Can i get out of this?

    so long story short I got a ticket today for speeding, The cop however didn't ask for or check my registration or insurance.
    I remeber somewhere, I think here, that someone mentioned that them not checking for registration was a small technical lapse that could be used to get out of it, sounds dumb, but if it works good news for me :)
    I did a search and there's waaaaaaaaaay too much to search through every last post.
    So, can anyone here help me out with some info on if this could work?
    If I can't, I might be getting my licence suspended for points from early last year :(

    any help is GREATLY APPRECIATED!!!!

    Sounds more like an urban legend to me. What it comes down to is the ticket itself. Has the ticket been misrepresented with false information? i.e. - stating you were driving a 1921 ford civic or having wrong name & birthdate. It doesn't matter what they did or did not ask for, unless someone was ill or harmed in which they did not pay any attention to while you were trying to alert them of such.

    So... what's the scoop?

    There's really nothing I'm aware of that requires the officer to check registration and insurance, but it's one more thing they can write you up for. If he ran your plate (pretty sure on this one) and took your license (I'm sure the address/name matched) then that should be good enough.

    Come to think of it, why in the hell do they even ask for your registration anymore? A few keystrokes and they can pull up pretty much anything.

    How much over the limit were you ticketed for? If you were ticketed for 7 mph over, you could fight it, appologize, show a receipt that you had your speedometer recalibrated and say it was in error. If you were going 10 mph or more over the limit, your best chance was to talk your way out of it at the time.

    If you fight the ticket, you will have to pay court costs, however the prosecutor may offer you a deal that involves no points. Suppose this ticket would cause your insurance to increase $500/year. The ticket is not registered with the DMV until after the court case decision finds you guilty, or you pay it. The prosecutor's job is to make the town money, so you can often buy your way out of a ticket by paying the municipality more. I have never heard of the state police tickets being bought off, but local tickets it is pretty common. You agree to some other infraction, that you did not commit, that has a fine 300% of that of the ticket and you leave having paid the town 3x the ticket amount but with no points. Is it better to pay the $100 ticket and receive the points, and thus insurance surcharge, or is it better to pay the town $300 and the ticket disappears? After you add court costs assume your $100 ticket will cost you $400 to get rid of, probably still cheaper than the insurance costs over the next decade.

    About the only thing that makes a summons fatal (thrown out) is the wrong charge (charging you with vehicular assault as opposed to speeding) or venue (the incident happened in New Hampshire when it REALLY happened in Florida)..of course venue could just be a street, block or hiway too!!! But you get my point.....and the errors can be ammended...
    If it was radar try and go after the radar, other traffic present, the angle of error on the radar.

    Also since speeding is strict liability, (no intent required) getting your speedometer cheked won't help either....you need to view the evidence used against you..ie: radar, vascar (time & distance)

    you are pretty much SOL. We don't really have to ask for registration and/or insurance anymore - we can usually get that info from dispatch.

    All it takes is a license plate. Most usually ask for the forms for two reasons:
    1. sometimes the computers are down so we have already requested/received the paperwork
    2. sometimes the DMV did not put in the insurance info for the plate, so we've already got the insurance paperwork in hand.

    My advice - call the county clerk's office and see if you qualify for a diversion program of some sort. If you haven't gotten a ticket in quite some time, I don't see why you couldn't qualify for it. This way you can avoid points and/or insurance cost increases.
