Funnily enough, the boat had the right of way. Not that it makes much difference, since the pilot likely never saw the boat until very late. Folks injured came from the boat. Maybe that will motivate other boaters to pay a little more attention.

 

you can see the plane had tried to take-off about a 100? ft before collision - just enough for the floats to avoid a direct impact with hull of the boat.

True. Although I can't believe that the boater was not aware of the plane, unless he was deaf (hard not to hear a Beaver at TO power). I've seen boaters try to get real close to a floatplane operating on the water. As a pilot it scared the **** out of me. As to boaters and ROW, my experience is many have no clue. Seemed worse with Canadians (based on experience on Lk Osoyoo in BC).
