Any Charlotte NC Traffic Lawyers here?

    I got a ticket today I feel VERY adament i did not deserve. I think he clocked the guy next to me.

    I was on a road in Charlotte in my SUV...Road is twisty and very narrow.and its 4 lanes (2 each direction)

    School zone 25 mph..traffic is whizing by me in teh passing lane..Im going about 40 to keep up. I did not know i was in a school zone. (im going back over tomorrow to check the signage.

    So CMPD comes up behind me THROUGH the school zone and has to be going 70 weaving in and out of traffic. Just before he gets behind me a SUV beside me whizzes past.

    He pulls me over..walks up mad as hell... I clocked you going 55 in a 25 in this school zone. I was silent..handed my Lic and papers over.

    Hes writing the summons. He comes back.."you have kids? you really need to slow down. He said you HAVE to come to court because im citing you for reckless driving also. You nned to get a lawyer or represent yourself and come to court."

    I said nothing..I was afraid Id make it worse.

    I have a SPIC AND SPAN driving record and am always slower than most traffic. There is no way he got me that fast. I know for a fact i was only going 40..as traffic was tight, and others were going WAY faster than me. Also theres no way I could go that fast on this raod in an SUV..the curves are so charp i think it would tip. I think he clocked the guy just before me taht was going WAY fastser than me.

    Ill take the ticket for 40 becuase i was speeding..but not wreckless driving.

    Anyone an atty or know of one in Charlotte?

    Just my opinion here, but here goes...

    With a clean record and a decent attorney, you should be able to get it dropped to AT LEAST 39 in a 25. If you're lucky, maybe even 34 in a 25. The wreckless driving charge will most likely be dropped.

    Hire a good attorney and let him or her do the arguing for you. They will be able to help, and you should not even need to go to court. Also keep in mind, it doesn't matter if everyone else was going 125 mph in a 25, all that matters is how fast you were going! It would basically come down to your word vs the cop's... and guess who always wins that one!

    Oh yea, sorry, but I don't know any good traffic attorneys in Charlotte. I could help you out in Newberry, SC though!!!

    Hire an attorney.

    Anywhere else, that speed isn't the end of the world. But, in a school zone, the judge will be very tough... almost regardless of your defense. I'm not taking the side of Johnny Law here, but the judge would probably say:

    "If traffic was whizzing by you, you could have slowed down and kept everyone in the school zone safer"

    You were very, very smart to say nothing.

    You need to determine what method he used to clock you.

    If it is radar, then you have the right to challenge him as to his experience with radar, his knowledge of radar, and when he last calibrated that instrument prior to stopping you, etc.

    It works. I have been successful with that many years ago.
