I'm looking to get a car transported (enclosed) from Chicago to Boston. I had an interesting conversaion with a guy (Gary, Almond Exotics - recommended here by some).
He says he does not provide insurance. He recommends checking with my insurance, but says they almost always cover transport related problems. Other companies say they are "fully insured."
If the car is damaged, who pays?
Should my insurance pay to fix my car if it is being transported by someone else (obviously enclosed, on a truck)???
It would seem logical that his insurance should pay if it was his fault, or the other driver involved (if there was one) if it was their fault..

Anyone been unfortunate enough to have their car damaged in transport???

Without seeing the actual policies of your own coverage and that of the transport company, I can only guess. Under normal circumstances where there are two insurances available, one would be deemed primary. There is a clause about this in your auto policy.

If your car sustained damage during transport and you used the insurance on the car, you would be out your deductible. If the damage was the result of the transport company then your company would subrogate to recover their payment to you plus your deductible. So really in the end the transport company would end up paying for everything. However, if the transport co is an innocent 3rd party this could get harry. Ex. Steve in his buick cuts off the truck.

Ask your transport company of choice for a copy of their policy. A stand up company is going to take responsibility for damages. However, some have clauses that limit their liability, so be aware of those and ask questions and get written clarification on anything that isn't clearly spelled out.

Mark's pretty much answered your question, so I'll just add that I am pretty surprised that he isn't carrying any type of Commercial General Liability policy, specifically bailees coverage to protect any assets entrusteed to him.

I was talking with an owner of a high end auto transport company based here in TX and he told me the CGL is required by DOT. He couldn't legally be in business, doing what he does, without it.

I'm sure Gary has his reasons for not carrying insurance, it may not be required where he is based, and the insurance is probably super expensive. It's also possible that he is self-insured in that he has the liquidity to cover any damages or total loss to his cargo while it's in his care, custody, and control.

I would recommend verifying with your company that the car is covered under your policy against comprehensive damage while in transport, whether the company you choose has insurance or not.

And there is a relevant thread I am going to point you to, but it's not exactly the same circumstance. Still interesting though.

also make sure that whoever you're talking to at your insurance company (eg: if they're a big national firm) is fully cognizant of state-specific rules.

MA (you said you were shipping to boston) is one of the stupidest such states with inane rules.

He (Gary Almond) shipped my car from St. Louis, MO to Corvallis, OR, last December 2004. Yes, he doesn't provide insurance. My car was covered (everything) under my policy so no separate fee was paid. Notify your insurance company in advance.

My experience with Gary was topnotch! There were no sleepless nights...

I just had a range rover sport shipped from wisconsin to boston (went through chicago) for $1395, fully enclosed, bonded, and insured, and that was expedited pickup as well! (delivered within 4 days of booking!!!)

The trucker actually got less than that, but I paid a broker fee. I can hook you up with the transporter directly, he does INCREDIBLE work, and is very anal about the cars he ships.
