    Pics of my daughter's car after a high wind blew some roofing off a building. By the way, the roofing was not attached... it was scrap from a re-roofing job that hadn't been removed, and was left unsecured on the roof.

    By the way, I talked to the insurance adjuster for the building owner, and they are denying the claim, saying it was a Act of God...

    Needless to say, our attorney was called immediately...it's in her very capable hands now.

    Also, the body shop called my daughter and said that they quit entering damage halfway through because the car was 'totalled.' I told her to tell them to finish putting it in so she could take it to the attorney.

    *sigh*

    Advice? Car is a 2000 Pontiac Grand Am.... probably books out a $4K (maybe), and really was in great condition. Looks like I'll be buying a new (used) car soon....

    Did the roofer leave a note under the wiper? God didnt leave the unsecured roofing laying loose for the wind to pick up.

    The roof work was done, apparently, some time ago.... no one seems to remember when.

    I have no idea what the note was...

    The whole thing sucks, for sure... and trying to deal with this, and her, 7,500 miles, and 9 time zones away makes it even more difficult.

    Seems like the claim would be against the roofing contractor.

    Mostly cosmetic except for the windshield? Does the passenger door still open?

    That's what I see. If she isn't too upset about driving a "student" car, fix the windshield, mirror and buff the rest out if you want. Should still drive fine unless I'm missing something major not showing up in the pics.

    Yeah, unless the owner of the building told him to leave it there to save money on a disposal fee or something...

    I don't know if the door opens... I'll have to ask, and she may not know... it was towed to a body shop.

    She's using the 1998 Sedan DeVille I keep in Oklahoma for when I'm home until this gets worked out... so, she's not without transportation.

    She just graduated in June, and started working two weeks ago in the Registrar's office.

    So.... would, if liable, would the obligation only be up to the book value of the vehicle?

    THIS, have a local attorney immediately file suit against the owner, the roofer, and the roofers Bond from the surety.

    We'll show then where God stands.........:D :D

    That's not cosmetic that car is hurt pretty bad, have your daughter also contact HER agent and they will fix it and subrogate.

    I really had promise as a lawyer...LOL!

    Replacement like for like, attorneys fees, duress, loss of use, and if the Owner and the roofer are brothers Federal racketeering might be brought to bear!!

    Did the material come off the building right next to the car - or the next one over? You can see some decent detail of the roof on both of those buildings in google earth.

    Sue the newpaper too, that isn't "rolls of roofing" it's been installed.

    "Leave it there instead of paying disposal".....I'll bet you a quarter right now there's asbestos in it and disposl is expensive.

    also, this is why you never get the "bare minimum" on car insurance.
