first: I have been following all the old threads and even did a search, but would still like any advice. I was out driving around today looking for a shop and a cop noticed me and pulled me over cause I was "suspisous". Anyway after he took my licence and came back he warned me to be careful cause Im pretty close to getting my licence taken away for life!!! Now Im 22 and got it when I was 16. In 2000, 2001, 2002, 2003 I had no tickets at all. In Jan 04 1 for speeding, Feb 04 got 4 in one stop (*****head cop in an unmarked car was hasseling me for over 4 miles till I gunned them he stopped me, nice) got em for speeding, improper lane usage, improper passing, and ignoring a stop sign. In March 04 another for speeding, so a very bad first 3 months of 04 Then I was a good boy till August when I another for speeding From all points added up they finally suspended me in Dec 04 for 30 days In July 05 got one for improper passing (a guy waved me around him, cop didn't care) And finally in October 05 another for speeding, but Im going to court to fight it. This cop also told me that "I would probulay loose me licence after this", but nothing about for life. I understand the suspesion for 30 days, but then next would be life?!?!?!? I would think there would be a 6-12 month suspension before that. I have around 30-34 points. Now before you go all off on how bad of a driver I am, I had 4 years of nothing then ONLY 1 came from Indianapolis, the rest from 2 cities north of Indy where they have 0 crime and all the cops do is give tickets, plus if it wasn't for the *****head that gave me 4 in Feb 04 I'd be fine!!. Also, they only ticket me when Im in the NSX, not my 2 trucks. It's the kind of crap like 5-10mph over and they write me up for 16mph+ over then they always run my VIN and question if its mine ect. I checked the Indiana BMV web page, and that was very little help . So what Im looking to find out is what gonna happen when I get my next ticket or I loose the one Im fighting?? Will some tickets from 2 years ago affect them suspending me now?? I think they drop off at 2 or 3 years and are only considered for habitual offences. Plus WTF is up with loosing it for life??? Since I was suspended in Dec 04 (for the 4 ticketed stops) all I got was the one for not passing correctly and the one for speeding that Im fighting, why would they suspend me know over just 2??
call a traffic attorney now. it looks like you didn't use one with your other tickets. always use one, it's worth it in the long run.
It sounds like you're getting a bit of a raw deal combined with some bad luck. I'd move away from that place. Good luck getting it sorted out.
8 tickets in less than 2 years - Maybe you should try a defensive driving course before you go to court--that will help --judges usually like when someone is doing something to better the situation. It can only help your case when the license issue arises..
I prefer to look at it as 8 tickets in 6 years ....of which 4 were in only one stop I took one they made me take after the 4 ticket stop, it was a 4 hour tape from Blockbuster that I phoned in the answers. But I'll DEFFENTLY look into taking another before I go.
34 points is outrageous......many states suspend for 6 months at 14 points. good luck, hope it works out, but maybe you should really JUST STOP speeding for awhile.
retain an attorney who knows the system in your jurisdiction, please ignore all other advice.............
Yeah I don't mean to sound rude, but I bought a Corvette when I was 16 (worked a triple-size paper route since I was 11 and saved up the money to buy it by the time I got my license). I got probably 5 or 6 tickets over the course of 3 years I owned it. At the time I thought I was being hassled, but looking back, I drove like a punk. I was always 10 over the limit, cutting people off, etc, etc. I bought my Viper when I was 21 and owned that for about 4 years and I only had one ticket in that car, and it was 95 in a 65 and was a legit ticket, even though he got me as I was passing someone who really pissed me off. I have a hard time believing that 8 tickets in 2 years is a fluke and the cops out to get you. I drive a LOT all over the USA, and I drive to and through Indy 3-4 times a year and I have not noticed the cops there to be any worse than anywhere else. If you are going 5-10mph faster than the rest of traffic, you stand out. If you are going 5-10 over like everyone else, you wont have a problem. I think you probably need to slow down.
Not to rain down on your parade at all here but you did every one of those offenses right? Stop doing that! You really have no one to blame but yourself here. Do you need to speed? DO you need to pass people to get where you are going an extra 30 seconds or a minute quicker then you would if you didn't pass? You know I would love to pass all the idiots in life but sometimes you can't and you need a little patience.
If you were very apologetic when you get pulled over you would probably get a 'no seat belt ticket' even if you were speeding. When you leave a pull over with four violations it seems pretty obvious you give the police an attitude. You are now viewed as a habitual offender, and the judge is going to see the 4 for 1 deal and conclude you gave the police officer a hard time. I suggest you pass on buying the Diablo until you have zero points, as driving one of those is begging for it. You will not lose your liscense for life, but you may lose it for a few years, at the end of which you will have to start all over taking driver's education classes. Hire an attorney and keep quiet in court. Moaning about how 'this isn't fair' will only make it worse. The only time a judge gives a little is if you eat lots of crow, apologize over and over again and promise to never ever ever do it again. Driving is a privledge, not a right, remember that. If you do lose your liscense, do not attempt to drive thinking you can get away with it, unless you like the idea of jail time.
Here is the Indiana Criminal Code for traffic violations http://www.indianalaw.to/htv2001.html it should answer all of your questions. Until you get this cleared up I would suggest get an attorney to represent you in court and get some lighter shoes...the ones you have now seem to put too much weight on the accelerator pedal. Your only other out is to sell the NSX (I can't imagine what your insurance premiums are anyhow) and drive your trucks until the state forgives your past indiscretions. Good luck.
thanks! I found this (c) A person who has accumulated at least ten (10) judgments within a ten (10) year period for any traffic violation, except a parking or an equipment violation, of the type required to be reported to the bureau, singularly or in combination, not arising out of the same incident, and with at least one (1) violation occurring after March 31, 1984, is a habitual violator. However, at least one (1) of the judgments must be for a violation enumerated in subsection (a) or (b). A judgment for a violation enumerated in subsection (a) or (b) shall be added to the judgments described in this subsection for the purposes of this subsection. Now if Im unsucessful with the last ticket that would make 9. But even if I got one more would I still be ok as long as it doesnt involve section (a) or (b) which involves death, manslautor, or drunk driving. Plus 4 of the tickets came from one stop (incident), so would my 9 be counted as 6?? Theres no way Ill make it to 2014 without another ticket, bright yellow cars stand out.
I know. I usually dont say anything unless they ask. And with my plans on the Diablo I know they're gonna see me Some tickets I deserved some I didn't but they do target a bright yellow NSX that gets 4k miles a year most on Saturday mornings than 2 white trucks that get 12k a year. Also I stay outta Fishers and Carmel cause of all the stops, finally got the last one in Indy, he was waiting over the crest of a hill trying to meat his quota. And the 4 in 1 stop was the most f'ed up thing Ive even seen with ANY cops. Immediatly he got out of his car screaming at me after tailgating and rushing me for the 4 miles and weaving alot behind me. He then persits to barrate me that I "dont derserve a car like that" and rants on and on while I just sit and listen. He even took out his stupid traffic book and read laws off to me. He's one of those "everyone made fun of me in school and now that I have a badge Im getting even" kinda cops. The judge didnt care less, which I expected....if that stop wasn't entrapment I dont know what is! I've been doing my best since the Aug 04 stop, but with the NSX I'd never leave 1st (except the highway) if I couldn't go 1 mph over the limit. When I speed and get caught I deserve it, but if it wasnt for that dickhead with the 4 in 1 I'd be fine, and every cop and judge thinks Im just a menace. Apparently that 3 month span of my 6 years of driving is the only thing that matters to them
Like a previous poster has already said it shows that you were more than likely giving the officer a hard time and he socked it to you. Are all offenses written on that ticket correct? Were you doing those things? If you were stop complaining about the officer and start complaining about your driving.
are you a cop??? jk, lol, the only thing I actually did in that 4 in 1 was roll through a stop sign. It was at a RR on a small hill and he was right on my ass, I didnt feal like slipping the clutch to avoid sliding back into him. I didnt ***** or argue with him either, what good would that do? And if you read my post, the minute he got out of the car he was screaming at me. I just gave him blank stares and polietly answered his q's, when he found out it was my car and not "daddy's" he really went apesh!t. He ended up giving me 4 seperate tickets, I just thought he was some dickhead in a camero that wanted to race me, I didn't want to, that's why I put up with it for 4 miles. Finially we came to an area with dirt in the road and I pulled to the right and slowed to 10 mph, he came flying beside be and then cut behind me with nobody else around, so I "gunned" it in 2nd (so it wasnt a fast acceleration at all) and he hit the lights, it didnt even hit the 40 mph speed limit before he hit the lights. Im not *****ing "why me" or "Im a victim", cause its pointless and noone cares. I could be 100% innocent and it wont change anything, the cops there are nothing more than a revenue generating department, thats why I never bothered to fight the tickets...what for?? to waste my time and pay court costs. The judge could give a **** less weather Im right or wrong, he's just a rubber stamper. So since it looks like Im SOL and gonna have to bend over and take it, Im just trying to find out how I can minimise the damage. Im deffently going to have to get some legal help....and some anal lube
The next time someone is riding your rear bumper, turn down a side street. If there are any retail businesses, pull into their lot. If there is absolutely no where to turn or go into, just pull over and act as if you are receiving a phone call. When confronted about why you can afford such a car, say you purchased it with money you inherited. If you really want to stretch it, tell the cop you had five of the six winning Lotto numbers and you won $92,000. The lesson is, you are so sorry you made a mistake, you will never do it again and if it was not for just some dumb luck you'd be driving a AMC Pacer. Ask the officer how he likes being a cop and tell him how you were considering it as a career since you life needs direction. Remember, you are young, dumb and sorry. I have successfully talked my way out of tickets many times.
haha! I like that advice Im going to use that!! It sucks that I get treated differntly depending on what I drive, but I guess kissing their ass will make them feal better. I'm rather humble and soft spoken and have found out twice that acting like a scared lil b!tch works pretty good lol, just dont do it with a girl in the car !
1. Hire an attorney, RIGHT NOW. 2. Slow the hell down. 3. Repeat #2, often. I don't think I understand this. I've been driving fast cars for 30 years. I've had (KNOCK ON WOOD) two tickets in that time, and no accidents that were chargeable to me. (KNOCKING AGAIN ON WOOD.) Just owning a fast car is not giving you license to drive like an idiot. If you got 8 citations, you probably deserved 800. You're gonna kill someone at this pace, and it won't be you. Sounds to me like your brain disengages when you sit in the car. Maybe a nice weekend at a Bondurant school for street driving is in order, maybe that'll help you understand safe highway driving. Then take a track course and spend some weekends driving the Indianapolis road course wtih the Indiana chapter of the NSX club, instead of racing on I80, or whatever big flat interstate runs by you. Feel free to ignore my advice, except for #1. Find a good lawyer. At this pace, you're going to need one.
I agree with the people who suggested a driving school and a good lawyer. ...and I can't help but point out one of the many spelling errors in your posts: it's "feel", not "feal". There are tons of others, but that one was really starting to annoy me when I saw that it wasn't a typo.
yes, Daves advice is good! ya, I suck with spelling. Fast typing, no spell check, and no proof reading is to blame
IMO, the 4 in 1 would count as 4 because it looks like all four were moving violations. The law counts tickets, not number of traffic stops. Every once in a while you get a dickhead cop that wants to throw the book at you. Get a lawyer! I was once stopped for going too slow! No ticket, but since they stopped me they had to find something wrong, which they did... a broken taillight. Some cops are just looking for a fight, don't give in, they always win!
Uh, no would be the answer to the would your 9 be counted as 6 question. These would all be considered individual offenses just like if you killed 17 people while robbing a bank they would not just charge you for 1 murder or just the bank robbery...sorry each is an individual offense...here is what I think happened when you got stopped last time. The officer looked at your past record and decided it was time for someone to give you a "come to Jesus speech" and he did this. From the Indiana Crim. Code it looks like you need to be a habitual offender and cause someone great bodily harm to loose your license forever (and even then you can reapply after 10 years) and you haven't killed anyone yet...listen closely to that YET...you need to slow the hell down, even 6 violations is too much! But you don't want a lecture so here is my 2 cents. The officer that told you that you could loose your license was trying to scare you. Seems he made his point. Do yourself a favor and get a Bently instead of the 6.0. btw there are *********s everywhere I got pulled over and written for 26 in a 25...THAT is some BS, yours seem like legit stops for the most part.
Man I don't know why you guys put up with that Nazis bull****. We don't have anything like that in Texas. I get a ticket at least every 6 months. I have had well over 40 in my driving career with no fear of losing my license. We don't have any kind of bs points system. Texans won't put up with that crap. You guys need to write you law makers.
