    Entirely possible so here is my invoice again where Art threatened a $5,000 financial penalty if I posted my honest review of what was going on down there with his shop while he still had my car.

    That guy was probably the most obnoxious loudmouth of them all when he went on all of the Ferrari Facebook pages proclaiming how they were the first to manual swap a Scud after "Everyone said it couldn't be done" when nobody said that.

    He then went on to proclaim how it was forecasted to fetch 7 figures at auction and when questioned on that he went on to say how stupid we all were for doubting it. I believe it fetched a quarter of that at said auction.

    I'm pretty sure he was behind a lot of the fake profiles trying to silence any dissenting opinions on social media, some of which were photography pages. No surprise there.

    That guy is so far under Art's desk he can see Narnia.

    He's a young guy, impressed to be around Ferrari's but his true passion is slammed Japanese cars. I'm sure Art liked him because he made Art feel good about himself. He didn't seem to be friends with any of the EAG crew, just sort of a groupie. He's a talented photographer, but knows next to nothing about cars and probably even less about analytics.

    For those curious about Libel laws here is a brief summary of California law. This is offered only for general information to fellow car enthusiasts. No legal opinion is intended nor implied. For this not interested, skip this post.

    In California, Libel involves more permanent forms of defamatory statements. Libel consists of a “writing, printing, picture, effigy, or other fixed representation to the eye.” (See Civil Code § 45.) Slander is the more transitory form, generally restricted to oral statements and gestures. (See Civil Code § 46). Web site postings are textbook examples of libel given the lasting nature and impact of web postings.

    Libel Per Se - or Libel as a matter of law - is a special action for particularly harmful accusations. The doctrine of libel per se has long been established in California. (See Tonini v. Cevasco (1896) 114 Cal. 266, 271; Smith, supra, 72 Cal.App.4th at 645; Walker v. Kiousis (2001) 93 Cal.App.4th 1432, 1441). If a reader would perceive a defamatory meaning without extrinsic aid beyond his or her own intelligence and common sense, then there is a libel per se. “A libel which is defamatory of the plaintiff without the necessity of explanatory matter, such as an inducement, innuendo or other extrinsic fact, is said to be a libel on its face. Claiming someone committed a crime is a classic example of libel per se. As Professor Witkin observes, “[t]he charge of commission of some kind of crime is obviously libel per se.” 5 Witkin, Summary of Cal. Law (10th ed. 2005) Torts, § 542, p. 795. No special facts or knowledge is required to understand that a thief is a bad person, for example.

    Libel per se is subject to a defense of truth; but truth is not an element of the cause of action. The plaintiff need only show the libel per se statement was made. The defense can show truth as a defense - but the defense has that burden of proof regarding the truth of the statement posted.

    For example, Courts have held that charging a person with “a violation of confidence reposed in him or with treachery to his associates” is actionable per se. (See Dethlefsen v. Stull (1948) 86 Cal.App.2d 499, 502). Under Dethlefsen, the claims about Art could be liable per se. Of course, truth of those statements is a defense.

    California courts have held that to be liable, a defendant need not make a direct accusation or charge of misconduct; epithets or descriptive words or opinions that carry with them the implication of acts of misconduct are actionable. (See Newby v. Times-Mirror Co. (1916) 173 Cal. 387, 395 [statement that person is “hypocrite”]; Albertini v Schaefer (1979) 97 Cal App 3d 822, 829 – 830 [calling attorney a “crook” is actionable as slander per se without proof of special damage]).

    Again, that may make statements about Art (and perhaps even those by him) subject to claims of libel per se. Claiming he will be in jail may be libel, as might claims someone stole his intellectual property. The determination of each of those requires far more information and a detailed analysis neither present nor intended by this post. I offer only general information to address an issue raised by a poster.

    None of the above includes any review and/or analysis of the TOS of this site. I am unaware of how that could modify the laws regarding libel per se.

    For disclosure, I neither know Art nor have I used his services. I have no financial interest in any car company mentioned in these posts. I do own a Ferrari 599 f1, and I did consider converting it prior to buying it. But I love the car too much as it is to mess with it. I think it is perfect as it is, especially since a 599 is a grand touring Ferrari.

    Now, it is sunny and 65 degrees outside. I am going for a drive. Best use of my 599 on a sunny Saturday …

    In other news it appears that EAGs instagram follower count has now grown nearly 10% since this stuff happened.

    There have been only 3 posts in the last 5 weeks, all 3 of which were last week. Any social experts see similar growth rates on accounts over 30K followers with just 3 non-earth shattering posts?

    That's also wildly anomalous... looking at their prior reels, 95% barely broke 20K per reel. It looks like two have ever broken 1M, and those were in their hayday of posting, which (with my basic understanding of IG), helps the algorithms prioritize and amplify posts. To me, this still feels very manufactured.

    I don't know how the IG algo works but it's my understanding it's not static, it's always changing. 1.2 mill views for the one posted Dec 12, 2022. 1.4 mill for Oct 24, 2022. 1.9 mill for Oct 19, 2021. More recently, 349k views for Jan 12, 589K views for Feb 19. And on the other end of the anomaly spectrum, 760 views for the VinWiki post about the Scud on April 24, 2020. I would have expected at least another digit or two for that one.

    I am heavily involved in the advertising and social media for my own business. I know the numbers. I know the increase in sales per month, the number of videos and photos put out, engagement, etc, as well as the increase in followers. Without disclosing the numbers, lets just say it seems highly suspect. I am sure some people decided to follow after the initial storm, but lets be honest here - how many people outside of serious enthusiasts have ever even heard of EAG? There are people on THIS site that don't know what it is.
