hey guys, i typically just lurk these boards but thought that i might as well seek more help by posting here.

May 26th I was pulled over for speeding (39 in a 25). Was ticketed, paid the ticket, and am now doing traffic school this weekend. This should leave me with no pts.

With even a greater level of stupidity,
I raced my friend in his 2005 smg Interlagos Blue Competition M3 (beat him 2x, woopty doo). It was around 10:00pm, little to no traffic here in Los Altos, CA/foothill.
Anyways, the cop who saw everything pulled us.

LUCKILY, he gave us both warnings for street racing, and marked me down (after much begging and pleading) to a misdemeanor for reckless driving which is 2 pts. Even if it shouldn't matter, speed limit on the road is 45mph and he marked me as going 30+mph. You can get reckless driving at 2 mph for doing donuts.

With all this stupidity, and me deserving this AND getting off somewhat, how much can a traffic lawyer save my ass. How bad is a misdemeanor---does it go on my record, will it cause more harm than just affecting my insurance?

The cop told me that he marked me for reckless driving b/c 1-i was racing, and 2- i was peeling out/"getting sideways"---which i wasn't.

    The scenario was this.
2 Lane road at a light at an intersection. I am on the left lane, and my friend is on the right lane. The cop is apparently down the intersection street on the right hand side----so im thinking that his view of me 'peeling out/getting sideways' was blocked. But whatever---we both knew i was being an idiot, and we both know that it's his word vs. two 22 year olds.

How much can a traffic lawyer help me?
    How much should it cost?
and how much will i suffer if i don't get a traffic lawyer or if the lawyer loses?
note: i will have 2 pts. on my record and a misdemeanor after i clear my first speeding ticket with traffic school this saturday.

THANK YOU for reading about my stupidity.
    please drive safely/with intelligence.

Dude, it is best to get a lawyer anyway because it's a misdemeanor and you do NOT want that on your record. Get it knocked down to a "speeding" ticket. Getting a misdemeanor--even if you get a lawyer--you will go to CRIMINAL court to contest, not the regular traffic court. If that isn't traumatic, if you represent yourself, it will be highly unlikely the judge will be sympathetic towards you. So get a lawyer--although it will be comparatively costlier, it's worth it in the long run. Do NOT settle with a misdemeanor. Good luck.

A misdemeanor puts you in jail for a maximum of one year and/or a fine up to $1,000. If this is your first speeding ticket/wreckless driing, you would probably get a low fine...trust me i work for the sacramento pd, but do get a lawyer!!!!

    1. Delete your post above, or edit it so you are speaking hypthetically and not admitting to anything.
    2. Getting a lawyer will help, as long as you get a good lawyer.
    3. Forget the cost. A criminal record can affect you in many ways that you are not even aware of. Those repercussions can cost you tens if not hundreds of thousands, and more importantly, missed opportunities and a blemish that will count against you. You want to avoid it at all costs. Anything less than 5 grand is a decent price, and I am sure you can get a good lawyer for 1/10th of that.
    4. You ask how a lawyer can help you. Simple, by getting the charge changed to some other trivial charge. No points, small fine, you're done.
    5. I know of an attorney who can help you, but it all depends on the details, so PM me. The one I am thinking of has a small practice in Burlingame. Her associate is an ex-state trooper. I cannot recommend tham highly enough.

Also, I am not an attorney. Just want to make that clear.

And for Gods sake do not drag race in Los Altos again. I grew up in Los Altos, and the cops there have nothing better to do then pull people over for doing 35 in a 25, and help Ms. Smith get her cat out of a tree.

I got pulled over in Los Altos one time for making too fast a left hand turn - whats up with that??

Faisal, for a second there I thought you'd recommended me, and you know I hate that sort of work. Hope you enjoy Austin, have you looked your buddy Dave up?

How come it's so important that he speak "hypothetically" and not really state that he admittedly did all that? Is it a legal thing? Forgive me for asking a stupid question, but wouldn't it not matter? It's not like anyone like the officer that gave him the ticket would read his messages on this board, right? Or is that specifically the reason why?

That is specifically the reason why. There's all kinds of jackasses out there, and an innocent comment can easily be twisted around and used against you. It's not hard to imagine someone saying something to someone else and eventually the officer hears of it on a "Ferrari board", does a search, and finds the post. The chances of winning or even leniency in court when this "confession" is presented...zero.
