calling all eBay gurus!

    So this is the same message I posted on the eBay boards just a few minutes ago. I know there must be someone (or a few people!) on fchat who are insane eBay-ers, and can give me some advice as what to do. In fact, even if you don't eBay, let me know what you think. OK, heres the message.
    I bought a pair of Nike shoes (item # 270251315886) from kmwfootwear, who's feedback looked good. The seller shipped them out to me, and when they got here, I found out they were to small. No big deal, my fault, I check out the seller return policy on the page, which is all fine with me. So I package the shoes on up, contacted the seller (all communication with seller has been via eBay) and sent them to the location provided to me by him, along with a note for the correct size (11.5) along with $10 in cash (big mistake), his restocking fee and where to send the new shoes.

    So I waited for a while to get the new pair of shoes, and nothing. So I send kmwfootwear an eBay message asking how long the shipping normally takes, he responds about 7-12 days. Thats fine, but then I wait for 3 weeks, and still nothing. I send him another message, and nothing happens. No response, nothing. So after about a week I start an item not received claim, cause I'm out $95. I tell him my situation, and he provides me with the tracking number for the first pair that he shipped. I tell him that yes, those were the ones I sent back, I'm wondering where the ones are that I sent them back for. Then another week goes by. I post a reminder in the Not received dispute, and still nothing. It has been two months to the day since I bought these shoes, and I have nothing to show for it, except the $95 that I'm out.

    I've tried to find his contact info., but nothing came up, so I've just requested it through eBay. I was just wondering what I can do, or if its just a hard lesson learned?

    You can try getting your money back thru Paypal if you used them. GL.

    Do you have a tracking number that shows you shipped back? Without that all the seller will likely claim is they never received them and your $10.

    First, make sure you have receipts and tracking for the items you sent to them, back and forth, etc. If you sent $10 in cash, have fun with that because it's gone.

    There are policys both on eBay (use the HELP tab) and on PayPal for item dispute.

    For one, a seller must be contactable and respond to items listed or they can get a shot against their account. You can also request their contact information via a form on eBay and call them.

    PayPal has a resolution form and most of the times it will result in getting your money back and as long as you can supply all the necessary info then they will back you up.

    I would file a complaint in both eBay (which may not do much, but will put a strike on the guy) and PayPal, which could result in refund if need be. Make sure you also continue to contact the seller and keep a record of communications. Don't be dirty or abusive in any email because it can cost your account.

    Thats my best suggestion. I used to be a Power Seller.

    thanks all. Unfortunately things are not looking good for me right now. I know the $10 cash is gone, and I made a couple of mistakes during this process.
    1. Buying shoes on eBay. I do not recommend this to anyone, next time I know I'll just go to a store, even if they don't have the exact pair I want.
    2. Sending the 10 in cash. That was just dumb.
    3. Not requiring signature or tracking number for postal service. Although I didn't know that I would need them, when returning things online from now on, I will always put out the extra 3 bucks to do this.
    4. eBay has told me that they are also looking into this seller, so it's likely that I won't get the shoes.
    5. Paying online in debt card. I've contacted PayPal, and this money is gone to. When I buy online from now on it will only be in CC.

    And I have contacted eBay for this seller's contact information. If I get this, I will be calling him as often as I can, and shooting him an e-mail every ten minutes.

    +1 Happen to me many times. Haven't bought something off ebay in a while. Good place to sell stuff though.

    Yep---Ebay will tell you to send back with tracking, delivery confirmation, etc--So they seller can't say he didn't receive the shoes...
