    Ok after half a day of messing around they folded on the cable too. Boy this has been hard work and leaves a bad taste in the mouth.

    Time to blow the car out on BaT, what does everyone think?

    It's sad and a shame when you spend 400k+ on a car and get treated like this. Maybe if they didn't have customers around the block they would start treating their customers differently. (Wishful thinking)

    I swear we are using the same dealer but I know we aren't. Absolute clowns, no business sense whatsoever. Now they are all scrambling like chickens to stay afloat with their bloated inventories and canceled orders.

    I get the part that we should all read contracts etc. But if this kind of things become more and more common, people are going to start reconsidering buying these cars altogether bc no one wants to hire a lawyer to go buy a ferrari. It will basically become as painful as going through a RE transaction which will end up lasting weeks.

    Short term wins for long term losses. I dont see new generation of buyers sticking around after this kind of treatment.

    Like the line-bumping practice a couple of decades ago, it's NOT "incompetence", and I would guess that FNA is not only fully aware, but doesn't care.
    A brief synopsis of a phone call I had with FNA those ~20 years ago, during the "line bumping" heyday:
    "(Dealer) just pushed my last year (of two years) until delivery to another three years, unless I buy a used car that I don't want with delivery miles for $100K over sticker"
    "We don't control what our dealers do"​
    "So I can buy from a dealer in another part of the country who doesn't play these games?"
    "We don't let our dealers sell out of their territory"​

    Yeeaahhhhhh..... Either ya DO, or ya DON'T control your dealers.
    Cured any desire to buy a new Ferrari.

    talking from both sides of mouth is fairly common. I had a very nice chat on the phone with the regional rep for the US west coast on the phone. He was wondering why I wanted to work with a Dealer much farther away from me than the one I had originally reached out to for a new 296. I got the impression things may be different now? Also they are firmly in control of their dealer network was my impression. I'm new to Ferrari so that could be a factor.

    honestly it sounds like a pretty miserable life as a dealer. have any of the dealers actually been that successful as a stand alone business on a budget? I get the impression it is a good vanity business alongside some other actual money maker businesses.

    I think the FTC would be interested in this dealer's tactics. Imposing a lean under your circumstances may not be legal.

    Perfectly legal when it's specified under a written contract signed by all parties. It happens in the real estate world all the time.

    Yes, once you've signed a contract there's little recourse. However, the practice may indeed not be legal according to the FTC if it's a condition of the sale.

    My understanding is they’re pretty profitable, the money comes from service and taking 5 to 10% on the sale of consigned cars.

    Agree, I highly doubt it’s illegal, you are free to voluntarily enter into stupid signed agreements (like I did), which are then enforceable. unless you can show you were coerced or weren’t of sound mind or some other legal out, we would need any lawyers here to weigh in, I think the contracts are absolutely enforceable.

    Really high costs and because RACE is killing it, doesn't mean each dealer is. They have very little power with requirements and allocations coming down from RACE/FNA. Remember the profitability of RACE is 100% disassociated with profits of each dealer owner.

    My contracts with my local Ferrari dealer have all been easy to read before signing, fairly short, and appeared straightforward to understand, including resale conditions. After passing them to my attorney, the attorney has never had issue with them either. I'm happy with the written agreements and the cars I drive.
