    He was the one giving you the feed back not the other way around. Sorry for the confusion.

    Anyway, I would like to dig into his previous sale of the same item. It smells!!

    They key was introduced to Ferrari Chat by "ROBM3."

    Fact:

    ROBM3 claims in his post that he has no relation to the eBay seller, " m3_smg2." I assume he makes this claim as to appear neutral despite the fact they both have an M3 in the name. Original thread:

    I looked up ROBM3's posts. He has 10 on Ferrari chat. And based on his posts on "Toronto spotter's thread," I make the assumption that he lives near Toronto.

    I then looked up "Dan Simone's" Woodbridge address on MapQuest. It's a suburb of Toronto!

    So it's one of three things

    1) "Dan Simone" is ROBM3 and is a liar from day 1
    2) "Dan Simone" personally knows the eBay seller through a local connection
    3) Total and complete coincidence

    I also think these are listed in order of most believable. I bet we never hear from him here again... and if we do... let's hear an explanation!

    if you paid via paypal, call up your cc company immedately, and explain this to them. Now paypal will contact this person ask him to prove the that he actually shipped the product, which is why he send you the box, beyond that i think you and/or your cc company will need to fight it out w/ paypal. But call your cc company right away to put in the claim.

    I'm sorry to hear about your situation.

    I am a victim of an Ebay scam myself.

    I would contact Ebay and find out what they can do for you.
    If you used paypal,they can try and get some money back for you.
    Just do all of this within the 30 days of auction end.

    P.S.- there is no physical dif. between the Enzo key and 360 Stradale key.
    Just the immobilizer inside the key is a diff frequency for all of the cars.

    I have a meeting tomorrow with my regional UPS rep to go over computer options.

    I can find out what, if anything UPS would do if informed of this scam.

    I can almost guarantee you the folks at UPS would take up some kind of action in this case, and, they have offices and reps in Canada, which gives them better jurisdiction than you do in the US.

    It is very difficult to pursue fraud across the border into Canada. The Canadians just aren't that interested. (Been there, tried that on a bad check from Canada a number of years ago.)

    I'll pop the question to the folks from UPS in the AM.

    I ship daily with UPS. The minimum weight you can enter when printing a ticket is 1 pound. It sounds like you got scammed by a dumb criminal! The tracking / print ticket on the box should have the exact address where the box was shipped from (POST IT HERE!). You should not have a problem tracking the shipment (unless the sender went to a UPS shipping location and paid cash with a bogus name).

    Also: I thought I saw this key before! If someone has time look in the Archives, If I recall, I thought I saw these pictures posted by an F-chat member long before they showed up on E-bay (Explaining where this guy got the photos)

    According to the data in the images on roadfly.com the pics were taken on 6/6/2003 (with a Kodak DX6490).

    Why use old pics if you had the key in your possession? Starting to sound more and more like a scam to me :mad:

    F-Chat (You guys) are the best!! I'm thinking that this may end up being an expensive lesson.

    It really sucks that scammers like this rarely get prosecuted. I'm going to wait until tomorrow a.m. to call him again and see if he has shipped the other key he says he has (I know....it's a long shot but ya never know). If he says anything other than "Yes, I have shipped it and here is the tracking number." I will utilize all avenues and F-Chat expertise to bring this scammer to justice. I requested the 2nd key be sent overnight so worst case I will lose another 24 hrs before opening the flood gates of He__ on this guy.

    Again, this community is the best, thanks all for all of the great detective work and information....EVERYBODY STAND BY..I WILL UPDATE FIRST THING IN THE AM!!!

    You should first ask him to take a photo of the 2nd key next to today's newspaper. I bet he can't do it, no key to take a photo of.

    very good, but if this is a scam, which it most likely is, the guy would just ignore everything.

    ebay and paypal and your credit card company has rules and are ready to deal with this sort of matter.

    an intact but empty box already tells you something is wrong.
    the previous auction that ended with buy it now at $1999 with some dude with (0) feedback is probably an accomplice. ask ebay to check their IP addresses, etc etc. Mr. Toronto_Prelude has been a member since Jun-18-01 but (0) feedback... hmm.... okay...

    contact ebay, paypal, and your cc company ASAP if you have not already done so. also here

    I agree Kewpie - The previous auction was probably just a scam to try & set some precident that an Enzo key is worth $2k & then you feel like you got a deal for $500.

    i have used ebay for 3 years now as i am in the uk i have bought classic bike parts from france holland germany usa and never had any problems but i have noticed alot of spoof auctions in the last 6 monthsbikes that are worth £7000 for £3000 and they want the money transfering into an account and then they post the bike a friend of mine bought a bike from a guy in france who said he would deliver it as he was touring scotland on the bike my mate bought the bike for £3100 so the french man gave him a date of delivery asked my mate for the nearest airport so he could drop the bike of after his holiday and fly home sounded great cheap bike and delivered to his door so he sent the money but the bike has never arrived
    also there has been a couple of spoof ferrari f50 ads on there in the last month so buyer beware chack every thing out i bought a formula boat from the states not on ebay the guy sent loads of pictures but i smelt a rat agreed to buy it for $21000 dollars and he said he would drop it at a shipping agent which was 60 miles from his house said he needed the money quick for a divorce i got his bank details and emailed him that the money was ready to transfer when the boat was at the shipping agents compound as they had the authority to release the money but he never got there another scam

    here i am again, just talking about ebay....

    i was a buyer on ebay (with about 750 items bought), without problems, and indeed 6 months ago, the problems began.

    I send money to several sellers, without receiving the items.

    one disapeared, with 20 negativ feedbacks, i lost 100 $....

    Then the last 3 sellers put negative feedback, because they didn't receive my money.
    It were cheap autographs, no matter, i send the 3 guys the money AGAIN !
    Yes, i paid them 2 times, and what happened, 1 of those guys just claimed he never received my money, even after 2 times.

    Yes, i took contact with ebay, and they asked me payement proof : but for items between 5 and 10 $, you don't pay them with bank, but send money by post, so : no proof : they pull me away from ebay.

    No matter of course, i registred with another name and email adress, but just to say that i've been waiting for 4 months to register again on this f.....ebay site, and just bought my first autograph in 4 months.

    Those fake sellers have more rights than buyers, but how can we proof we send money.....how can we proof we never got the item, and how can we proof the box we received was empty .....

    I bought F1 wheels, signed t-Shirts, F1 parts, autographs, programs, ... without problems, but now i think trust is gone.

    I THINK THE END OF EBAY IS NEAR....................

    If the seller doesn't come up with a solution I say that you should post his cell # here and everyone can give him a call. I know it isn't the mature thing to do but this guy is a scammer. The cell # is probably not his though. If it is then he really is a dumb criminal.

    If the seller has done this before, and they've paid a claim, you are probably out of luck, as UPS will deny the claim.

    Additionally, if he has not done it before, they will pay the claim, BUT TO HIM, not you, as he is the shipper.

    If you put in the claim, and they find it to be fraudulent, which they show by asking the seller to provide proof of value, i.e. a sales receipt for the original purchase price, then he would be ineligible for any additional claims with UPS for four years, and they would deny the claim.

    They see these scams all the time. If it's someone they are already aware of, and enough money is involved, they prosecute. If not, they just put the parties on the UPS bad guy list, and treat them like the scum that they are. Oh, and most of these scams are shipped UPS Next Day Air (red label.)

    So, if UPS has no claims from this guy, and you file, HE GETS THE MONEY. You have to get reimbursed by him.

    Looks like either way, UPS is not going to be the way to get your money back.

    Thanks for the information. That is great info. for future transactions for everyone.

    HERE IS THE LATEST UPDATE:

    The seller emailed me last night. He found about F-Chat and this thread and was pretty alarmed and upset by all of the information about his history, etc. that was immediately posted by all of the members (I tell you F-Chatters are quick to react when a fellow F-Chatter has a problem).

    He apologized and said the entire mess is a mis-understanding. He explained that his previous auction for the Enzo key ($1999.00) was bid on then went unpaid.

    I spoke to him on his cell phone and he said he shipped his other Enzo Key out today via UPS next day.

    He seems genuine and really wants to make good. I will update everyone when I have more information.

    In the meantime I've asked Rob to remove my post that has his address on it as a courtesy, in the event the entire mess is really just a mess and not a scam.

    EVERYBODY STAND BY!!!
