    good luck. i assume you've reversed the charge with your ccard company - usually they won't leave the customer holding the bag, though i don't know how it works when the provider's bank accounts are frozen, etc.

    Dean, that entirely sucks. I assume this means Chap 11. If they were Chap 7, at least we could go buy some of their assets then sell 'em on eBay.

    Really, I'm very sorry to hear of this. Bankruptcy laws are not kind to creditors, and you're probably behind a long list of parts suppliers, employees, and banks.

    USUALLY, THEY WILL HELP YOU OUT IF NOT TOO LONG GONE, I THINK 60-90 DAYS.....

    I WOULD CALL THEM ASAP..........

    You used your credit card. Chapter 11 or not, if you didn't get the goods, you should be able to get a refund from the Visa folks.

    Get a claim going, in writing, RIGHT FRIGGIN' NOW. Don't do it over the phone, has to be in writing, although a call wouldn't hurt, come to think of it.

    GO! GO! GO!. Time's a waisting. Only get 60 or 90 days to contest a charge, I think.

    Already talked to the CC people. You would think that a comsumer with a payment for product not recieved would be ahead of creditors such as steel providers etc, but I don't know.

    She said they are sending me a "dispute form" to fill out and send back with copy of letter, etc.

    The CC lady was sketchy, but hopeful I could get my money despite the fact I paid in full. Doesn't that suck? You pay your card in full and get screwed??!!

    Reverse the charges, post haste!

    I would think that, if they do not have the money, you would still get your money back. It's part of the 18% fees those CC companies charge. Its really no different than fraud... you charge for a product, you get said product. In the event you do not get it (for WHATEVER reason), the CC gives you your money back and collects from the charger. If they don't/can't collect, tough cookies.

    That's the way they work it. Then they send a copy of the dispute form to the vendor. He gets about ten days to respond. in your case, I'm guessing he'll have a lot of these to do, and what response can he give? "Oops, I went broke?"

    If he can't provide Proof of Delivery, then you get your $$$$$ back. Simple as that.

    Hmmmm... Wait a minute. If the vendor doesn't have any money, and you don't get your stuff, where does the CC company get the funds from? Do you have purchase protection??

    Oh, and next time, don't freakin' prepay for some stupid car stuff. WHAT WHERE YOU THINKING THAT DAY?

    But, on the upside, if he no pay, you get a loss deduction on your taxes, right?

    In the meantime, I have a great bridge in Brooklyn that I can let you have, just gonna need a $500,000 deposit. You can collect the tolls for the next 100 years.

    They told me they would not charge 'til they shipped. I saw the charge come thru, felt happy as I figured shipping would happen sooner than the June promised date, didn't notice they charged it on the 4th of April! That would have been a hint, had I noticed that.

    Of course there is nothing in writing about not charging 'til ship, just the guy on the phone.

    Who would have thought such a "good" company would pull this crap? :(

    Bad day huh.........

    Well, the CC comany should make you whole. Just dispute it. You can probably get a form online. You didn't get the product. It is as simple as that. The CC lady should have made a note on your account of the dispute so there are no finance charges while being disputed.

    So the guy who has trouble pulling the trigger, pulls, then this happens? Whos lift are you going to look at know?

    I had some issues with items being charged prior to shippment too. I looked into it and it is against the CC co's terms if not the law in your area to charge you from goods until they are shipped unless it is a custom built part.

    Thanks for the heads up. I had Autolifters on my "to do" list. After this dies down, I would like to know what your parameters were for selection so I can make an informed decision. I want a good lift for the 355.

    That's a real drag getting stiffed.

    I feel terrible about this. I have an Autolifters and I have recommended it numerous times on this site because of the sound design and good build quality. It doesn't make up for bad management.

    I could be completely wrong but I have seen numerous companies fail because too much of the company cash flow was diverted for personal use instead of back into the company for stupid stuff like paying supplier bills, wages and taxes. .

    I really wanted to see you get that lift and get your shop set up. Go for a big name when you shop for another. There are guys on this site that can probably research the viability of the outfit before you place an order.

    Get the money back. It is the law. You are protected by the "fair credit billing and fair credit reporting acts" If you don't get your merchandise you get your money back from the credit card. There is an agreement that we merchants have with the creditcard cos. That is that they can charge us back. The problem of fraud or banrupcy is with the credit card co not you. Write to the creditcard co and tell them


    You are disputing this charge xcyz in accordance with Fair credit billing and fair credti repoting acts. Tell them not about backrupcy but tell them You have not recieved your merchadise and the company is not responding to your request. That is all you have to tell them period and you have the rights to your $ back. I have done this before with bad merchants.
