Would a buyer be just as penalized as the seller? I would think so, but i'm new to the Ferrari pre owned market and really would like some pointers.

That no-sale clause is a contract between the original owner and Ferrari. The second buyer is not a party to that contract and has no duties thereto. Only the seller is at risk for breach of contract.

Excellent thank you. Legally in the clear, but would it affect me getting preorders on New Ferrari's. I do want to play it so i can get new production models and play it the right way.

You would not be affected in any way. You are not the one that is in breach of the contract nor a party to that contract.

How would Ferrari learn that the seller breached the contract? Unless they’re notified by the buyer or seller directly, how would they know?

Registration data is made available in most states. It’s a very big business.

How about if the "2nd"owner needs to take the car for some service or warranty work at the dealer before the clause mandate is over ?

    Sure about that ?
I've been lead to believe that at least in here in California there are some privacy laws/rules in place to prevent easy access to registration data.

No issues buying it. Take it to your local dealer for service, and establish a good relationship with them moving forward.
You could even let them sell it for you whenever the time comes, and get in their 'in crowd'

Times are changing, my understanding is that as long as you put down the deposit, and are willing to wait for your allocation, you can get a Roma, Portofino M, F8, and so on.

If you are wanting special editions, I think it best to purchase your Ferrari from the Dealership you are wanting to do business with.

    Just my understanding...

The Ferrari world is a small world, aside from the numerous sources and services out there, word of mouth travels quickly, not to mention social media and the like.

    ^^^^ This.
