Tifosi and SBoney, although I'm a generally pro-business conservative, I respectfully disagree with your views of plaintiff law. Although insurance companies are quick to blame, tort law is a way to deal with economic externalities and damages that companies or people do to others and would otherwise not have to worry about.

If, for example, someone loses their penis (as in a recent case in PA, I think the guy got only $2M), it destroys much of the joy of their entire life, as intimacy is forever ruined and even romantic feelings can become warped and futile. I'd almost rather be dead, if I didn't have a kid on the way already. That's not to say *every* case is valid, but we can't throw out the system altogether.

BTW, people usually bring up the McD's burn victim as the prototypical example of this system gone wrong. What people tend not to know is that a) the woman received 3rd degree burns which melted the flesh off her thys, from the 180F coffee; b) the $250k she got in damages was mainly to cover the skin grafts and hospital bills, with a nominal amount for suffering.

Now, McD's had several THOUSAND burn cases like this reported, and hadn't done anything to change their coffee. So the jury awarded the $3M in punitive damages, equal to the profits of ONE DAY's coffee sales for the McD corporation, which has $28B in assets. That $3M was reversed on appeal, leaving the woman not really better off than she was before the accident. McD eventually lowered it's coffee to a more reasonable 140F.
This was from a Biz law textbook and my professor who was an AZ plaintiff's bar member.

Ironically, in Europe you can get speeding tickets for $14,000 if you're rich (ie. Finland takes a % of your net worth), but get nothing if you're hit by a speeding driver.

Make no bones about it.... tort law was enacted by our lawmakers (read: lawyers) to keep an elite group of lawyers RIDICULIOUSLY rich.

Most people who end up with "large" settlements end up with a SMALL fraction of the $$. Why???? because the "crusaders for the little guy" who are valiantly fighting the scourge of "big business" are rolling around in the $$$, almost choking because the pile is so big.
You can not put a price on "pain and suffering", regardless of what part of you may or may not function properly any more.
the tort system is a large fishing expedition that leaves the lawyers target with no way to "win".... "winning" only means the case goes away, after very large legal bills (which made more lawyers rich).

Ryalex, not to disagree but the whole issue has gotten out of hand. I know attorneys on this board will think I am trying to prevent them from making money but that is not the case. Do you remember when in the 80's McD had the little spoon coffee stirrers? They had to do-away with them because coke -heads were using them to sniff coke. That is ridiculous, pure and simple. While I agree that there is a DEFINATE NEED for protection, do not get me wrong, just as the case with labor unions and so many other things, current tort law has outlived its usefulness. They have become nothing more than a lottery for attorneys and plaintiffs alike. I agree that catastrophic medical malpractice cases and the like need to be adjudicated, but gimme a break. The tobacco lawsuits... how can you POSSIBLY justify those? Smokers didn't KNOW the risks? Please. As usual, useful tools have been taken by dishonest people and bastardized to where they are not only no longer useful but actually criminal in intent often times. We need tort reform PERIOD!

I presume you do not run a company. I do -- ethically and with every resource I have at my disposal to throw into it. My in-box has something new in it regularly from some vulture. A cost of doing business? Maybe. We fight them all tooth and nail. I spend thousands more on legal fees than on "damages." Hurtful to my investors and employees definitely, distracting to my management team running a business, no doubt.

Show me any social good coming out of this and I will run to the statehouse to support it.

 

It looks scary and, on crowded dayys, probably unreasonable, but this is still a monument and, if you think of it, not much more dangerous than driving fast on an open road you don't know, which we all do to some degree, with trafic coming from the other direction and all sorts of uncontrollable risks.
I am sure that the Nordschleife on a relatively quiet week day must be a stunning experience, really want to go there one day.

Look I think the German's have it bang on. No speed limits ( in places anyway ) . And if you want to go out on a track and flog your car with a bunch of like minded people go fill your boots. But don't come crying to us later when you prang the 360 / 996 etc, or kill yourself.

I'm surprised no one mentioned Jens and Amar in this thread - I never met either one but it felt like we all lost members of our extended family there.

 

What's the story there?

 

Two active members of the FerrariChat community met at the 'Ring for a day of hot laps last spring. They were riding together on one of the laps when the car left the road, flipping upside down, then caught fire. Both were killed.

It really brought the horror of a tragedy like this into the forefront for many of us.

 

Oh ... well you just gave me a sick feeling in the pit of my stomach and I didn't even know them. That is so terrible, condolences to their families.

I just read about jen and Amar and that is truely tragic. I as read up to the date of the accident they were so excited. Gods Speed to both of them.

 

I'm sorry. The part where the Porsche spins, and then backs up mid corner, is one of the reasons that you will never catch me driving even 5/10s on this track.

Funny, I don't remember signing anything when I went out on the track, just paid and went. I rented an Opel and drove the tires off of it.

 

Okay, that is freaking ridiculous. How about the fact that some of those guys just back on the trackin the middle of traffic. What about the Suby hitting the benz?
