I've been debating whether I should make a post about this or not. Many of you know me well enough so I'm deciding to go ahead and post. I was able to participate in this years Bullrun rally which has been a disaster ever since. I thought it would be a pretty cool experience but it was the exact opposite. The other participants on the rally are great and I'm glad to call them my friends but thats about the only good thing that the rally had going. If I didn't know anyone on the rally it would have been a living nightmare! The organizer (Andy Duncan) has no respect for anyone especially if your doing business with him. That is at least my view and I have heard others say the same. What a headache dealing with that guy. A few of you also know I have been doing online work for them since last September 2006 from running their myspace profile to promoting them under my name on the forums. I'm glad to say as of August 2007 I'm no longer working for them. Getting back to Andy Duncan. He is riding on probably one of the biggest train wrecks I have ever seen. Not only that I've never dealt with someone who acted in such an unprofessional manner as he does. I give his rally 2 more years before it completely falls apart. I would never post this publicly about someone and would keep it off line but I feel I should let you guys know and be warned about him. Anyways now the underlying issue. I have tried contacting him several times over the past month and a half and he has been avoiding my calls and emails until today. He owes me $1,000.00 for work that I have done over the past 5 months since February 2007 and I have yet to see any money. This probably wouldn't be a big deal to some of you but it is more then just the money which ticks me off. The fact that this guy thought he could take advantage of me just because of my age sickens me.

STAY AWAY FROM THIS RALLY!!!

Posting this doesn't please me at all, but since this is a car community and, for example, dealer experiences almost always get posted to warn others, I decided to inform everyone of the way I was treated by them.

Jason -- interesting to read and I'm sorry you had/are having a bad experience.

Since you did decide to post this publicly, would you mind giving some more details? I very much see that you're angry with them and have a personal issue with Andy, but aside from the fact that he owes you $1k you haven't really said what the problem is. People are sometimes slow to pay (it's a reality of doing business with companies), but what else has you so upset?

Well, said, Jason.

Sorry to hear about your troubles...

...and Bullrun is not a big company. 4 months for $1,000 is just disrespectful.

By the way, I'll have that $1,000 I've owed you since 2005 next week.

Noah,
Here are the emails we exchanged today- *read from the bottom up*

Andy,
You are the one that owes me money....NOT Rory. Please stop telling me to take it up with Rory. I've never dealt with someone who acted in such an unprofessional manner as you do. You know you owe me $1, 000.00. If you don't think I did work worthy of that then please delete the Bullrun myspace page and start new. I was the one who built up the page to over 7,000 friends so it shouldn't be a problem for you to build it up back to 7,000 friends again since it obviously isn't hard work in your eyes.

Andy,
It was a verbal contract. Just like the verbal contract we had that I would supply you with all the pictures that I took from the rally. Stop trying to back your way out of paying me. You owe me $1,000.00 for the work I did. Be a real man and pay up already. Unlike you I stuck to the verbal contract we had.

Andy,
You agreed last September of 2006 to pay me $200.00 a month for working on the Bullrun myspace and promoting the rally on car forums. I was never told to stop so I have continued until the beginning of August 2007. There are 5 months since February that I have worked and not received any compensation yet. Do the math its not to hard- $200.00 a month for 5 months equals $1, 000.00. How are you not aware of owing me any money when you agreed to pay me last September?

Sorry mate, it isn't going to happen – I'm not aware of you being owed anything or any work having been done to warrant payment i.e. no confirmation from Rory.

Andy,
It has been over a month since I sent this and I still haven't been paid. What is your address in California? Since you are refusing to do anything when I send emails I am going to send hard copies to your home. You owe me $1, 000.00 and you are trying to back out of it. I'm expecting to have a check in my hands for the amount due before this weekend is over.

While I agree with your point, you know the old saying, " a verbal contract ain't worth the paper it's written on." I do hope you get what is owed you, but don't hold your breath...

10. Sorry for your troubles about this. I hope that you do get your cash, but in the interim, let this be a lesson to you about doing business in the future.. You don't have much to stand on if this is just a "verbal" contract, especially in business. Make sure anything/everything is in writing so you dont have to take it in the A$$ next time. I hope this piece sends you the cash, what a c@cksucker

Jason, what can I say? As a business to business this is the BS that goes on every day......It's sad to hear a person that runs BULLRUN would let you down like this. You being in the Bullrun ment everything to you, and for that buble to be bursted like that, killed you. As for you not getting paid, why would you wait 5 months? he should've paid you month to month in advance...... The other thing, if you were maintaning myspace, why you had no control over the password.......I'd ****ing delete it that puppy in a heart beat. Kinda your fault (no control). As for the owner(s) of BULLRUN, shame on you!!!! it doesnt matter what agreement you had or what missunderstanding there was....... Youre going to expose yourselves on the internet like that over $1,000?

Jason, there is no contract between you two, youre a minor. Minors cant enter into any contracts. (I'm no lawyer, but I think I might be right?).

Looks like Judge Judy for you Jason :-}
You can always take him to small claims court although even if you win collecting can be a long tedious process. In the future make sure you have a signed contract.
You do know a good Lawyer (Name withheld), you should get some advice from him.

A verbal contract can be held up in court to the same extent as a written one. However in this case it really would help if there was a 3rd party or witness.

This is rediculous Jason, and you are right for publically posting this. I am also glad to see that you posted it in a professional and mature manner without name calling like some people's bashing threads. This will show anyone reading who doesn't know you personally just how mature and respectful you are. You do not deserve to be treated like this and I hope you get what you earned in a timely fashion. I know I'm a nobody, but you're a good friend and if I can help in anyway with anything don't hesitate to ask.

That sucks Jason. Good luck on getting paid. Hope the members of this forum that know this putz have some sort of influence in getting you paid! Maybe you can start emailing the contestants and or sponsors about this issue.

Good Luck Jason.

By the way, I need a Wide Angle Lens for my XT. Any suggestions.

Agreed: Verbal contract are binding but hard to prove. However: if you have proof of the work you did over the time frame, it's to your advantage. Were you an employee or an independent contractor?? As a minor do you have working papers?
Minors cannot enter into contracts on their own. Best if you can settle this without resorting to the legal system. No doubt in my mind that you are being stiffed. Thanks for sharing.
