or McLaren or Lambo you should have to have a cert from a racing or stunt driving school. I like what Porsche does with their Experience Center delivery. They show you what the car can do on the track. Good idea.

    The Ferrari driver was 100% at fault. Regardless of what the Lamborghini did or didn’t do in terms of passing, straying over the solid line to pass, peaking around the camper, failing to signal, etc. the Ferrari driver failed to see that and keep it at a safe distance ahead of him so that he could take appropriate evasive action if needed. Instead the guy followed right along and despite the Lamborghini straying across the line the Ferrari tried to make space where there clearly was none. It’s sad for all involved.

    Like Brian mentioned, it’s why many guys don’t go on these events. Unless they’re really well ran and include police escort I don’t see them as worth the risk if you’re crowded in with more money than brains guys or even worse, “influencers”.

    I totally agree.

    I was in a similar situation today making a left turn and there was a white BMW straddling two lanes more on the right lane, I was very cautious and waited for him to do make his move before I got next to him.

    These guys need to watch the video again. The blue Lambo was over the white line readying for another overtake. The guy in the Ferrari needed to 100% take note and caution with this fact.

    If there was no Ferrari driving like a dhead there would not have been an accident in my opinion.

    Californian law sucks if it is counting points.

    And I don’t care how rich the Lambo owner is.

    ferrari to blame imo, i'm not sure what he was thinking making that overtake considering the positioning of the lambo.

    Completely agree and I would smash the like button 1,000 times if I could.

    And LOL to those that think the billionaire Lamborghini driver will have to pay out anything more than nuisance cash. He didn’t cause anything. If he had stayed completely in his own lane, the Ferrari STILL hits the motor home. That stupid guy was fully committed and left himself no recourse to get back in the right lane.

    I’m still in disbelief at how ALL those cars, the F8, the Roma, the white Huracan, the blue Huracan and the Portofino, all kept passing the car with the camera… on that kind of road, with SO MANY cars and motorcycles coming the other way… I mean I don’t get it… it seems to me that there was some agreement for each to pass the camera car for the sake of video— I mean why else would they all keep passing the camera car? We don’t see the camera car have any interest in approaching and passing the white truck. Seems too coincidental that everyone just had to pass the camera car. In my opinion, this was organized and intentional for video purposes. - and stupid AF on that road.

    Only because the Ferrari driver is dead and can’t be charged. I bet the drivers of the other cars making illegal passes also get charged with things. All the drivers deserve a legal punch in the mouth but only the Ferrari driver caused the collision.

    Both drivers are to blame, the Lambo for not looking i the mirror and not giving sign and the Ferrari for stupid and risky overtaking,

    Both were in the same event and obviously driving in a convoy.

    There´s a strict order when driving among about 50 or more Ferrari cars in the Ferrari Club Austria. DO NOT OVERTAKE EACH OTHER IN THE CONVOY!

    Pass slower cars one by one. That helped to prevent accidents for more than 20 years.

    The footage is a private video, it's not an official camera car.
    The occupants are german and are constantly wondering about the reckless driving of the supercar drivers.

    Ye I understand it’s not a professional… just referring to that car as the one with a camera rolling…. Regardless, it still makes no sense that everyone felt the need to pass them in such a high traffic and dangerous area. One sure, two ok… but 5 different cars feeling the need to pass right there? Hmmmmm

    Italian traffic laws say that legally the Lamborghini driver is liable for causing a (fatal) accident because he started overtaking while already being overtaken himself. This is an serious offence (even a crime) that can (and probably will) be prosecuted.

    All other issues (like illegal passing, or speeding) are lesser offences that probably will be fined. I have no idea if it is possible / common use in Italy to fine a deceased driver......

    We all believe that morally a lot of the blame (if not all) is on the Ferrari driver, but legally he is not responsible for causing the accident and therefore will not be prosecuted.

    The same traffic laws are essentially valid throughout EC countries.

    It may not seem "right" or "fair" to us, but suppose you are driving in the slow lane and start to overtake a lorry while at the same time a much faster speeding car is overtaking you. The liability on the resulting collision is only on the car changing lanes; the fact that the overtaking car was speeding and driving recklessly is not relevant for the liability (this may be fined though).

    In the Netherlands, in an accident between a car and a bicycle the liability is almost always on the car since a bicycle is deemed "vulnerable" . Only in extreme cases liability will be on the bicycle. Again, this seems not "fair" but it IS the Dutch law.

    Therefore it is always essential to check local traffic laws when driving in a different country. It seems that the Indian billionaire was driving like he was at home in India: big mistake.

    Watch the video again. The Lamborghini was clearly a meter over the line looking for clearance to overtake the camper when the Ferrari attempted to overtake him.

    In the abstract, the law makes perfect sense (the person who cuts in front of a car that is already passing is responsible).

    I'd say that, in this case, it's anything but clear. The Lambo was already steadily driving well across the white center line long before the Ferrari came along, but the Ferrari guy kept on going even though there was clearly no space and even though the Lambo was clearly in the process of passing. I'd say it was the Ferrari that ran into a car that was already passing, not the other way around.

    The Ferrari guy stayed in the wrong lane for a very long time and was driving noticeably faster than all of the other supercars that were just trying to slowly work their way around the camper.
