    The judge will rely on the expert's report, the expert being someone qualified in that particular field.
    Ditto for any mechanical issues etc.

    The people who should be cautious are the sellers who treat descriptions like entertainment, with no consequences.

    Understood. However, for every expert on one side, there can be experts arguing against. Consequently, it will depend upon what the Judge thinks and who he believes more...and so there are no guarantees as to the resulting outcome.

    That said, this is all moot... as the dealer needs to step up. If not, they have a lot to loose in terms of their reputation. The F-car World is a small place and word travels pretty quick and especially given the circumstances as presented.

    Each party can hire their own experts, but some countries have a court appointed expert doing the report as per judge's instructions.
    Words will have meanings.

    No guarantees. As with everything, one should leave nothing on the table and make it memorable.

    How many dealers, either franchised Ferrari dealers or independent dealerships, aside from early matching numbers cars do you suppose bother to investigate at all if any given Ferrari still has its original engine installed? My guess is none. Unless it comes up coincidentally they'll never know nor will most care.

    In 45 or so years in the Ferrari business this is the first time it has come up. Buyers for the most part, they few who even consider it accept, especially on older cars components get replaced and accept that fact of life.

    The question I posed wasn't if it's a big deal to buy a Ferrari with a replacement engine, the question was should a seller disclose such a thing if he knew it to be the case. In this case, as I mentioned, the selling dealer absolutely knew. He didn't deny it after the fact. I also asked a contact at RM Sothebys for his POV, and to quote him "Jesus, that's a helluva thing to not mention when selling a Ferrari." Thanks for weighing in, this thread will hopefully help others in a similar journey.

    My view is that the legal position will depend on the relevant law in the relevant jurisdiction in terms of whether you can avoid the deal. But I think the more important point is whether it bothers you. If it were me it would take some of the shine off. If you feel that way then I would look for a way out and that may not be that hard if the dealer wants to maintain reputation.
    To my mind the block number is the second most important one after the VIN and it isn’t the same as a different box/axle etc. I understand others may feel differently.
    Also worth bearing in mind that if values rise these things may become more important.

    Walk away and/or renegotiate the price. If (and when) you sell the car, this will undoubtedly be an issue that will weigh on the car's value.

    Getting in touch with Massini is also advisable.
