    What is the story on this impounding business? According to my son, in QLD, if the car you are driving is impounded under these provisions, the State has the right to sell ther car and keep the proceeds, even if the car you were driving is not even yours, if the driver has two previous convictions. How does this work with cars under finance?

    'Misuse of a motor vehicle' wonder what that was.

    I don't know the whole technical side of the confiscation is here in QLD but I have seen plenty of example. They just leave you standing there on the side of the road.

    Funniest example I've seen here on the coast was on the news. They were interview an officer in Surfers whilst behind him you see a VN commodore come around a corner sideways, tyres squealing. The cop just goes 'hang on' walks out into the middle of the road and pulls the bloke over and confiscated his car. hilarious.

    Qld has a 3 strike rule.
    - 1st offence of "street racing" -- they impound your car for 24hrs.
    - 2nd offence of "street racing" -- they impound your car for 3 months.
    - 3rd offence of "street racing" -- you forfeit your car to the crown.

    the car will be impounded, even if owned by a third party
    [there are escape provisions for this however]


    Finance is a good question.
    If the car is listed as an encumbered vehicle, then you would expect the finance company has a right to the proceeds.....?

    there was a hilarious article in a local newspaper recently.

    - young hoon fronts court, facing his 3rd confiscation.
    - the magistrate orders he surrender it.
    - young hoon goes home, and with the help of some mates, strips the car back to a rolling shell in a couple of hours.
    - police arrest the kid for fraud......!

    yep i remember that. he had like 2 hours before they 'repo' guys were coming around to take it, so he'd basically just left a bare shell by the time they got there and he played dumb (didn't take much acting). :D

    he was a hero on nissansilvia.com for ages!
